REGULATIONS OF POLONIA DORMITORY effective from November 15, 2017 1 Definitions Terms used in the Regulations shall have the following meanings: 1. Polonia Dormitory, Dormitory - seven-storey building located in Katowice at ul. Kochanowskiego 3 intended for the temporary residence, study and leisure of Tenants 2. The Common Parts - the parts of the Dormitory intended for shared use by the Tenants 3. The Rent - monthly rent for the use of the Room, in the amount specified in the Tenancy Contract 4. The Deposit - cash paid by the Tenant to secure the Landlord's claims related to the Tenancy Contract in the amount constituting the equivalent of the gross rent for 1 month 5. The Tenant - the person renting the Room, under the Tenancy Contract 6. The Room - room in Polonia Dormitory (single / single premium / double / premium double room) with equipment used by the Tenant on the basis of the Tenancy Contract 7. The Single room - room prepared and intended for residence for one person 8. The Premium Single Room - room prepared and intended for living for one person in higher standard 9. The Double room - room prepared and intended for residence for two people 10. The Premium Double Room - room prepared and intended for residence for two persons of higher standard 11. The Transfer and Receipt protocol - written transfer and receipt protocol written on acceptance and return of the Room 12. The Regulations - Regulations of Polonia Dormitory 13. The Service - web portal at: http://akademikpolonia.pl 14. The Tenancy Contract - a tenancy contract for a place in a Room in the Polonia Dormitory concluded between the Tenant and the Landlord for a definite period of time 15. Preliminary Contract - preliminary contract for the tenancy of the place in the Polonia Dormitory Room concluded between the Tenant and the Landlord 16. The User - a person who uses the Service, in particular for the purpose of concluding the Tenancy Contract 17. The Landlord - Drogowa Trasa Średnicowa Spółka Akcyjna ( Cross-Regional Highway S.A.) with its registered office in Katowice (40-877) at ul. Mieszka I 10, for 1

The Administrator - the entity appointed by the Landlord to manage and perform the current obligations of the Landlord. The Administrator is also authorized to conclude Preliminary Contracts and Tenancy Contracts and make any representations under or in connection with the Contracts. 2 Object of Regulations 1. The Regulations define the rights and obligations of the residents of the Polonia Dormitory, as well as the rules of staying in the Dormitory and is an integral part of the Preliminary Contract and the Tenancy Contract concluded between the Landlord and the Tenant. By signing it, the Tenant confirms that she/he has read and accepts the terms and conditions of these Regulations. 2. The Regulations apply to all persons staying at the Polonia Dormitory. 3. The Regulations are displayed on the wall next to the Polonia Dormitory reception desk and their current version is available for download fromwww.akademikpolonia.pl 3 General provisions 1. Polonia Dormitory provides accommodation and ancillary services and is intended for the temporary residence, study and leisure of tenants, in accordance with the specific provisions set out in the Tenancy Contract concluded between the Landlord and the Tenant. 2. The Dormitory is managed by an Administrator, who is the primary decision-making body in relation to tenants in all matters relating to the tenancy of Dormitory Rooms and the use of parts for common use. 3. The owner of Polonia Dormitory is obliged to provide tenants with: a. proper housing conditions; b. keeping public rooms clean; c. repair of Dormitory devices and equipment, subject to the relevant provisions concerning the material liability of the Tenant for the property entrusted to him/her, as specified in 7 of these Regulations; d. professional and polite service in all dormitory services provided at the Dormitory; e. enforcement of the order regulations described in detail in these Regulations. 4. Vacant Dormitory Rooms and Rooms provided by the Tenant (with the consent of the Tenant) may be placed for short-term tenancy run by the Administrator for students and lecturers of part-time courses coming to mass meetings, tenants guests and other 2

persons. The tenants' tenancy arrangements for short-term rentals by the Administrator are set out in the Tenancy Contract between the Landlord and the Tenant. 5. The Landlord and / or the Administrator shall not be liable for the private property of the Tenant, which has not been transferred by the Tenant to the Depositary maintained by the Administrator. The Landlord and / or Administrator is also not liable for damage to or loss of the vehicle or other vehicle owned by the Tenant, as well as objects left in it, regardless of whether the vehicles are parked in the Dormitory's internal parking or in public parking places in front of the Dormitory Building. 