Nebraska WHEREAS, pursuant to Neb. Rev. Stat. 5 23-104, the County has the power to do all acts in relation to the concerns of the County necessary to the exercise of its corporate powers; and, WHEREAS, pursuant to Neb. Rev. Stat. 5 23-103, the powers of the County as a body are exercised by the County Board; and, WHEREAS, the County Board of Commissioners has the authority to adopt a Zoning Regulation, which shall have the force and effect of law pursuant to Neb. Rev. Stat.o 23-L74; and, WHEREAS, said Zoning Regulations require the County Board of Commissioners to approve Special Use Permits; and WHEREAS, the Planning Department has reviewed the Special Use Permit application to operate a commercial recreation and camping area in the AG, Agricultural zoning district on property generally located southwest of 99th Street and Whitney Road along the Platte River and legally described as follows, hereinafter "the Property": Tax Lot 2A in the SE 1/4 of the SW Tnand the SW Tnof lhe SE % in Section 21, together with portions of Section 28 and Tax Lot B and Gov Lot 3 in Section 33, all in Twp 13N, Rng 12E of the 6th P. M. Sarpy County, NE. NOW, THEREFORE, BE IT RESOLVED BY THE SARPY COUNW BOARD OF COMMISSIONERS that this Board makes the following findings of fact: l. A public hearing regarding the Special Use Permit was held before the Sarpy County Planning Commission on March 2L,20L7, and further, the Planning Commission gave their recommendation. ll. lll. A public hearing regarding the Special Use Permit was held by this Board. Notice of each of the Public Hearings described above was published at least ten (10) days prior to each respective public hearing. lv. The Planning Department has made a recommendation as noted in the attached Exhibit "A", which Exhibit "A" includes the planning Department report, the operation plan, the Site Plan and an aerial view of the Property. V. The zoning at the Property is AG, Agricultural District. Vl. The Special Use Permit is in compliance with the Comprehensive Development Plan and the Sarpy County Zoning Regulations. Vll. The performance standards set out at Section 41.5 of the Sarpy County Zoning Regulations have been met. FURTHER BE lt RESOLVED THAT this Board in light of the above recited findings of fact, after due deliberation and consideration, approves a Special Use Permit for Schmid Farms lnc. consistent with the following: L. Applicant shall improve Whitney Road to allow for additional access to the Property before creation/improvement of any RV Pad Sites approved herein. 2. A Watchman's residence or pad site shall be installed on the Property. 3. The areas marked Phase 1 and Phase 2 on the Site Plan may be developed to install RV Pad Sites consistent with the application but shall be limited to a maximum of 5C) RV Pad Sites. 4. A year round recreationalvehicle storage area on the former quarry site located outside of the AE Flood Zone is hereby approved, but shall be limited to a maximum storage capacity of 150 vehicles. 5. The Emergency Plan shall be followed. 6. lf any permanent structures are damaged 50% or more of their value, all repairs shall be required to meet Sarpy County Flood Plain Regulations. 7. RV sites shall be free from any man-made items from November 1 to March 3t of each year. 8. Applicant, the property owner of record, shall accompany Sarpy County Staff on an annual inspection of the Property between November 1 and November 15. 9. The use remains compliant and consistent with the approval set out within this Resolution, the operation plan attached hereto in Exhibit A, and as specifically described in the Planning Department Reports. 10. Applicant shall be required to comply with Sarpy County Zoning Regulations in all development or improvements. PURPOSE OF REQUEST: Applicant has operated a family owned business leasing seasonal dwelling sites for recreational use since the late 1940 s. Applicant is working with Sarpy County Planning Department to bring the property into compliance with regulations, as well as requesting approval to expand the business to include RV pad sites on the property for seasonal recreational vehicles, development of an area for recreational vehicle storage on a year round basis, and a watchman s residence (may be a permanent structure or a RV pad site). II. BACKGROUND INFORMATION

A. EXISTING CONDITION OF SITE: The property is made up of 4 parcels, which include numerous Tax Lots and Government Lots, totaling over 395 acres. Roughly 145 acres of the property is farmed with row crops. The remaining property is currently improved with a 24 acre sand pit lake, 69 seasonal dwellings (permanent, privately owned cabins and mobile home structures), and an area that was a former quarry operation site which is improved with a 34 x 56 Astro Building. A large portion of the property contains a heavy tree canopy and approximately 32 acres along the Platte River is accretion land and was once a channel of the river. Accretion is a natural, slow and almost unnoticeable deposit of soil by water, and land formed by accretion is generally recognized to be owned by the owner of the bank or shoreline upon which the accretion occurs. B. SURROUNDING AREA CURRENT