BOARD OF COUNTY COMMISSIONERS MINUTES OF PUBLIC HEARING Kootenai County-Coeur d Alene Commissioner Absent: Chairman Marc Eberlein, Commissioner Chris Fillios and Commissioner Bob Bingham Staff Present: The purpose of the meeting was for the Board to conduct a public hearing as advertised in the Coeur d Alene Press. Chairman Pro Tem Fillios called the hearing to order at 9:01 a.m. The members were polled for conflicts of interest. No conflicts were expressed. Chairman Eberlein joined the hearing at 9:03 a.m.. Case No. ZON18-0007, a request by Kootenai County to assign a new zoning classification to Parcel Numbers CK12200000A0 and CK12200000B0. Both parcels consist of 0.1034 acre and are reserved for access to the adjacent parcels. The parcels are located on the north side of Nettleton Gulch Road, just East of Bramble Bush Court and Nettleton Gulch Road intersection. The subject parcels were recently de-annexed from the city limits of the City of Coeur d Alene and are now within the County jurisdiction. As such, the County is required to assign a zoning classification to them. The County proposes the subject parcels be assigned an Agricultural Suburban zoning classification, consistent with the adjacent parcels and surrounding area. Access to the subject parcels is off of Nettleton Gulch Road. The properties are described as Parcel #1: Tract A of Shefoot in Section 06, Township 50 North, Range 03 West, B.M., Kootenai County, Idaho. Parcel #2: Tract B of Shefoot in Section 06, Township 50 North, Range 03 West, B.M., Kootenai County, Idaho. The Hearing Examiner held a public hearing on October 18, 2018 and recommended approval. (Ben Tarbutton-Planner) Applicant/Staff Presentation: Ben Tarbutton, Planner, introduced the zone change application referencing a presentation stating two parcels were de-annexed from the City of Coeur d Alene and the County is required to assign a zoning classification to them. He added according to the subdivision plat of Shefoot, these two parcels (Tract A and Tract B) are reserved for access and do not own development rights. Case No. ZON18-0010, a request by Kootenai County to assign a new zoning classification to Parcel Number S00000061300, which consists of 20.0 acres. The parcel is located west of the intersection of W. Nash Road and N. Charlotte Drive. The subject parcel was recently de-annexed from the city limits of the City of Spirit Lake and is now within the County jurisdiction. As such, the County is required to assign a zoning classification to it. The County proposes the subject parcel be assigned a Restricted Residential zoning classification, consistent with the adjacent parcels and surrounding area. Access to the subject parcel is off of W. Nash Road. The property is described as: East half of the Southwest quarter of the Northeast quarter in Section 06, Township 53 North, Range 04 West, B.M., Kootenai County, Idaho. The Hearing Examiner held a public hearing on October 18, 2018 and recommended approval. (Ben Tarbutton-Planner Applicant/Staff Presentation: Ben Tarbutton, Planner, introduced the application referencing a presentation stating the subject parcel was de-annexed from the City of Spirit Lake and the County is required to assign a zoning classification. The purposed zoning is Restricted Residential to be consistent with the adjacent parcels and surrounding areas. Mr. Tarbutton stated during the agency comment period, Lakes Highway District and Panhandle Health District did express concern regarding the assignment to Restricted Residential zoning. While the County understands the concerns this case is for the assignment of a zone classification only, and not an application for subdivision. If the property owner desires to pursue a subdivision in the future, they would be required to comply with all applicable agency standards upon subdivision application.