6. The Landlord and / or the Administrator is not liable for any breaks, not resulting from their fault, in delivering the utilities and is not liable for damages to the Tenant's property caused by such interruptions. 7. In justified cases, the Landlord and / or the Administrator reserves the right to transfer the Tenant to another Room corresponding to the standards of the previous Room. 8. The landlord is authorized to install monitoring in Common Parts, in particular: entrance to Dormitory, corridors, kitchens, staircases, for preventive and security purposes. 4 Contracts 1. The Preliminary Contract and Tenancy Contract may be concluded by an authorized employee of the Landlord or the Administrator. 2. Tenancy Contract is concluded with the help of the Service. The conclusion of the Tenancy Contract may also be concluded without Service involvement with the consent of the Landlord. 3. In order to conclude the Tenancy Contract: a) the User will fill in the booking form available athttp://akademikpolonia.pl/, while accepting the terms and conditions made available by the Landlord contained in the Polonia Dormitory Regulations and the Tenancy Contract, whose template is attached as Attachment No. 1 to the Dormitory Regulations; b) The Landlord will inform the User about the possibility of concluding a Tenancy Contract via e-mail; The Landlord will also send to the e-mail address specified by the User the completed booking form, the Tenancy Contract, the Polonia Dormitory Regulations along with the appendixes, and will indicate the bank account for payment of the earnest money; c) The User will confirm within 7 days the receipt by the e-mail of the Landlord's information, as defined in 4 sec. 3 letter b acquaintance with and acceptance of the conditions contained in the Tenancy Contract and the Dormitory Regulations; d) The User within 7 days of receipt by the e-mail of the information of the Landlord, specified in 4 sec. 3 letter b, will pay the Deposit in the amount specified in the Tenancy Contract. 3

e) in case of timely payment of the Deposit, in accordance with 4, sec. 3, letter d, the payment shall be treated as confirmation of the Tenant referred to in 4 sec. 3 letter c. The payment of the Deposit by the Tenant shall be treated as a confirmation of the Tenant concluding the Tenancy Contract, on the terms and conditions set forth in the Tenancy Contract and the Dormitory Regulations. 4. The amount of the Deposit will be used to secure all Landlord's claims to the Tenant, which may arise during the term of the Tenancy Contract, in particular: contractual penalties, late payment of Rent, damage to the Landlord's property, repair costs resulting from misuse of the Landlord's property. If the Landlord satisfies the claim during the term of the rent from the deposit, the Tenant is obliged to make up the amount of the deposit within 7 days of receiving the Lender's request to supplement it. After termination of the Tenancy Contract, the Deposit (in the amount including any possible deductions from the Deposit of any claims due to the Landlord against the Tenant) shall be returned by bank transfer to the account from which the last receivable for the Rent was credited, within 7 days of the date the Tenant leaves the Room, unless there is a Landlord's claim relating to the Tenancy Contract. 5. The Tenant undertakes within 3 days of payment of the Deposit to sent by registered mail to the following address of the Landlord: Polonia Dormitory, ul. Kochanowskiego 3,40-035 Katowice, the Tenancy Contract printed in two copies and signed by the Tenant. A copy of the Tenancy Contract signed by the Landlord (by authorised persons) shall be handed over to the Tenant on the day of making the Room available, and at the Tenant's request shall be sent to the correspondence address indicated by the Tenant. 6. In case of non-performance or improper performance by the Tenant of the obligation specified in 4 sec. 5 on the date of making the Room available, the Tenant undertakes to submit a signed copy of the Tenancy Contract or sign the Tenancy Contract prior to the making the Room available. 7. The provisions concerning the conclusion of the Tenancy Contract shall apply accordingly in the case of conclusion of a Preliminary Contract. 5 Tenant Rights 1. The Tenant shall be entitled to: a. use all of the facilities and rooms of the Dormitory designed for common use, as intended for these premises; b. entering and leaving the Dormitory premises at any time; c. use of a depository maintained by the Administrator, while the Administrator reserves the right to refuse to accept things of great value, large sums of money, things posing threat to safety and large objects beyond the storage capacity of the Dormitory Depository. 2. The Tenant has the right to receive guests in his / her room (only during his / her presence), subject to the following rules: 4

