Background and Summary of Proposal As the applicant was unaware of the need for a Conditional Use Permit for rental of U-Haul vehicles, the Zoning Staff recently cited the applicant for operating a truck and trailer rental operation on the property without the proper permits. As the Zoning Ordinance requires a Conditional Use Permit for this type of activity, the applicant is now requesting a Conditional Use Permit for Motor Vehicle Rentals that is subordinate to the applicant s primary business on the site, which is a sports cards and memorabilia retail shop. As the number of parking spaces is minimal, the applicant is requesting to offer no more than two box trucks for rental on the site at any one time. As depicted on the proposed site layout, the rental trucks will be parked on the northern side of the building, behind the front facade of the building. All transactions related to the rental of the trucks and trailers is proposed to take place within the retail store. Proposed hours of operation are from 12:00 p.m. to 7:00 p.m., Monday through Thursday; 12:00 p.m. to 5:00 p.m., Friday; 10:00 a.m. through 6:00 p.m., Saturday; and 12:00 p.m. to 2:00 p.m. on Sunday. The number of parking spaces meets the requirements of the Zoning Ordinance for the retail, office and warehouse uses on the site. The applicant worked with Staff to reduce the number of trucks and trailers offered for rent in order to meet the parking requirements of the existing uses. Page 2
In Staff s opinion, this use is compatible with the surrounding commercial uses. The number of parking spaces on the site exceeds the minimum parking requirement by two; therefore, the display of up to two motor vehicles to rent will not impact the ability of both customers and employees to park. A condition is recommended that specifies the location of the two vehicles in order to limit visibility from the rights-of-way. For the reasons stated above, Staff recommends approval of this application, subject to the conditions listed below. Recommended Conditions 1. There shall be no signs placed within the windows or the doors of the rental vehicles. There shall be no pennants, banners, streamers, or portable signs placed on the site or on the vehicles. 2. No more than two trucks or trailers for the purpose of renting shall be allowed on the site at any one time. Rental trucks and rental trailers shall be located only in the area on the site that has been designated on the exhibit entitled, Proposed Site Layout, as depicted on page 5 of this report. Rental trucks and rental trailers shall not be parked in such a way that impedes the internal vehicular circulation on the site. Further conditions may be required during the administration of applicable City Ordinances and Standards. Any site plan submitted with this application may require revision during detailed site plan review to meet all applicable City Codes and Standards. All applicable permits required by the City Code, including those administered by the Department of Planning / Development Services Center and Department of Planning / Permits and Inspections Division, and the issuance of a Certificate of Occupancy, are required before any uses allowed by this Use Permit are valid. The applicant is encouraged to contact and work with the Crime Prevention Office within the Police Department for crime prevention techniques and Crime Prevention Through Environmental Design (CPTED) concepts and strategies as they pertain to this site. Comprehensive Plan Recommendations The Comprehensive Plan identifies this site as being located within the Suburban Area. The general planning principles for the Suburban Area focus on creating and maintaining great neighborhoods through stability and sustainability; protecting and enhancing open spaces and places of cultural and historical significance; and creating and maintaining a transportation system that provides connectivity and mobility. Achieving these goals requires that all land use activities either maintain or enhance the existing neighborhood through compatibility with surroundings, quality and attractiveness of site and buildings, improved mobility, environmental responsibility, livability, and effective buffering with respect to type, size, intensity and relationship to the surrounding uses. Natural and Cultural Resources Impacts The site is located in the Chesapeake Bay watershed. There are no known significant natural or cultural resources associated with this predominately impervious site. Page 3
