In 2011 Bstn Fish Market was granted a Cnditinal Use Permit t perate a Whlesale Gds Establishment with Limited Accessry Retail Sales at 1225 Frest Avenue within the M-1, Limited Manufacturing Zning District. In additin t the whlesale and retail sales f fish prducts, a restaurant was perating at the lcatin. Restaurants are nt a permitted use in the M-1 Zning District, but are permitted by right within the C-3 Zning District. In 2013 the 1.5-acre parcel at 1225 Frest Avenue, was reclassified frm the M-1, Limited Manufacturing Zning District t the C3, General Cmmercial District t allw fr the legalizatin f a 560 square ft dining area within the facility. At the time 50 parking spaces were shwn n the apprved plans. The existing flr plan within the 28,683 square ft building includes warehuse and fd prcessing areas, refrigeratin and freezer areas, as well as shipping and receiving and ffice areas adjacent t the interir truck dck. An additinal 2,400 square-ft dining area is prpsed in frnt f the retail cunter. There are 56 parking spaces shwn n the prpsed site plan, where 75 parking spaces are required fr the prpsed ffice,
Page 3 fd prcessing, and interir restaurant peratins. Per Department plicy the seasnal utdr dining areas d nt require additinal parking spaces. A traffic study was prepared by Kenig, Lindgren, O Hara, Abna, Inc. (KLOA, Inc.) in Octber 2010 with an addendum t include the retail sales use cmpleted in Octber 2011. The initial study cncluded: that the facility was prjected t generate a very limited vlume f traffic, especially during the critical mrning and evening peak hurs; generate less traffic than ther uses that culd ccupy the site; that the existing three access drives will be sufficient t ensure efficient and rderly access with limited impact n Frest Avenue; and that the prpsed facility wuld have a limited impact n the peratin f the Lee Street/Frest Avenue intersectin. The addendum fund that the lw vlume f additinal traffic t be generated by the retail space wuld have limited, if any, impact n the peratin f the radway system. The Mannheim Rad/Frest Avenue intersectin is scheduled t be imprved t prvide (1) a traffic signal, (2) a separate left-turn lane, a thrugh lane and a shared thrugh/right-turn lane n bth appraches f Mannheim Rad and (3) a separate left-turn lane and a shared thrugh/right turn lane n bth appraches f Frest Avenue. A secnd addendum t the traffic study was prepared in August f this year t address the prpsed expansin f the restaurant use. The addendum evaluated the traffic vlumes, lading dck peratins, and parking. The addendum nted that while the area fr indr seating wuld increase, the area f utdr seating shwn n the plans wuld decrease frm existing cnditins. The addendum als ntes that With a ttal f 56 parking spaces, it can be seen that the parking t be prvided with the expansin may nt meet the peak parking demand f the expanded facility. Hwever, the wner f the facility has indicated that he will btain an agreement with ne f the neighbring prperty wners t use their parking lt fr verflw parking. If necessary, the wner has als indicated that he may use valet parking t increase the number f vehicles that culd be accmmdated within the facility s parking lt. The requested variatin f 19 parking spaces is 25% f the 75 required spaces. Per Sectin 12-3-6.F f the Zning Ordinance, a parking variatin f up t 30 percent may be apprved by the Zning Bard f Appeals as a standard variatin. Recmmendatin: Staff des nt recmmend apprval f the abve-requested parking variatin at this time based n review f the infrmatin presented by the applicant and the standards and cnditins impsed by Sectin 12-3-6.H (Findings f Fact fr Variatins) as utlined by the City f Des Plaines Zning Ordinance. Staff believes that the Zning Bard f Appeals shuld nt apprve a variatin withut an executed ff-site parking agreement fr a minimum f 19 parking spaces. The Zning Bard may deny the applicatin r cntinue the case until an agreement is brught befre the bard. If the applicant btains a lng-term (5-year minimum) ff-site parking agreement within 500 feet f the prperty that is executed and recrded with the Ck Cunty Recrder f Deeds, staff wuld recmmend the fllwing cnditins f apprval: 1. Fencing and gate shall be remved frm the entrance t the West Parking lt. A minimum f 21 spaces shall be lcated utside f a gated area. 2. Petitiner shall install signage t indicate the lcatin f custmer and emplyee parking areas. 3. Petitiner shall install signage t direct custmers t the lcatin f ff-site parking. 4. Bard Member Catalan asked why the agreement isn t lnger than ne year. Mr. Hartel advised Aldi staff and Petitiner agree and prefer a ne-year agreement. Mr. Mangum advised it is preferred t btain a lngterm agreement nw. Mr. Hartel stated, by mving the gate back, nly a swing gate wuld be apprpriate, and that wuld take up parking spaces. He nted that clear signage wuld indicate custmer parking is available. Nw patrns are parking in the street. Bard Member Schell asked if this agreement wuld be renewed annually. Mr. Mangum advised a lngerterm agreement is preferable. Bard Member Hfherr asked if the gate can be remved. Mr. Psihgis advised the fence prvides security (fr partner cntracts; shipping requests). He nted the gate culd be pen during business hurs and clsed at night. Bard Member Schell asked if it wuld be wrkable if the gate is mved frward. Mr. Hartel advised it wuld affect the maneuverability; fence wuld get hit. Bard Member Green stated: per the site plan, the current lcatin f the