a. a visit may take place between: 08-22:00; b. other co-users of the Room do not oppose the reception of a guest; c. at the time of entry into the Dormitory, the guest is required to present at the Dormitory reception desk an ID with a photo for entry in the Visitor Register, and to wait at the reception desk to record his visit by the receptionist; Visitor registration is designed to provide security in the Dormitory, and the data collected is not processed; d. at the time of entry into the Dormitory, the visitor may leave at the Dormitory desk an identity document other than the identity card to make an entry in the Guest Register without having to wait at the reception desk to note his visit by the receptionist; such a document is returned upon completion of the Dormitory visit; e. the guest is obliged to observe the provisions of these Regulations while on the premises of the Dormitory; for its behavior, the liability, including consequences, shall be borne by the Tenant being visited; f. The Administrator reserves the right not to let into Dormitory the aggressive and / or those guests whose behavior indicates that he or she is under the influence of alcohol or other intoxicants; g. if the guest is found in the Tenant's Room after regular visitor hours, the Tenant may be charged with a fine of PLN 100. 6 Responsibilities of the Tenant 1. The Tenant shall be obliged to: a. adhere to generally accepted principles of good manners and standards of social coexistence; b. abide by the provisions of these Regulations; c. comply with any orders, decisions and orders of the Administrator and / or Landlord, which are displayed on the notice board in the Dormitory and sent electronically to the e-mail address given by the Tenant to contact; d. observe the silence of the quiet hours between 22:00 and 06:00; e. use the Room and Dormitory with respect for the rights of the co-users; f. keep your Room clean with the sanitary facility and care for the common areas; g. respect for the property being the Dormitory property and to prevent its destruction and misuse; h. economical use of water, electricity and other media; i. show a Dormitory resident card at the reception of the Dormitory each time at the entrance to the Dormitory and in other cases at the request of every Dormitory employee; 5

j. leave the keys to the room at the Dormitory reception each time you leave the Dormitory area; k. keep the contact details and current usage of the electronic mailbox updated, indicated during the conclusion of the Preliminary Contract or Tenancy Contract; l. timely payment of rent for the Room / place in the Room in the amount and in the manner specified in the Tenancy Contract between the Landlord and the Tenant; m. settling interest on late payment in the amount and the mode specified in the Tenancy Contract concluded between the Landlord and the Tenant. 2. The Tenant is obliged to strictly comply with fire protection and safety and health regulations, subject to the provisions of 8 of these Regulations. In the event of an evacuation order, the Tenant is obliged to immediately leave the Dormitory building and go to the designated assembly point. 3. The tenant is obliged to immediately report to the Dormitory reception desk the loss of or theft of keys to the room. Any costs resulting from loss or theft of keys shall be borne by the Tenant in the amount and in the manner specified in the Tenancy Contract concluded between the Landlord and the Tenant. 4. The Tenant is obliged to immediately notify at the Dormitory Reception of all noticed defects and / or breakdowns: a. defects / breakdowns will be removed according to the order of entries unless the nature of the defects / breakdowns requires urgent response action; b. the Dormitory Administrator reserves the right to enter the Tenant's Room in order to remove the reported defect / failure, also in the absence of the Tenant; c. The Tenant is liable for damages resulting from non-notified defects / failures. 5. The Tenant is obliged to immediately notify the Dormitory Reception at the reception desk of all accidents and illnesses that could jeopardize other tenants and all persons staying in the Dormitory area. 6. The Tenant holding a private car and / or a bicycle is obliged to leave it in designated places. All costs resulting from leaving the vehicle in place not designated for this purpose are covered by the Tenant. 7. The Tenant is obligated to take away all items brought into the Room or Common Parts and to return the Room in a state not worse than normal wear at the latest on the day of termination of the Tenancy Contract. 8. The Tenant using the Internet provided by the Administrator is obliged to comply with the applicable law. In particular, it is forbidden to: a. use the network for any illegal activity; b. upload, share, use, download or distribute content infringing the rights of third parties, especially those protected by intellectual property; c. distribute computer viruses and other programs that may damage other Internet users devices; 6