ZONING AND LAND USE DESIGNATION: The surrounding areas are all zoned AG (Agricultural) and AG/FP (Agricultural-Flood Plain) and are designated as Greenway in the Future Land Use Map. The properties located along the Platte River each have seasonal dwellings, cabins and RV sites. C. RELEVANT CASE HISTORY: Sarpy County Zoning Regulations requiring a Special Use Permit for seasonal dwellings and commercial camping areas date back to 1976 if not longer The property currently has 42 leased lots with permanent cabins and 27 Mobile Homes which require Special Use Trailer Permits renewable every three years (Sec 41.5.3). The property has operated as a seasonal recreational area for many years. The owner wishes to improve additional areas of the site with 50 x 75 pad sites for recreational vehicles for seasonal leasing (not daily or weekly) and develop a year-round RV storage site for 150 recreational vehicles (RV s, boats, vehicles) on the former quarry site that lies outside of the flood plain. They have proposed a 5 Phase Development to be improved over a 1 to 10 year time frame. Phase I RV storage area, watchman s residence/pad site and estimated 25 leased pad sites for recreational vehicle Phase II new access and gated entry via Whitney Road and estimated 25 leased pad sites for recreational vehicle Phase III estimated 70 leased pad sites for recreational vehicle Applicant has stated that the existing cabins are served with individual water and wastewater systems (septic). For the new pad sites, they are proposing to install a water line that will provide water hookups for each pad site. No sewer is being proposed at this time as the applicant will contract with a service to have each RV pumped on a weekly basis during the camping season by way of a sewage pump truck. According to the Flood Insurance Rate Maps (FIRM) issued by the Federal Emergency Management Agency (FEMA), 1/3 of the property is located inside the Flood Plain of the Platte River, roughly 68 acres being designated as Floodway, and will have to comply with all applicable regulations in Section 30 of the Sarpy County Zoning Regulations, Flood Plain Regulations. Any man-made improvements to the land or any new/existing structures/camping sites located within the designated Flood Plain will require the approval of a Flood Plain Development Permit prior to making any such improvements pursuant to Section 30 of the Sarpy County Zoning Regulations. The applicant has submitted an Emergency Action Plan for the property as requested by the Papio Missouri Natural Resources District.

D. APPLICABLE REGULATIONS: Sarpy County Comprehensive Plan Sarpy County Zoning Regulations: - Section 9 AG (Agricultural) District - Section 41 Special Use Permits - Section 30 Flood Plain Regulations III. ANALYSIS/STAFF COMMENTS A. COMPREHENSIVE PLAN: The proposed project is consistent with the Comprehensive Plan as the Future Land Use Designation for this area is Greenway. B. TRAFFIC AND ACCESS: Access to the site is currently from 99 th Street only. Applicant proposes to create an additional access via Whitney Road from the west. C. OTHER AGENCY REVIEW/COMMENTS: The application was sent to area jurisdictional agencies or departments that may have an interest to allow them to comment. Comments received are attached. Should any additional comments be received, they will be provided at the public hearing. D. GENERAL COMMENTS: Notice of the public hearing for this application was published in area newspapers, notification letters also were sent out to property owners within 300 feet of the subject property and the subject property was posted with a sign indicating a zoning action was pending on it. Our office has received a number of calls from property owners in the area inquiring about the request. Applicant is working with an engineer to complete a detailed site plan and other studies necessary to start the proposed project. Applicant has met with the Papillion Fire Department and has agreed to install a Knox Box for access and keep roads maintained for emergency vehicles. They have also met with Sarpy County Public Works regarding the maintenance of Whitney Road. Planning Commission has recommended that if supported by the Fire and Public Works Department the second access and gate on Whitney Road be completed with the opening of Phase 1 of the project. Planning Staff supports this recommendation. Planning Staff has discussed the proposal with the applicant and has recommended that they put Phase 3 on hold and see how Phase I and 2 work out. If they still wish to move forward with the additional phase in the future, they can amend their SUP at that time. IV. PLANNING COMMISSION RECOMMENDATION: MOTION: Ackley moved, seconded by Huddleston, to recommend APPROVAL of a Special Use Permit allowing for a Commercial Recreation and Camping Area in the AG Agricultural Farming District to allow the existing seasonal dwellings currently located on the site and to allow, 1) the improvement of Phase I only consisting of a maximum of 25 RV pad sites, 2) the development of the year-around recreational vehicle storage area on the former quarry site located outside of the AE Flood Zone, and 3) a watchman s residence/pad site, subject to a recommendation by the Fire and Public Works Department s on whether or not the second access and gate is needed on Whitney Road and the applicant to follow that recommendation; all subject to compliance with the PMNRD requirements as stated in their