gate is prhibitive fr custmer parking, the gate wuld have t mved back t allw mre custmer spaces utside the gate. Mr. Mangum cncurred, stating that patrns wuldn t have t walk arund the gate. Mr. Hartel nted with the gate being pened full-time, there is accessibility via the sidewalk. n patrns are parking in adjacent area. He stressed that signage is required. Petitiner cncurred. There are 11 parking spaces in frnt with n handicapped spaces. Mr. Barnes nted he placed $300 wrth f signage t deter restaurant patrns frm parking in the lt east f the restaurant. He stated he desn t knw where the parking spaces will be btained. Acting Chair Szab stated he believes a lease is apprpriate rather than a letter (denting a signature with n title under it). Acting Chair Szab asked if the Bard has any questins. Bard Member Hfherr stated he is cncerned with: debris which blcks what culd be emplyee parking

Bard Member Saletnik stated that nt having a lng-term agreement is nt prudent. He stated the gate shuld be relcated because patrns are nt aware there is parking n the ppsite side f the gate. Mr. Psihgis advised as lng as we are ding a whlesale business with Aldi staff, they are requesting an annual agreement. He referred t Mr. Barnes cmments and nted the wner f the neighbring building has nt cmmented. Mr. Psihgis advised that patrns f this neighbr are als parking n the street. Mr. Psihgis stated a sign will be placed by the gate. He nted the area n the ppsite side f the gate is a safety issue (due t plicies/regulatins f shipping seafd). Bard Member Hfherr asked abut the debris. Mr. Psihgis advised the waste cans can be mved further back which will allw 15 parking spaces fr emplyees. Bard Member Saletnik asked, since the Aldi s parking lt is never packed, what the City s plicy is t assisting in cntacting Aldi staff. Mr. Mangum stated ideally parking within 500 ft. is preferable, and a private agreement is preferred. Mr. Psihgis advised that staff frm Aldi Crprate Office is requesting an annual agreement. Bard Member Green stated that typical parking agreements are recrded dcuments (3-5 years) with a site plan designating parking spaces. Mr. Hartel stated a request culd be psed t Aldi staff fr a lnger-term agreement. Acting Chair Szab stated the letter (frm Aldi) is nt sufficient; a legal dcument is preferred. Mr. Sakas stated the ZBA culd suggest the number f years fr a mre apprpriate agreement. Bard Member Schell cncurred and suggested the number f years is acceptable, but a legal dcument in writing is preferable. Bard Member Saletnik stated a site-plan drawing is required as a part f an agreement. The site is lcated at the nrtheast crner f Lee Street and Oakwd Avenue and cnsists f fur lts ttaling 36,281 square-feet. The site currently cntains eight structures and fur businesses. Printing and graphics businesses are lcated within a 4,260 square ft building at the nrthern edge f the site. An autmtive repair and tire shp are lcated within the attached structures at the suthern end f the site. The prperty is currently accessed by three curb cuts n Lee Street, tw n Oakwd Avenue, and tw ff the public alley t the east. A five stry, 65,308 square-ft, 68-unit Assisted Living Facility is prpsed. A majr variatin is sught because prpsed height f the building is apprximately 60-6 t the midpint f the rf, instead f nt higher than 45. Revere Healthcare, Ltd, prpses t manage an Illinis licensed assisted living facility prviding husing and assistance t senirs. The facility will be in peratin twenty-fur hurs a day seven days a week with a peak f 21 staff members during the mrning shift. The facility wuld cntain 51 assisted living units and 17 memry care units. Additinal resident services prvided n site wuld include fd service, with a first flr kitchen and dining rm, administrative and health prfessinal ffices, a chapel, husekeeping, and maintenance. The masnry-clad building wuld be riented twards Lee Street with the main entrance, gift shp, and ther active uses ccupying the street frntage. An additinal entrance at the rear f the building wuld prvide access t the 28-space parking lt with drp-ff and lading areas. The prpsed amunt f parking wuld meet the Zning Ordinance requirement f ne space per 5 beds (68/5=14) plus tw spaces per three emplyees (2/3 x 21=14). The parking lt wuld be accessed by ne curb cut n Oakwd Avenue and tw drive entrances frm the adjacent alley. The attached traffic study, which was reviewed by the City s Engineering Divisin, fund that: The vlume f traffic generated by the develpment is minimal (10 t 15 vehicles per hur) due t the nature f the use. The net change in area traffic vlumes is psitive because the prject replaces fur higher traffic generating uses. Three existing driveways alng Lee Street will be remved which reduces bth vehicular and pedestrian cnflicts pints and allws the creatin f five n-street parking spaces. The prpsed driveway n Oakwd Avenue will be narrwer than the existing driveway creating mre rm fr n-street parking east f the drive. An n-site lading space is prvided with access t the alley fr truck maneuvers. The prpsed prject will als reduce the vlume f trucks in Dwntwn Des Plaines. The City Cuncil has the final authrity n the prject. Acting Chair Szab asked hw many feet away the Heinrich Huse is frm this prperty. Mr. Sski advised 50-75 yards and 12 stries. Mr. Sakas stated a Bard and Chair wuld be selected at that time as well. He nted membership is a Mayral appintment. Mr. Sakas stated a vte, per meeting, must take place fr an Acting Chair.
