EXECUTIVE SUMMARY Steil Surveying Services, LLC, on behalf of Leaning Tree Homes, has submitted an application for a Subdivision Permit and Plat for Prairie Sunset Subdivision, 3rd Filing, a replat of Tracts 1 and 3, Prairie Sunset Subdivision, 1st Filing, Laramie County, WY, located northwest of Roads 215 and 136, Cheyenne, Wyoming. The purpose of the application is to create four (4) singlefamily residential lots. BACKGROUND The proposed subdivision is located north of Road 215 between Feldspar Road and Road 136. The applicant is requesting to subdivide two vacant tracts previously platted in Prairie Sunset 1 st Filing into four (4) residential tracts averaging 5.51 acres per lot. Pertinent Regulations Section 2-1-101 (a-d) of the Laramie County Land Use Regulations governing the criteria for a subdivision permit. DISCUSSION The subject property is located outside the zoned boundary. Surrounding properties in the area are either agricultural uses or single-family homes on private well and septic, and range in size from approximately 6.5 to 616 acres. The proposed tracts in the 3 rd Filing are all above 5 acres, and meet septic system minimum lot size requirements. The Laramie County Comprehensive Plan (2016) identifies the area as Rural Ag Interface (RAI). Rural residential uses are primarily anticipated in these areas. Limited service commercial and retail uses are anticipated at major intersections. Density of uses shall be foremost based on availability and access to water. Due to lengthy response times, existing topography, and limited reliable water resources, cisterns are encouraged in any development in an RAI area, as well as utilizing fire-wise planning. The proposed subdivision is outside the PlanCheyenne boundary. Public notice was published and neighbor notice letters were mailed. Staff received no comments from adjacent landowners or the public. Agency comments have been addressed with a revised plat submitted April 4, 2018, a copy of which is attached. Staff finds the proposed Subdivision Permit and Plat is in conformance with the plans and policies of the Laramie County Comprehensive Plan and the Laramie County Land Use Regulations. The Laramie County Planning Commission held a public hearing of this application on April 26, 2018. No public comment was received. The Planning Commission voted 3 0 to recommend approval of this application to the Board with no conditions. The attached resolution shall serve as the Subdivision Permit upon approval by the Board. RECOMMENDATION and FINDINGS Based on evidence provided, staff recommends the Board find that: a. This application meets the criteria for a subdivision permit pursuant to section 2-1- 101 (a-d) of the Laramie County Land Use Regulations. b. The year shown in the Acknowledgement is shown as 2017 instead of 2018. 2. I concur with the request for a waiver of a detailed Drainage Study and Traffic Study. Surveyor Review 1. For subdivisions in the County, survey tie(s) by bearing/azimuth and the distance to the nearest public land survey system monument shall be accurately described on the plat. In addition, for the purposes of enhancing the City and County GIS Program framework, all public land survey corners on or within the subdivision boundary shall have field observation coordinates provided on the plat. These coordinates shall reference Wyoming State Plane Coordinate System, East Zone, U.S. Survey foot, NAD 1983(CORS96). The coordinates shall be observed and verified at the time of the plat survey. There is one coordinate shown on the plat, the East 1/4 Corner of Section 1. The reference to the Wyoming State Plane Coordinate System, East Zone, U.S. Survey foot, NAD 1983(CORS96) is not comprehensively stated. 2. The Basis of Bearing/Azimuth on which the survey is based shall be noted on the plat. The Basis of Bearing is stated as the East Line of the SW1/4 of Section 1. The East Line of the SW1/4 of Section 1 is not shown on the plat nor is a survey tie to the referenced Basis of Bearing line shown on the plat. 3. Layout shall include the following: Boundary lines with bearings/azimuths and distances and the location of all recorded rights-of-way intersecting the boundary of the subdivision. Some of the dimensions are very small and difficult to read and it would help if they were a little larger. By the time you get the 2nd or 3rd generation by copying or scanning they are unclear. The dimensions of the North Boundaries of Lots 1 & 2 of Block 3 do not add up to the total length of the North Boundary of the subdivision. 4. In the title block it is indicated that Prairie Sunset 3rd Filing is a Re-Plat of Tracts 1 & 3 of Prairie Sunset Subdivision, therefore shouldn t there also be a Vacation Statement indicating that they are Vacating Tracts 1 & 3? Fire District No. 2: Jason Caughey COMMENTS ATTACHED 03/23/2018 My only concerns are: 1. Distance from existing Fire Protection. This subdivision is a significant distance from any existing fire station. The concern of response time is critical for the safety of the future home owners. 2. Lack of water supply, hydrants or cisterns. This is a significant distance from the existing cistern located on road 215.
