Minutes City of Waseca Planning Commission Meeting February 14, 2017 - Page 2 2 APPROVAL OF AGENDA It was moved by Terrell, seconded by Neuendorf, to approve the agenda as presented; the motion carried 5-0. 3 APPROVAL OF MINUTES Staff was directed to make a date change on the January 10, 2017 minutes. It was moved by Neuendorf, seconded by Larson, to approve the minutes of the January 10, 2017 regular Planning Commission meeting as amended; the motion carried 5-0. 4 PUBLIC COMMENTS No Public Comments were received. 5 TRAFFIC SAFETY No Traffic Safety items were submitted. 6 NEW BUSINESS A) Action No. 17-02_PP/FP: Shady Oaks Subdivision; 1601 5 th Street SE Lance Frost, Stonebrooke Engineering, on behalf of Drummers Garden Center & Floral Shop Inc., owner of the property, is requesting approval of a Preliminary Plat and Final Plat for the Shady Oaks Subdivision. The property is located at 1601 5 th Street SE and is zoned I-2, Moderate Industry District. No change in zoning is requested. A complete application for the Preliminary and Final Subdivision was received January 20, 2017. Final action is required within 60 days of the complete application date, and must be taken by March 21, 2017. The site currently has two large buildings formerly used as greenhouses and storage. The northern structure, which includes the greenhouses, is currently vacant. The southern structure is currently being rented to Palmer Bus Service. Surrounding land use is moderate industrial and agriculture land. The site is currently served by public utilities. Changes to utilities are detailed in the Engineering & Utilities Memo and the Development Agreement, which were included in the Planning Commission packet. Bill Green, Planning & Zoning Coordinator, stated there are no environmental concerns at this time. Mr. Green also stated the proposed south parcel would not have street frontage, one of the requirements of a lot in a subdivision. In addition, current utilities run from 5 th Street SE to the greenhouse building, and then branch off to the south storage/maintenance building. Mr. Green stated that Staff reviewed these issues and concluded the utility and frontage items should be addressed to facilitate the approval of the Preliminary and Final Plat. A Development Agreement was drafted between the City of

Staff provided the following Findings of Fact for consideration in approval of the preliminary and final plat: (A) The proposed subdivision, including the design, shall be consistent with all applicable general and specialized city, county and regional plans, including, but not limited to the City s comprehensive plan, level of service (LOS) standards, which may be established in the comprehensive plan for streets and other public facilities and with Chapter 154 of this code. (B) The physical characteristics of this site, but not limited to topography, soils, vegetation, susceptibility to erosion and siltation, susceptibility to flooding, water storage, drainage and retention, are such that the site is suitable for the type of development and uses contemplated. (C) The proposed subdivision shall adequately provide for water supply, storm water drainage and control, wastewater transportation, erosion control and all other services, facilities and improvements otherwise required herein. (D) The design of the subdivision or the type of improvements shall not adversely impact public health, safety and welfare, nor shall the proposed subdivision have an adverse impact on the reasonable development of the neighboring land. (E) The design of the subdivision or the type of improvements will not conflict with easements of record or with easements established by judgment of a court. Staff recommends approval of the Preliminary Plat and Final Plat as submitted for the property located at 1601 5 th Street SE, subject to the following conditions: 1. The property shall be developed according to the submitted plans. 2. All improvements and changes as stated in the City Engineer & Utilities Director Memorandum dated February 7, 2017. Final approval by the City Engineer. 3. The Development Agreement between the City of Waseca and Drummers Garden Center and Floral Shop, Inc. is approved. Danny Lenz, City Manager, stated that upon subdividing, each parcel will be served by separate water and electric connections. Sewer would serve both parcels until 5 th Street SE is extended south to provide lot frontage. Mr. Lenz stated the developer has within one year of approval of the Final Plat to make the improvements. Chair Elsner opened the Public Hearing at 7:12 p.m. Bill Harguth, 413 5 th Street SE, Waseca, Minnesota, had questions regarding the draining of this property. The City Manager stated water drains to the storm sewer into Gaiter Lake. Mr. Harguth voiced his concern of drainage into Ditch 15-2. Mr. Lenz reiterated that any drainage flows through the City owned Lewer property into Gaiter Lake. Mr. Lenz stated drainage issues are addressed in the Engineering report.

