WHEREAS, by Ordinance No. 9002 adopted on September 17, 2012, the Ouachita Parish Police Jury enacted it s 2012 Revenue Law providing for the levy of certain ad valorem taxes and the assessment of certain service charges to, generally, provide revenue for the operation of the Ouachita Parish Police Jury and its component districts for the year 2013; WHEREAS, several Road Lighting Districts had sufficient operating balances for 2013 said Ordinance No. 9002 assessed only a minimal annual service charges of $5.00 on parcels located in such Districts; and, WHEREAS, given that these Districts have sufficient fund balances for 2013 the Ouachita Parish Police Jury, in coordination with the Assessor and Tax Collector, has determined that the minimal annual service charges of $5.00 on parcels in these district should be withdrawn and that the parcels in these district should not be assessed an annual service charge in the 2012 Revenue Law. NOW, THEREFORE: BE IT ORDAINED by the Ouachita Parish Police Jury in Regular and legal session that the following Sections of Ordinance No. 9002 be, and are hereby, amended as set forth below to eliminate the $5.00 annual service charges for certain road lighting districts: 2012 REVENUE LAW SECTION ELEVEN: BE IT FURTHER ORDAINED that pursuant to the provisions of the proposition which was approved at a special election held on October 17, 2010, there is hereby levied a service charge of Zero and no/100 Dollars ($0.00), plus a collection charge of $0.00 to be paid to the Tax Collector, in the year 2012 on each parcel of immovable property located wholly or partly within the boundaries of the Road Lighting District No. 4, for the purposes stated in the proposition. SECTION TWELVE: BE IT FURTHER ORDAINED that pursuant to the provisions of the proposition which was approved at a special election held on October 17, 2010, there is hereby levied a service charge of Zero and no/100 Dollars ($0.00), plus a collection charge of $0.00 to be paid to the Tax Collector, in the year 2012 on each parcel of immovable property located wholly or partly within the boundaries of the Road Lighting District No. 5, for the purposes stated in the proposition. SECTION THIRTEEN: BE IT FURTHER ORDAINED that pursuant to the provisions of the proposition which was approved at a special election held on October 17, 2010, there is hereby levied a service charge of Zero and no/100 Dollars ($0.00), plus a collection charge of $0.00 to be paid to the Tax Collector, in the year 2012 on each parcel of immovable property Page 7 of 19

located wholly or partly within the boundaries of the Road Lighting District No. 6, for the purposes stated in the proposition. SECTION SEVENTEEN: BE IT FURTHER ORDAINED that pursuant to the provisions of the proposition which was approved at a special election held on October 17, 2010, there is hereby levied a service charge of Zero and no/100 Dollars ($0.00), plus a collection charge of $0.00 to be paid to the Tax Collector, in the year 2012 on each parcel of immovable property located wholly or partly within the boundaries of the Road Lighting District No. 11, for the purposes stated in the proposition. SECTION NINETEEN: BE IT FURTHER ORDAINED that pursuant to the provisions of the proposition which was approved at a special election held on October 17, 2010, there is hereby levied a service charge of Zero and no/100 Dollars ($0.00), plus a collection charge of $0.00 to be paid to the Tax Collector, in the year 2012 on each parcel of immovable property located wholly or partly within the boundaries of the Road Lighting District No. 13, for the purposes stated in the proposition. SECTION TWENTY-FIVE: BE IT FURTHER ORDAINED that pursuant to the provisions of the proposition which was approved at a special election held on October 17, 2010, there is hereby levied a service charge of Zero and no/100 Dollars ($0.00), plus a collection charge of $0.00 to be paid to the Tax Collector, in the year 2012 on each parcel of immovable property located wholly or partly within the boundaries of the Road Lighting District No. 20, for the purposes stated in the proposition. WHEREAS, prior Ordinances have adopted the various Personnel Policies of the Ouachita Parish Police Jury which are codified in Chapter 1, Article II of the Compiled Ordinances of Ouachita Parish; WHEREAS, the Ouachita Parish Police Jury desires to clarify its Personnel Policies to specify that in some cases a past felony conviction does not disqualify an applicant from employment by the parish, per se; and, WHEREAS, a past felony conviction is nonetheless a serious matter and the Ouachita Parish Police Jury finds it is in the public interest to establish regulations for the consideration of applicants with such past convictions; NOW, THEREFORE: Page 9 of 19