d. use of P2P applications; e. providing access data to the Internet to third parties who are not residents of the Dormitory. 7 Landlord Liability 1. The Landlord shall be fully responsible for: a. his/her behavior while using the services of Dormitory; b. behaviour of the invited guest in the premises of the Dormitory. 2. The Tenant shall be liable for the property entrusted to him and shall be responsible for the condition of the Room on the basis of the Transfer Protocol and equipment, which shall be made by the appointed employee of the Dormitory at the leaving of the Room. In the event of damage, whose perpetrator is unknown, liability is shared jointly by the flat mates, if harm has been done in the Room, and in the event of damage in Common Parts to which all tenants have access, all tenants shall be jointly and severally liable. 3. Before leaving the Room, the Tenant is obliged to return all the property entrusted to him in an unaltered state in terms of quantity and quality, in the course of proper use. 4. The Tenant shall be fully liable for damage caused to the Dormitory's property at the cost incurred by the Administrator or Landlord for the purpose of bringing the damaged property to its pre-damaged condition. 5. The Tenant shall be fully responsible for securing the Room during his absence and shall be responsible for securing personal items (money, valuables, computer equipment, etc.). 8 Other rules related to the functioning of the Dormitory 1. At the Dormitory it is forbidden to: a. smoke tobacco, b. alcohol consumption in public areas (in corridors, in shared kitchens or stairways, etc.), c. use sound equipment in a way that hinders other Tenants from learning or leisure, d. interfering in any way with quiet hours, e. share keys with others, f. organize events in Rooms, corridors, shared kitchen spaces or stairways, g. organize gambling, h. keep animals, i. grow fungi, bacteria, viruses or plants dangerous to health, j. provide accommodation to non-residents of the Dormitory, k. bring in and possession of firearms and pneumatic weapons, 7

l. consume, bring in, manufacture or other use of narcotic drugs, other intoxicants or other prohibited substances by applicable law, m. store any items in communication routes, n. run any business, commercial, production activities, etc. o. place any advertisements outside the designated places. 2. Due to generally applicable fire protection and safety and health regulations, it is strictly forbidden in the Dormitory area to: a. use alcohol burners, gas and petrol burners, and in rooms also electric stoves and heaters, and other appliances that draw more power, b. use extension cords without a zero field (neutral earthing), c. use any damaged household and electrical appliances, d. arbitrarily install, rework and repair any installation, and in particular electrical, telephone, Internet, television, water sewerage and gas systems, e. block fire doors and store any items on evacuation routes, f. change and replace any locks, to install second locks and to make duplicate keys to Rooms and other rooms in the Dormitory, g. devastate walls, doors and any equipment in Rooms and public areas, as well as permanent changes in the furnishings and decor of the Room, h. throw technical garbage and any items into sanitary, sewerage and ventilation systems that may cause their damage, malfunction or fire i. store substances in any dangerous manner that could pose a risk to human health and life, and in particular toxic, flammable, filth, etc., j. the use of fire protection equipment for non-fire protection purposes and any interference with elements of the fire system (especially the covering of fire detectors) under pain of immediate deprivation of accommodation in the Dormitory. 3. For sanitary reasons, the Dormitory Administrator reserves the right to remove from the premises designated for common use (and especially from shared kitchen facilities) the items left there. 4. The Dormitory Administrator reserves the right to enter any room and Dormitory Room in the absence of the Tenant in the event of: a. suspicion of health or life threat; b. suspicion of serious breach of these Regulations or applicable law; c. suspected breakdown that requires immediate repair; d. the need to repair the malfunction notified by the Tenant; e. loss of the right to live in the Polonia Dormitory. 5. the Administrator reserves the right to enter any room and Dormitory Room in the absence of the Tenant during the inspection of the installation and inspection of the rooms, upon prior notice to the Tenant. 8

