PLEDGE TO THE FLAG Chairman Burns led the pledge. IV. AGENDA APPROVAL Chairman Burns asked if there were any changes to the agenda. Mrs. Kayla Phillips stated that there are no changes to the agenda. Mr. Peter Higgins made a motion to approve the agenda with the changes. Mr. Brad Smith seconded the motion. The motion carried by unanimously. V. APPROVAL OF MINUTES Chairman Burns asked if there were any corrections or additions to the November 26, 2018 meeting minutes. Mr. Alan Zipperer made a motion to approve the minutes as read. Chairman Burns stated all items voted on would be presented at the January 15, 2019 Board of Commissioners meeting at 6:00 pm as a public hearing (with the exception of residential business and pond requests) Hussey, Gay, Bell & DeYoung, LLC SKETCH PLAN (1): The applicant requests a sketch plan approval for [Map# 436 Parcel# 46] located on Noel C. Conaway Road for Creekside Subdivision (Second District). Mr. Hal Kraft stated that Creekside Subdivision is a PUD that was approved back in 2006, and the economy had started a downfall before the development got underway. Mr. Haydon Rollins stated that the sketch plan is for Phase 1 and will have 55 single family residences and 25 townhomes. They are changing some of the wording regarding the townhomes in the master plan. The development will be serviced by the county s water and sewer system that will need to be extended from the Park West development adjacent to the property. Mr. Alan Zipperer made a motion to approve the request. The motion was seconded by Mr. Peter Higgins and carried unanimously. VII. NEW BUSINESS Chairman Burns stated all items voted on would be presented at the January 15, 2019 Board of Commissioners meeting at 6:00 pm as a public hearing (with the exception of residential business and pond requests) Caroll Emory Waldhour PUBLIC HEARING ( 1): The applicant requests a pond less than one acre for [Map# 351B Parcel# 4] located at 4006 Blue Jay Road, zone R- 1 (First District). Mr. Carroll Waldhour has Mr. Jeffrey Hardin as his contractor to dig his pond on the property. The dirt from the pond will leave the property. Mr. Alan Zipperer made a motion to approve the request with staff recommendations: 1. Follow 3.17 - Excavation, mining, ponds, and fills of land and/or state/federal jurisdictional waters or wetlands. The motion was seconded by Mr. Brad Smith and carried unanimously. Kern & Co., LLC PUBLIC HEARING (2): The applicant requests to rezone 48 +/- acres for [Map# 353 Parcel# 3] located on Hwy 17 at Roebling Road from AR-1 to I-1 to allow for a surface mine (First District). Mr. Chad Zittrouer stated that this has already been presented to the Planning Board back in August of this year, the Planning Board made a motion to approve their request and the item moved forward to the County Commissioners meeting. They had to table their request for the county commissioners due to CUVA. They were unable to straighten out the issue and withdrew their request. Because they withdrew their 2
request from the Commissioners, they had to start the process all over again back through the Planning Board. The presentment is exactly the same as it was back in August. Mr. Brad Smith made a motion to approve the request with the following stipulations: 1. Lot meets the requirements of the I-1 zoning district. 2. Meet the requirements of Section 3.17- Excavation, mining, ponds, and fills of land and/or state federal jurisdictional waters or wetlands. 3. Site development plans comply with the Effingham County Water Resources 4. All wetland impacts permitted by USACE. 5. Subdivision plat must be approved by the zoning office and health department. 6. The applicant shall notify the Zoning Administrator at the time of final reclamation of the borrow pit and close out of this mining operation, and upon the determination of the Department of Natural Resources that the affected lands have been reclaimed in an acceptable manner, a minor recombination subdivision plat shall be submitted to the County and the zoning of the property shall revert to its original AR-1 zoning. 7. Subdivision plat shall be submitted to the County and the zoning of the property shall revert to its original AR-1 zoning upon final completion and reclamation of the site. The motion was seconded by Mr. Alan Zipperer and carried unanimously. Chairman Dave Burns recused himself due to conflict of interest for items 3 & 4. Blandford Homes, LLC PUBLIC HEARING (3): The applicant requests to rezone 33.38 acres for [Map# 414 Parcels# 3] located at 724 Blue Jay Road from AR-1 to R- 6 to develop a new residential subdivision. (Second District) Mr. Wilson Burns stated that they would like to rezone the property to develop a 62 lot single family development. The subdivision would be serviced by Effingham County water, sewer and re-use system, similar to the existing development across the road. Mr. Alan Zipperer made a motion to approve the request with the following stipulations: 1. Lot shall meet the requirements of the R-6 zoning district. 2. Site development plans shall comply with the Effingham County Water Resources Protection Ordinance and the Stormwater Management Local Design Manual. 3. All wetland impacts shall be permitted by USACE. 4. Subdivision final plat shall be approved by the Effingham County Board of Commissioners The motion was seconded by Mr. Brad Smith and carried unanimously. Blandford Homes, LLC SKETCH PLAN (4): The applicant requests a sketch plan approval for [Map# 414 Parcels# 3] located at 724 Blue Jay Road for Bluejay Road Subdivision. (Second District) 3
