APPROVING AN AMENDMENT TO AN INTERGOVERNMENTAL AGREEMENT WITH DUNDEE TOWNSHIP FOR PROPERTY TRANSFER FROM VOLUNTARY FLOODPRONE PROPERTY BUYOUT WHEREAS, on October 13, 2009 Kane County (KANE) passed Resolution No. 09-373, approving an Intergovernmental Agreement with Dundee Township for property transfer from voluntary floodprone property buyout; and WHEREAS, on November 10, 2009 KANE passed Ordinance No. 09-416, establishing a Richardson Subdivision Special Service Area for the purpose of paying the cost of providing special services in and for such area; and WHEREAS, both KANE and Dundee Township desire to modify said Intergovernmental Agreement to specify the conditions under which Kane would activate the Richardson Subdivision Special Service Area; and WHEREAS, residents of both Kane County and Dundee Township will benefit from this Project through reduced flooding and reduced flood hazard exposure along Fox River. NOW THEREFORE, BE IT RESOLVED by the Kane County Board that the attached amended Intergovernmental Agreement between KANE and Dundee Township is hereby accepted and approved and that the Chairman of the Kane County Board is hereby authorized and directed to execute the Agreement on behalf of the County. 57
COUNTY BOARD MINUTES- February 9, 2010 WHEREAS, on October 13, 2003, the County passed Ordinance No. 03-308 adopting the Kane County Natural Hazards Mitigation Plan {the "Mitigation Plan"); and WHEREAS, the Mitigation Plan lists seventeen action items to improve the County's natural hazard preparedness, including undertaking Repetitiv~ Loss Projects; and WHEREAS, the County's Department of Environmental Management developed a Floodprone Properties Mitigation Plan identifying potential voluntary elevation and buyout projects; and WHEREAS, the County identified properties in the Township that suffered from severe repetitive flooding including one property commonly known as 15N302 Camp Flint Drive; and WHEREAS, the current owner of 15N302 Camp Flint Drive has indicated his willingness to enter into a voluntary sale to the County; and WHEREAS, on August 12, 2008 the County passed resolution #08-253, authorizing the County Board Chairman to enter into a grant agreement with the Illinois Emergency Management Agency in the amount of $432,963.00 and other contracts to acquire, among other properties to be acquired by voluntary sale, the property in the Township; and WHEREAS, the County is willing to acquire the property located at 15N302 Camp Flint Drive and transfer title to 15N302 Camp Flint Drive to the Township in exchange for a commitment to abide by all provisions of the Illinois Emergency Management Agency State Local Flood Mitigation Assistance Program Agreement, dated January 12, 2009; and WHEREAS, the Township is willing to enter into this Agreement for the transfer of title to the property located at 15N302 Camp Flint Drive; and WHEREAS, the Township and County have mutually determined that it would be in the best interest of the citizens of the community to be able to assist each other through this transfer of property and agreements. NOW, THEREFORE, in consideration of the foregoing, as well as the mutual covenants and agreements hereinafter set forth, the Township and the County hereby agree as follows: 59
COUNTY BOARD MINUTES- February 9, 2010 Local Flood Mitigation Assistance Program Agreement, dated January 12, 2009, and maintenance requirements as set forth and limited to the above referenced Use and Maintenance Agreement requested by the residents of the Richardson Subdivision. The County has heretofore on November 10, 2009, by Ordinance No. 09-416, established the Richardson Special Service Area. The County agrees that if the Association shall fail or refuse to perform any maintenance needed or required under the Use and Maintenance Agreement described in Paragraph 3 hereof, upon written request by Dundee Township, the County shall activate, as expeditiously as possible, the Special Service Area and agrees to levy an amount, determined by Dundee Township, but not to exceed the maximum allowed by the Richardson Subdivision Special Service Area, sufficient to perform all such maintenance together with all related administrative or legal expenses. The parties agree that Dundee Township shall not be responsible to expend any funds iri excess of those actually received from the County pursuant to the Special Service Area ordinance. 5. COSTS OF TRANSFER. All costs and fees (but not including the fees and expenses of any attorney not retained by the County) associated with the transfer of the property at 15N302 Camp Flint Drive, including but not limited to premiums for the title insurance, examination fees, survey fees, and recording fees, shall be paid by the County in accordance with the budget developed in accordance with the terms of the Grant. 6. COMPLETION AND DEFAULT. Should either party hereto breach any of the material terms of this Agreement, the other party shall serve written notice upon the President or Chairman of the breaching party, as the case may be. Should the breaching party fail to cure such breach within thirty (30) days after receipt of the written notice from the other identifying the breach, then--unless this Agreement is further extended or modified in writing by the parties-the non-breaching party may seek specific performance of the promises set forth herein and the breaching party shall indemnify the other for any reasonable costs necessary to enforce the terms hereof. 61