BE IT ORDAINED by the Ouachita Parish Police Jury in legal and regular session that Section 1-62 of the Compiled Ordinances of Ouachita Parish, Louisiana be, and hereby is, supplemented and amended to add Paragraph c as set forth below: Sec. 1-62. Disqualification. (a) An applicant shall be eliminated from consideration if he or she: (1) Does not meet the minimum qualification necessary for the performance of the duties of the position involved. (2) Has made false statement of material fact on the application form or supplements, thereto. (3) Has committed or attempted to commit a fraudulent act at any stage of the selection progress. (4) Is an alien not legally permitted to work. (b) An applicant may be eliminated from consideration upon other reasonable grounds relating to job requirements. (c) A past felony conviction shall not per se disqualify an applicant from consideration for employment except as to positions where such disqualification is required by law or other applicable standards such as civil service rules or accreditation criteria. However, a past felony conviction may be considered in the evaluation of an applicant. Such consideration may include the nature of the felony, the age of the conviction, the relation of the felony to the duties of the open position, the applicant s subsequent work history, and other relevant factors. In the event an applicant with a past felony conviction is recommended to the Police Jury for employment, the requesting Department Head shall provide a brief written statement identifying the past conviction and explaining the basis of the hiring recommendation in view thereof. 2) DISCUSSION/ACTION: ORDINANCE NO. 9004 (FINAL) AN ORDINANCE SUPPLEMENTING AND AMENDING CHAPTER 8, ARTICLE III, OF THE COMPILED ORDINANCES OF OUACHITA PARISH GOVERNING COLLECTION OF SOLID WASTE TO REQUIRE THE OWNER OF EACH OCCUPIED RESIDENCE OR COMMERCIAL BUILDING IN THE UNINCORPORATED AREAS OF OUACHITA PARISH, LOUISIANA TO MAINTAIN A CONTRACTUAL ARRANGEMENT FOR THE PERIODIC COLLECTION, CONVEYANCE, AND DISPOSAL OF SOLID WASTE FROM SUCH RESIDENCE OR COMMERCIAL BUILDING BY A FRANCHISE AGENT; AND, FURTHER PROVIDING WITH RESPECT THERETO. WHEREAS, La. R. S. 33:1236(31) authorizes the police juries of this state to enact ordinances to require, prohibit, or regulate the destruction, disposal, or burning of trash, garbage, leaves, limbs and branches, or debris of any kind and to regulate dumping and the use of borrow pits for sanitary fill. ; WHEREAS, it is a given that any occupied residence or commercial building will generate solid waste, as defined in this Article; WHEREAS, the Ouachita Parish Police Jury issues non-exclusive franchises to companies in the business of collecting, conveying and properly disposing of solid waste in the unincorporated area of Ouachita Parish and most residents and businesses voluntarily utilize such services; WHEREAS, inasmuch as the use of such garbage service has heretofore been voluntary many parish residences and some businesses have elected to use other means for to handle their solid waste. Some of these residents and businesses fail to dispose of their solid waste in a legal or appropriate fashion; WHEREAS, the experience and information gained from the work of the Ouachita Parish Code Enforcement officers, the Ouachita Parish Administrative Hearing Officer, and the Ouachita Parish Public Works Department shows that improper and illegal dumping of typical household solid waste from residences and businesses is rampant and causes the public to incur significant expense and difficulties, including but not limited to, trespassing by those dumping illegally; clean-up costs incurred by the public and by victimized landowners; congestion of public drains resulting in the aggravation of flooding problems; increased costs of roadside litter pick-up in connection with mowing; enforcement costs. Further such illegal dumping of household solid waste causes general damage to the aesthetic beauty of Ouachita Parish; decreases the sense of pride among parish citizens; and makes a negative impression on visitors and businesses that adversely impacts economic development in our region; and, Page 12 of 19

WHEREAS, the Ouachita Parish Police Jury finds that it is in the public interest to require the owners of all occupied residences and commercial building in the unincorporated areas of Ouachita Parish to provide a regular, reliable method for the proper collection, conveyance, and disposal of their household solid waste through the services of a franchise agent. NOW, THEREFORE: BE IT ORDAINED by the Ouachita Parish Police Jury in legal and regular session that Chapter 8, Article III, of the Compiled Ordinances of Ouachita Parish governing Collection of Solid Waste be, and hereby is, supplemented and amended to add Section 8-28.1 to provide as follows: Sec. 8-28.1. Mandatory Solid Waste Collection and Disposal. The owner of every occupied residence or commercial building in the unincorporated area of Ouachita Parish shall maintain a contractual arrangement that provides for the collection, conveyance, and disposal of solid waste from such residence or commercial building by a franchise agent on a regular basis of not less than two (2) times per month. The obligation of the owner may be satisfied by a contractual arrangement maintained by the occupant of such residence or commercial building. BE IT FURTHER ORDAINED that Sec. 8-33 of said Chapter 8, Article III, of the Compiled Ordinances of Ouachita Parish governing Collection of Solid Waste be, and hereby is, supplemented and amended to provide for the imposition of community service as a penalty: Sec. 8-33. - Violation and penalty. The violation of any of the provisions of this article or rules and regulations promulgated thereof shall be deemed to be and is hereby declared to be a misdemeanor and any person convicted of the violation thereof shall be fined not more than one hundred dollars ($100.00) or imprisoned for a term not to exceed thirty (30) days, or ordered to perform not more than 40 hours of community service, or any combination of such penalties.