letter dated March 17, 2017. This recommendation is being made as the Special Use Permit is in conformance with the Sarpy County Zoning Regulations and the Future Land Use Map. STAFF COMMENTS AND RECOMMENDATIONS: Staff recommends APPROVAL of a Special Use Permit allowing for a Commercial Recreation and Camping Area in the AG (Agricultural) zoning district to allow the existing seasonal dwellings currently located on the site, as well as to allow for the improvement of the development of year-around recreational vehicle storage area for 150 vehicles on the former quarry site located outside of the AE Flood Zone, 50 leased pad sites for recreational vehicles, a watchmen s residence or pad site, and additional access via Whitney Road, so long as all improvements and activities meet the regulations of the Sarpy County Zoning Regulations and Flood Plain Regulations and the Sarpy County Planning Department staff are allowed an annual inspection of the property. Special Use Permit Application for Schmid Farms Inc. Schmid Farms, Inc is a family owned business that has been in the farming business since the late 1800's. In the late 1940's, additional land was purchased by silent auction for additional pasture ground which was river bottom land. That land soon became a site for seasonal recreation for at first cabins & later trailers. The business was incorporated in 1976. In 1986 the county adopted the current zoning regulations. Since the seasonal recreation area had been in existence prior to the law, it was "grandfathered" in, but the park was not allowed to expand or put other cabins/trailers unless they followed the current restrictions found in Sarpy County Zoning Regulations code. We currently have: 27 special use trailers, lots leased 42 existing seasonal dwellings/cabins, lots leased Farm land, rented The lots are accessible to all lessee's year-round with the exception that during the winter months, the private road is not maintained. It is recreational only with the season being April 1st to Oct 31st yearly. It is the corporation's intention to bring the seasonal recreation area into compliance with the current law, and expand to include additional seasonal campground sites on land that is currently in the flood plain as indicated by Parcel 010609067 and the South side of Parcel 010609105. It is also the intent to utilize the old quarry site Parcel #010609105 currently zoned as AG/X as a storage area for RV's, boats or other recreational/personal equipment. Additional Proposed Usage of land: 200 proposed seasonal RV recreational camping pads 150 proposed recreational (RVs, Boats, vehicles) storage To account for the extra access road to our camping ground & storage area, we would request the county maintain the entire Whitney Road as per the surveyor, Mike Sharp and Dept of Roads for Sarpy County, Rod Ripley. We would then place an electronic gate for access to our property to include additional fencing around our field/parcel. In addition, the access to the storage area/quarry area from ggth Street would also be available for access or exit with authorization. The RV pads are estimated to be 50' wide x 75' in length. Development is estimated to be over a 1-10 yr. period oftime.

All, After having researched further into the NFPA Code which addresses the requirements for RV parks, specifically NFPA 1194 I am revising the comments formerly submitted by Chief Bowes in regard to the Schmid Farms Special Use Permit application. All roads in the development must be a minimum of 10 wide per traffic lane and 8 wide per parallel parking lane. Owner indicates the lane width will be 16. All road curves must maintain a 30 internal radius. We will require that all roads be maintained year round to areas that will accommodate winter storage and/or be occupied. Owner has agreed to install a Knox Box at the main gate for fire department access keyed specifically for the Papillion Fire Department. Trees and brush must be kept clear to the sides and above roads to allow fire apparatus access (minimum 16 clearance above roadway). Owner agrees to develop a road through the property to meet with the County maintained Whitney Road. The District offers the following comments based on review of the site plan and emergency operations plan This site is located in the Zone AE floodplain of the Platte River. All improvements will require a floodplain development permit. A portion of this site is located in the Zone AE floodway of the Platte River. Any improvements in the floodway will require a no-rise certification. The operation plan provided is not clear on the seasonal use of the property. The plan should be revised to reflect Sarpy County floodplain regulations that only allow RVs to remain in place from April 1-October 1 of each year. The operation plan provided does not state how the owner will determine an emergency is eminent in order to notify tenants to remove their vehicles.