Mr. Wilson Burns stated that they would like to rezone the property to develop a 62 lot single family development. The subdivision would be serviced by Effingham County water, sewer and re-use system, similar to the existing development across the road. Mr. Alan Zipperer made a motion to approve the request with staff recommendations 1. Preliminary plans for development shall be submitted per Article IV, Section 4.2.2 and be reviewed and approved pursuant to the Effingham County Code of Ordinances, Appendix B Subdivision Regulations. 2. Development shall comply with the requirements of the R-6 zoning district and those conditions remaining in effect under prior rezoning approvals. 3. Water and Sewer services shall be approved by EOM Operations The motion was seconded by Mr. Brad Smith and carried unanimously. George Tuttle - PUBLIC HEARING ( 5): The applicant requests a variance for [Map# 264 Parcel# 1D02F] located at 406 Dewitt Road to allow for a 30 access easement, zoned AR-1 (Third District). Mr. George Tuttle stated that his daughter owns the property and requests to reduce the required 60 access easement to a 30 easement. Having a 60 easement located all on the property would take up an acre of land, she plans to either build or move a mobile home to the front of her property. The easement is for access to the back property owned by Mr. Jeff Caughron. Mr. Caughron was unable to attend the meeting but had called and expressed that he is opposed to the 30 access easement. He plans to eventually move a mobile home to his property and feels that a 30 access easement is not wide enough to allow a moving truck through to bring the home to the property. Mr. Higgins made a motion to approve the request for a variance to allow for a 30 access easement instead of 60 to an unbuildable lot Section 7.1 The motion was seconded by Mr. Smith. The motion carried unanimously. Charlie Johnson - PUBLIC HEARING ( 6): The applicant requests to rezone 1 acre for [Map# 270 Parcel# 20] located at 1716 Old Louisville Road from AR-1 to AR- 2 to subdivide the property (Third District). Mr. Tim Johnson stated that he is giving the one acre to his son. Mr. Peter Higgins made a motion to approve the request with the following stipulations: 1. Lot meets the requirements of the AR-2 zoning district. 4. Subdivision plat must be approved by the zoning office and health department. The motion was seconded by Mr. Zipperer. The motion carried unanimously. Kathy & Donald Spence PUBLIC HEARING (7): The applicant requests to rezone 1 acre for [Map# 387 Parcel# 4] located at 5002 Old Dixie Hwy from AR-1 to AR-2 to subdivide the property (Third District). 4
Mrs. Kathy Spence stated that she is receiving one acre from her sister. Mr. Alan Zipperer made a motion to approve the request with the following stipulations: 1. Lot meets the requirements of the AR-2 zoning district. 4. Subdivision plat must be approved by the zoning office and health department. The motion was seconded by Mr. Smith. The motion carried unanimously. W. Marvin Tebeau PUBLIC HEA RING (8): The applicant requests to rezone 1.03 acres for [Map# 320 Parcel# 35] located at 2132 Hwy 119 South from AR-1 to AR-2 to subdivide the property (Fifth District). Mr. Chad Zittrouer stated that the property owner is planning to split the parcel three ways and the home will be subdivide and rezoned separately from the rest of the parcel. Mr. Brad Smith made a motion to approve the request with the following stipulations: 1. Lot meets the requirements of the AR-2 zoning district. 4. Subdivision plat must be approved by the zoning office and health department. The motion was seconded by Mr. Zipperer. The motion carried unanimously. Anthony Collins PUBLIC HEARING (9): The applicant requests a rural business for [Map# 471A Parcel# 1F01] located at 393 Exley Road South to allow for a bait and tackle shop, zoned AR-2 (Fourth District). Mr. Anthony Collins stated that he is located within miles of three boat landings. He plans to sell higher end back and tackle that most consumers have to travel to Savannah to visit Bass Pro to purchase. He has a neighbor that takes veterans out to the river to go fishing and having a bait and tackle shop close to the boat landing would serve beneficial. He has also submitted a petition of support for his rural business by his neighbors. Mr. Brad Smith made a motion to approve the request. The motion was seconded by Mr. Zipperer. The motion carried unanimously. Lexington Ave, LLC PUBLIC HEARING (10): The applicant requests to rezone 24.16 acres for [Map# 447 Parcel# 9] located at 489 Lexington Avenue from AR-1 to B-3 to allow for mini storage and office space (Fifth District). Mr. Lance Burgstiner stated that they would like to split the property into three separate parcels. There is already a metal building existing on the property and has in the past had a business being run out of the building. They would like to add two more 5
metal buildings to the property and rent out for small local businesses. Mr. Freddy Long stated that he is opposed to the rezoning to B-3, the B-3 zoning is a very broad zoning. Mr. Slade Helmey stated that he has a petition with 27 signatures against the rezoning to B-3. Mr. Milton Rahn stated that the property is low land, to develop they would need to build up the property and is concerned about the water shed. Mr. James Saxon stated that he is concerned about the road. It is an ash road and concerned with the increased traffic traveling the road or if we were to have another freeze the road would be destroyed. Mr. Lance Burgstiner asked if they could change their request to a different zoning, one that is not so lenient. Mrs. Stephanie Johnson stated that the area that they are requesting to rezone to B-3 is not compliant with the current comprehensive plan for Effingham County. Mr. Lance Burgstiner has requested to change his request to rezone t B-3 to B-1. Mr. Peter Higgins made a motion to approve the request. The motion was seconded by Mr. Zipperer. The motion carried unanimously. VII. ADJOURNMENT There being no further business, the meeting adjourned at 6:49 pm.
