RESOLUTION NO. 2006-329 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ELK GROVE DECLARING THE NECESSITY AND AUTHORIZING THE COMMENCEMENT OF EMINENT DOMAIN PROCEEDINGS TO SECURE REAL PROPERTY INTERESTS NECESSARY TO CONSTRUCT THE SHELDON ROAD/STATE ROUTE-99 INTERCHANGE RECONSTRUCTION PROJECT (SHELDON TERRACE, LLC / APN: 116-0021-036) WHEREAS, imprving and widening the Sheldn Rad/State Rute 99 Interchange hlds a pririty in the City f Elk Grve Transprtatin Imprvement Prgram and acquiring the necessary right f way and ther prperty interests and assisting with the required business and residential relcatins is an imprtant and necessary step in the Sheldn Rad/State Rute 99 Interchange Recnstructin Prject; and WHEREAS, the Prject, including its imprvements, is necessary t ensure that the radway system perates at an acceptable level f service, t prvide fr efficient and safe traffic circulatin and access, and t generally further public safety and the general cmmunity welfare in a manner cnsistent with the City's General Plan; and WHEREAS, it is necessary t acquire certain real prperty interests ("Prperty") fr the cnstructin, peratin and maintenance f a right f way and related imprvements as part f the Prject; and WHEREAS, the City has investigated and examined alternatives t the Prject and the acquisitin f the Prperty, and cncluded that bth the Prject and acquisitin f the Prperty fr the Prject are necessary; and WHEREAS, the Prperty, which is the subject f this Reslutin f Necessity, cnsists f a fee interest, a public utility easement and a temprary cnstructin easement all f which are mre particularly described and depicted in Exhibits A-1, A-2, B-1, B-2, B-3, C-1, C-2 and C-3 which are attached heret and are incrprated herein. The Sacrament Cunty Assessr has designated the Prperty as a prtin f APN 116-0021-036; and WHEREAS, the Prperty is lcated entirely within the municipal bundaries f the City f Elk Grve; and WHEREAS, the City f Elk Grve has cmplied with the requirements f the Califrnia Envirnmental Quality Act, Public Resurces Cde sectin 21000, et seq., in regards t acquisitin f the Prperty based upn the City f Elk Grve's adptin f a Final Envirnmental Reprt and Assessment, including the Mitigatin Mnitring and Reprting Prgram as adpted by the City Cuncil n July 27, 2005; and 844857.2107R4.120-1-

WHEREAS, the City f Elk Grve has cmplied with the requirements f Gvernment Cde sectin 7267.2, in regards t the acquisitin f the Prperty by making an ffer t purchase t the knwn wner(s) f recrd; and WHEREAS, as a result f the hearing held n December 13, 2006, and in accrdance with the prvisins f Cde f Civil Prcedure sectin 1245.235, the City Cuncil f the City f Elk Grve intends t make certain findings and determinatins. NOW, THEREFORE, BE IT RESOLVED by the City Cuncil f the City f Elk Grve as fllws: 1. The recitals cntained herein are true and crrect. 2. Upn examinatin f the alternatives, the City f Elk Grve requires the Prperty fr the Prject. 3. The City f Elk Grve is authrized t acquire Prperties pursuant t the prvisins f Gvernment Cde sectins 37350.5, 40401 and 40404 and the prvisins f Eminent Dmain Law cmprising Title 7, Part 3 f the Cde f Civil Prcedure (cmmencing at sectin 1230.010). 4. Acquisitin f the Prperty fr Prject purpses prmtes public safety and the general welfare, is authrized by Gvernment Cde sectins 37350.5, 40401, 40404, and is therefre a public use. 5. The City f Elk Grve hereby finds, determines and declares: a. The public interest and necessity require the prpsed Prject; b. The prpsed Prject is planned r lcated in the manner that will be mst cmpatible with the greatest public gd and the least private injury; c. The prperty interests described and depicted in Exhibits A-1, A-2, B-1, 8 2, B-3, C-1, C-2 and C-3 are necessary fr the purpses f cnstructin, peratin and maintenance f the prpsed Prject; and d. Prir t making the abve findings and determinatins, the ffer required by sectin 7267.2 f the Gvernment Cde was made t the wner(s) f recrd f the prperty interests described and depicted in Exhibits A-1, A 2, B-1, B-2, B-3, C-1, C-2 and C-3. 6. The City Attrney is hereby authrized and directed t prepare, cmmence and prsecute prceedings in eminent dmain in the apprpriate curt t acquire fr the City f Elk Grve the prperty interests described and depicted in Exhibits A 1, A-2, B-1, B-2, B-3, C-1, C-2 and C-3.