9 Losing the right to live in a Dormitory 1. The Tenant may be deprived of a place in the Dormitory in accordance with the specific provisions set out in the Tenancy Contract between the Landlord and the Tenant, if: a. the Tenant in gross negligence or persistent manner violates the Tenancy Contract or the Polonia Dormitory Regulations or, through his improper behavior, makes use of other Rooms or Polonia Dormitory onerous, in particular provides accommodation to non-residents of the Dormitory contrary to the provisions of these Regulations, waived or rented out his place in the Dormitory to another person, notoriously fails to comply with the obligation to maintain the cleanliness of his Room along with sanitary facilities; b. does not supplement the amount of the Deposit in accordance with 4 sec.4 of the Regulations; c. the Tenant is behind with Rent for the Room / Place in the Room; d. using the Room differently than in the manner specified in the Tenancy Contract without the prior consent of the Landlord, expressed in writing; e. violates the applicable law. 10 Final provisions 1. The Regulations of Dormitory enter into force on the day of signing them by the Landlord or the Administrator of the Dormitory. 2. Matters not governed by these Regulations shall be governed by separate provisions and decisions of the Dormitory Administrator. 3. The appendices to these Regulations form an integral part thereof. 4. The Landlord also provides for the preparation and availability of the Regulations in other language versions, provided that in case of disputes or doubts connected with the interpretation of the Regulations, the Polish language version will prevail. 5. Changes to the Dormitory Regulations may be made by a decision of the Landlord or the Dormitory Administrator. The changed Regulations of the Academy will be placed and made available on the Website. The change of the provisions of the Regulations by the Landlord/Administrator in the terms and conditions of the Tenancy Contract does not apply to contracts concluded before the changes of the Regulations are made, except for cases when the change of the Regulations results from the change of mandatory legal regulations, court ruling or decisions of the administration body. The Administrator and / or the Landlord reserves the right to introduce separate orders of additional regulations and regulations related to ensuring safety in the Polonia Dormitory and appropriate sanitary and hygienic conditions. (first name and surname), residing in... (residence address), holder of ID number... issued on... by... PESEL..., e-mail:..., telephone number:... hereinafter referred to as Tenant. 1. 1. The Landlord declares that he: owns a property located in Katowice, at ul. Kochanowskiego 3, where there is a seven-storey building designed for the place of temporary residence, study and leisure of the Tenants (hereinafter referred to as the Polonia Dormitory ). 2. The Tenant declares that he has indicated the real personal data in the booking form on the Tenant's website (http://akademikpolonia.pl/). The Tenant declares that he has received from the Landlord this contract, the Polonia Dormitory Regulations with appendices. The Tenant declares that he has read the terms and conditions of this Contract, the Polonia Dormitory Regulations and accepts them. The Polonia Dormitory Regulations along with the enclosures and completed booking form constitute an integral part of this Contract. 2 1. The object of this Tenancy Contract is the place in the single room / single premium / double / double room premium (floor, room number) in the Polonia Dormitory (hereinafter referred to as the Room ) under the conditions specified in this Contract and the Polonia Dormitory Regulations. 2. This Contract has been concluded by and between the Landlord and the Tenant for the period from... (the date when the Room tenancy starts) to.... 3. The Parties declare that the rented Room will be used by... (first name and surname)... (address of residence)... 4. The Room shall be handed over not earlier than on the first day of the tenancy period specified in 2 sec. 2. The Room referred to in 2 sec. 1 shall be made available on the basis of the transfer and receipt protocol made by the Parties in which the condition of the object of the tenancy will be described as of the date of its availability to the Tenant (including its equipment). The Tenant will also receive a key from the Landlord and Dormitory residence card. Any costs resulting from the loss or theft of keys/dormitory residence card will be covered by the Tenant at full amount. As stated in the sentence preceding the costs, the Tenant undertakes to pay the Landlord immediately, not later than when the new key to the Room/Dormitory residence card is handed over. 5. Regardless the agreed date of handing over the Room, the obligation to pay the rent shall be effective from the date of commencement of the tenancy of the Room referred to in 2 sec. 2. 10