KANE COUNTY LAW LIBRARY & SELF HELP LEGAL CENTER CONFERENCE ROOMS WHEREAS, the Kane County Law Library & Self Help Legal Center is established and maintained pursuant to 55 ILCS 5/5-39001; and WHEREAS, the vision of the Kane County Law Library & Self Help Legal Center is to assist all members of the public in their efforts to use the legal system effectively and efficiently and to provide access to such information in the most cost effective manner; and WHEREAS, as reported in the "2009 Report on Chicago Region Poverty", Kane County has the highest rate of unemployment in the Chicago collar counties at 9.8%; and WHEREAS, as reported in the "2009 Report on Chicago Region Poverty", 7.6% of Kane County's population is living in poverty (under 100% of the Federal Poverty Level ("FPL") and 15% of the population is low income (100%-199% FPL); and WHEREAS, it is deemed necessary and desirable to provide equal access to justice for all the citizens of Kane County; and WHEREAS, the Kane County Law Library & Self Help Legal Center works closely with Prairie State Legal Services, Administer Justice, other legal aid agencies and those members of the private bar who volunteer their services; pro bono; and WHEREAS, the Kane County Law Library & Self Help Legal Center desires to construct three (3) conference rooms within the confines of the Kane County Law Library & Self Help Center located at the Kane County Judicial Center to be used primarily by those agencies and attorneys volunteering their services to assist low income and poverty level members of the public who otherwise would not have access to the justice system; and WHEREAS, adequate funds sufficient to construct the three (3) conference rooms are available from the Kane County Law Library Fund, a special fund established pursuant to 55 ILCS 5/5-39001 and subject to disbursement by the County treasurer on order of a majority of the resident circuit judges of the Circuit Court of Kane County; and WHEREAS, the County of Kane holds title to the Kane County Judicial Center. 63
INTERGOVERNMENTAL AGREEMENT BETWEEN DUNDEE TOWNSHIP AND THE COUNTY OF KANE THIS AGREEMENT made as of the date of final execution, by and between Dundee Township ("Township") and the County of Kane ("County")_ for the mutual benefits and purposes as set forth below: WHEREAS, Article VII, Section 10, of the Illinois Constitution of 1970 provides that units of local government may contract or otherwise associate among themselves to obtain or share services and to exercise, combine, or transfer any power or function in any manner not prohibited by law or by ordinance and may use their credit, revenues, and other resources to pay costs related to intergovernmental activities; and WHEREAS, the Illinois Intergovernmental Cooperation Act, 5 ILCS 220/1 et seq. further authorizes intergovernmental cooperation; and WHEREAS, the County and the Township desire to transfer and accept certain properties in order to help each party better fulfill their respective functions and provide services to the public; and WHEREAS, on October 13, 1998, the County passed Ordinance No. 98-251 adopting the Kane County Stormwater Management Plan (the "Plan") pursuant to 55 ILCS 5/5-1062 which established goals to identify, protect, and improve floodplains, waterways, lakes, ponds, wetlands, and groundwater recharge areas; to minimize and reduce stormwater damages to existing structures; and to guide land use in order to maximize the protection of public health, safety and welfare; as well as identify and develop revenue sources to complete the goals and objectives of the Plan; and WHEREAS, pursuant to authority granted in 55 ILCS 5/5-1062 and 5/5-15001, et seq., and the Home Rule provisions of the Illinois Constitution, the County is authorized to take action to control flooding and to enter into agreements for the purposes of stormwater management and flood control; and
1. RECITALS. All of the Recitals set forth above are made a part of this Agreement and incorporated herein. 2. ACQUISITION AND TRANSFER OF TITLE TO 15N302 CAMP FLINT DRIVE. The County hereby agrees to acquire title to the property located at 15N302 Camp Flint Drive and to transfer title to the property located at 15N302 Camp Flint Drive to the Township by a recordable Warranty Deed subject only to: a) covenants, conditions and restrictions of record as of June 1, 2009; b) public and utility easements and roads and highways, if any; c) a covenant, running with the land, to comply with the provisions of the Illinois Emergency Management Agency State-Local Flood Mitigation Assistance P rogram Agreement, dated January 12, 2009.. The County agrees, for the ultimate benefit of the Township, to cause the sellers of the 15N302 Camp Flint Drive to remove liens and other encumbrances upon title other than the Permitted Exceptions. 3. DEMOLITION AND USE OF 15N302 CAMP FLINT DRIVE. Within 120 days of recording the Deeds transferring ownership to the County in accordance with the terms hereof, and prior to the County transferring ownership to Dundee Township, the County agrees to demolish the structure and improvements at 15N302 Camp Flint Drive; to grade the property at 15N302 Camp Flint Drive, and to seasonably seed and landscape the property at 15N302 Camp Flint Drive. The Township agrees, through a long-term Use and Maintenance Agreement with the Richardson Subdivision Homeowners Association (the "Association"), to maintain the property at 15N302 Camp Flint Drive, in perpetuity, as open or park space, and to otherwise comply with all provisions of the Illinois Emergency Management Agency State Local Flood Mitigation Assistance Program Agreement, dated January 12, 2009. 4. CONTINGENCIES. This Agreement is contingent upon the terms set forth above as well as Dundee Township's execution of a long-term Use and Maintenance Agreement with the Richardson Subdivision Homeowner's Association and the approval of a backup Special Service Area between the Richardson Subdivision Homeowner's Association and Kane County, both to stipulate compliance with the Illinois Emergency Management Agency State-
7. INSURANCE. The County shall arrange for all necessary property title insurance for the property located at 15N302 Camp Flint Drive effective on the date of execution of the Warranty Deed from the County to the Township. 8. MISCELLANEOUS. It is mutually understood and agreed that the provisions herein are severable and that in the event that any of them are held to be invalid by any court of competent jurisdiction, then this Agreement shall be interpreted as if such invalid portion were not contained therein. The agreements, terms and conditions herein may be modified only through the written mutual consent of the parties hereto.