Chair Elsner closed the Public Hearing at 7:15 p.m. Commission member Larson voiced his concerns regarding the future extension of the road, and the possibility of a dead end street. It was moved by Terrell, seconded by Neuendorf, to recommend approval of the request from Stonebrooke Engineering on behalf of Drummers Garden Center & Floral Shop Inc., for Preliminary and Final Plat approval for property located at 1601 5 th Street SE, to the Waseca City Council at their February 21, 2017 meeting ; the motion carried 4-1 (nay Larson). 7 DISCUSSION ITEMS A) Update of Previous Planning Commission Items 8 OTHER No Planning Commission meeting was held in March 2016. REQUEST The applicant is requesting approval of a Vacation of Easement in the Clemons Subdivision. LOCATION The property is located at 1904 State Street North in Waseca, MN and is described as: Lots 1 & 2, Block 1, Clemons Subdivision LAND USE The site has recently been redeveloped with a new Dairy Queen Restaurant building with associated parking and landscaped areas. ZONING The property is currently zoned B-2, Community Retail and Service Business District. ENVIRONMENTAL There are no environmental concerns at this time.
PUBLIC UTILITIES The site is currently served by public utilities. There are no changes proposed to utilities with the vacation of easement. There are no concerns at this time in regards to utilities. REVIEW On February 15, 2017, the City of Waseca received a completed application for a vacation of easement for the property located at 1904 State Street North from Lesley Adam with Frauenshuh Hospitality Group of Minnesota, LLC. An Easement Vacation survey was submitted as required and reviewed by the City Engineer. There is a ten foot wide drainage and utility easement running east to west on the former lot line separating what were lots one and two of the Clemons Subdivision. This easement is no longer required. FINDINGS The following findings are necessary for City Council approval of a vacation of easement: 1. The use will not create an excessive burden on the existing parks, schools, streets and other facilities which serve or are proposed in the area; 2. The use is sufficiently compatible or separated by distance or screening from adjacent residentially zoned or used land so that existing homes will not be depreciated in value and there will be no deterrence to development of vacant land; 3. The structure and site will have an appearance that will not have an adverse effect upon adjacent residential properties; 4. The use is reasonably related to the overall need of the City and to the existing land use; 5. The use is consistent with the goals and objectives of the Comprehensive Plan 6. The use will not cause traffic hazards or congestion; and 7. Adequate access roads, drainage and necessary facilities are provided. RECOMMENDATION Staff recommends approval of the Vacation of Easement request on the property located at 1904 State Street North, Waseca, MN. REQUESTED ACTION Hold a public hearing on the Vacation of Easement request and take action on a recommendation to be forwarded to the City Council for consideration at their March 21, 2017 meeting.

PLANNING DEPARTMENT M E M O R A N D U M TO: Nicholas Elsner, Chair Waseca Planning Commission FROM: MEETING DATE: March 14, 2017 SUBJECT: Bill Green Planning and Zoning Coordinator Status Report on Planning Commission Items Listed below is the previous Planning Commission item from the April 2016 meeting and the current status: April 12, 2016: Action No. 16-01_RZ; Hintz Subdivision 1/Lundholm Subdivision - Rezoning of R-3 District to R-2 District The City of Waseca initiated a change in zoning district for the Hintz and Lundholm Subdivisions from the R-3, Multi-Family Low and Medium Density District, to the R-2, Urban Residential District. The Hintz and Lundholm Subdivisions are located west of 10 th Street NW between 9 th and 10 th Avenues NW. At a vote of 6-0, the Planning Commission concurred with Staff s recommendations and forwarded their recommendation to the Waseca City Council. The Waseca City Council met on April 19, 2016 and at a vote of 7-0, adopted Ordinance No. 1042 approving the rezoning of the Hintz Lundholm Subdivisions from R-3 to R-2. Ordinance No. 1042 was recorded by the Waseca County Recorder s Office on April 25, 2016. As of March 14, 2017, the City of Waseca s official zoning map has been updated to reflect the change in zoning.