3 1. The Tenant will pay the Landlord in advance a rent in the amount of... (say:...) monthly gross (referred to as the Rent ) until the tenth day of each month to bank account no.:.. 2. The amount of the Rent includes VAT, resulting from separate regulations, valid on the date of VAT invoice. The amount of rent includes: rental fee, electricity, water, heating, wireless Internet, garbage collection, cleaning common parts, security, 24-hour monitoring. The date of payment will be considered the date of receipt of cash to the indicated bank account of the Landlord. 3. In the title of transfer, the Tenant will indicate each time his / her first name, surname and the month of transfer of the amount of the Rent refers to. 4. It is permissible to deliver invoices and other accounting documents by electronic means. These documents are deemed to be delivered on the day of dispatch to the e-mail address indicated by the Tenant in this Contract. 4 1. This Contract shall enter into force when all of the following conditions have been met: a) the User will fill in the booking form available at http://akademikpolonia.pl/, while accepting the terms and conditions of the Polonia Dormitory Regulations and Tenancy Contract; b) The Landlord will inform the Tenant about the possibility of concluding a Tenancy Contract via e-mail; The Landlord will also send to the indicated e-mail address in the form filled in the booking form by the Tenant, the Tenancy Contract, the Polonia Dormitory Regulations and the appendixes, and indicate the bank account for payment of the Deposit; c) The User will confirm within 7 days the receipt by the e-mail of the Landlord's information, as defined in 4 sec. 3 letter b acquaintance with and acceptance of the conditions contained in the Tenancy Contract and in the Dormitory Regulations; d) Within 7 days after receipt by the e-mail of the information of the Landlord, specified in 4, sec. 3 letter b, the Tenant shall pay the Deposit in the amount indicated in 5 sec 1 hereof: 2. In case of timely payment of the Deposit, in accordance with 4, sec. 3 letter d, the payment shall be treated as the confirmation of the Tenant, referred to in 4 sec.3 letter c. The payment of the Deposit by the Tenant shall be treated as a confirmation of the Tenant of the conclusion of the Tenancy Contract, on the terms and conditions set forth in the Tenancy Contract and the Dormitory Regulations. 5 1. Amount of Deposit in the amount equivalent to the gross rent for 1 month, i. e. PLN... (say: will be used to secure any claims of the Landlord to the Tenant, which may arise during the term of the Contract, in particular for: contractual penalties, late payment of Rent, damage to the Landlord's property, repair costs resulting from misuse of the Landlord's property. The Landlord is entitled to claim amounts exceeding the Deposit. 2. If the Landlord satisfies the claim during the term of the tenancy from the Deposit, the Tenant is obliged to make up the amount of the deposit within 7 days of receiving the Landlord's request to supplement it. 3. Upon termination of the Tenancy Contract, the Deposit shall be refunded by transfer to the account from which the last Rent has been received, within 7 days of the date the Tenant leaves the Room (in the amount taking into account any possible deductions from the Deposit of any claims due to the Landlord against the Tenant), unless there is a Landlord's claim relating to the Tenant connected with the Tenancy Contract. The Parties agree that the Landlord will not be 11

obliged to cover the costs of the transfer, in particular the costs of handling transactions or currency conversion. The Tenant authorizes the Landlord to deduct and cover from the amount of Deposit any transfer costs specified in the preceding sentence. 4. Subject to the provisions of section 3, the Deposit shall be returned in the nominal amount. 6 1. The Tenant is not entitled to transfer the Tenancy Object for sub-lease or use free of charge by third parties without written consent from the Landlord. 2. The remaining terms of the Tenancy Contract are specified in the Regulations of the Polonia Dormitory. By signing this Contract, the Tenant confirms the familiarization and acceptance of the conditions set out in the Dormitory Regulations. 7 1. With the consent of the Tenant during the period of validity of this Contract referred to in 2 2, the Landlord is entitled to the short-term tenancy of the Tenant's room in his absence, subject to the following provisions: a. The Tenant is obliged to inform the Landlord about his willingness to make his Room available for short-term tenancy during his absence for a minimum of 7 days before his planned absence; b. on the day the Tenant gives the Landlord his Room for short-term tenancy, the Tenant is obliged to pack his private things and hand them over to the Landlord for the time of his absence and leave the Room and hands over the key to the Landlord to the Room not later than till 9:00 am. 2. In the case of renting the Tenant s Room for the time of his absence to a third party, the Landlord is obliged to reduce the Rent for the next tenancy month paid by the Tenant referred to in 3 1, by an amount equal to 15% of the net amount received by the Landlord for the short-term tenancy to a third party of the Tenant's Room, after deduction of any commissions for intermediaries and booking platforms. 3. If the Landlord, despite obtaining the Tenant's consent for short-term tenancy of his Room in the absence of the Tenant referred to in section 1 of this paragraph shall not rent a third party the Tenant's Room,the Tenant is not entitled to reduce the amount of the Rent for another month of the tenancy for letting his room for short-term tenancy. 4. In the event of renting the Tenant s Room by the Landlord to a third party, prior to the re-transfer of the Room to the Tenant, the Tenant and the Landlord are obliged to checking on the basis of protocol the technical condition of the Room together with the equipment. 5. If the Tenant, despite his consent to the short-term tenancy of his Room, referred to in sec. 1 of this paragraph, fails to leave the Room within the time limit referred to in sec. 1 pt. b, and the Landlord is not able to accommodate a third party who has rented a room in the Dormitory in another room in the Dormitory, the Tenant will be obliged to cover all costs incurred by the Landlord with respect to the non-availability of the room, including the costs providing the third party possibility of renting a room of an approximate standard in Katowice. 8 1. The Tenancy Contract may be terminated by agreement of the Parties in writing under pain of invalidity. 2. The Landlord shall be entitled to terminate this Contract with an immediate effect in the following cases: a) when the Tenant in gross negligence or persistent manner violates the Contract or the Polonia Dormitory Regulations or through his improper behavior makes use of other rooms or Polonia Dormitory onerous; 12

b) failure to supplement the amount of the Deposit specified in 5 sec. 2 of the Contract; c) the Tenant is in default in rent payment for more than 30 days; d) using the Room differently than in the manner specified in the Tenancy Contract without the prior consent of the Landlord, expressed in writing; e) sub-leasing or giving the premise for use on a third party under any legal title, without the prior consent of the Landlord, expressed in writing; 3. The Tenant will have the right to terminate the Contract with immediate effect in case of the Landlord s failure to fulfill the provisions of the Tenancy Contract or Polonia Dormitory Regulations in gross negligence or persistent manner. 4. The termination of the Contract should be made in writing, under pain of invalidity. 5. Tenants handover of the Room with the equipment and key/dormitory residence card shall be effected on the basis of the transfer and receipt Protocol not later than on the last day of the tenancy in the presence of the Tenant and the authorized employee of the Landlord. In case the Tenant does not appear on the day of the Room handover without signing the transfer and receipt Protocol, the Landlord is entitled to unilaterally prepare and sign the transfer and receipt Protocol. The Tenant is obliged to return all the property entrusted to him in the unaltered state in terms of quantity and quality, in the course of proper use. In the event of a delay in the handover of the Room, the Landlord has the right to charge a contractual penalty of PLN 80 for each day of delay. 6. If the Tenant leaves any item in the Room after the expiry of this Contract, the Landlord is entitled to secure it, remove it from the Room and deposit it in the place and manner selected by the Landlord, in the warehouse in particular. The Landlord will inform the Tenant of this fact by electronic mail to the contact email address. All costs of securing, transporting and storing items shall be borne by the Tenant, who will be obliged to pay them to the Landlord. 7. Whenever the Tenancy Contract or the Dormitory Regulations provide for the Tenant's payment of the contractual penalty, this does not deprive the Landlord from demanding and claiming the full compensation from the Tenant (exceeding the amount of such contractual penalties ) on a general basis. 9 1. The Parties undertake to immediately notify each other of change of any data specified in the Contract and in particular to the addresses, telephone numbers and e-mail addresses. 2. Should any of the provisions of this Contract, prove to be invalid or ineffective, this shall in no case result in this Contract becoming invalid. In lieu of an invalid provision, the Parties will enter into an appropriate form the legally and effectively enforceable provision by which the purpose which was the subject of the invalid order will be attained. 3. Any alterations to this Contract shall be made in writing, otherwise they are null and void. 4. The Parties undertake to cooperate in the proper implementation of the provisions of this Contract and the relevant Contract and not to disclose to third parties the contents of the contracts. In the event of a dispute arising out of this Contract, the Parties are obliged to interpret the Contract as a matter of first priority in order to resolve the dispute amicably and to execute the Contract in accordance with its nature and content. Any disputes arising herefrom shall be settled by a competent court which is competent for the location of the Dormitory. 5. In matters not covered by this Contract, the relevant provisions of the Act of April 23, 1964, Civil Code shall apply. (i.e. Journal of Laws No. 2017, item 459, as amended) and relevant applicable provisions of Polish law. 6. This Agreement has been made in two identical copies, one copy for each Party.
