I UNDERSTAND AND AGREE THAT: 1. No work shall commence until written approval of the Architectural Committee has been received. 2. Building permits for the proposed work may be required and the cost of any permits and the responsibility of obtaining permit(s) and subsequent City inspection will be the responsibility of the undersigned. Architectural Committee approval is not intended to be, nor shall it be considered a substitute for approval by the necessary and appropriate governmental agencies. 3. The Architectural Control Committee s approval or disapproval shall be based on the considerations set forth in Article X of the CC&R s and the Association s Architectural Guidelines, and the Architectural Committee shall not be responsible for reviewing, nor shall its approval of any plan or design be deemed approval of, any plans or design from the standpoint of structural safety, engineering or conformance with building codes or other codes. 4. I have read this application, the Pelican Ridge Community s Association s CC&R s, and the Architectural/Landscape Guidelines, and I understand and agree to the terms and conditions of the Architectural Committee s review of my application, plans and specifications, as stated herein. 5. A Traffic/Parking Control Plan will be required for major projects, at the Architectural Committees/Boards discretion showing on the community plot plan where workers vehicles will be allowed to park, which will be on the non frontage side of through streets only, not on cul de sacs. 6. Streets Restoration will be required following completion of remodel and landscape projects including cleaning and re-slurrying of asphalt, and power washing of curb and gutters to remove tire marks. A cash deposit, in accordance with the Fee and Deposit Receipt and Agreement per Non-Refundable Road Repair Fee, will be required. 7. A letter must be submitted by the Architect of a project verifying that they have complied with all requirements set forth by the Architectural guidelines, CC&R's and By-Laws and they must verify that the plans conform, and determine the cost of the improvements to determine the amount of deposit required per the attached fee and deposit receipt and agreement. 8. If further architectural and/or design changes are to take place, please submit to our attention all details for future approval. 9. Your request must be reviewed by the Architectural Committee and you will be given a decision within forty five (45) days of complete submission of all plans and specifications and any other data required by said Committee. FEE AND DEPOSIT RECEIPT AND AGREEMENT Telephone CONTRACTOR Telephone To determine the amount of deposits and fees required for a homeowner to make a real property improvement, the Board of Directors of the Pelican Ridge Community Association has approved the following criteria: CONSTRUCTION DEPOSIT (Fee s determined by Association s Agent) COMPLETED BY MANAGEMENT: (A) If the cost of any real property improvement (exterior or interior) is approximately less than $5,000.00 or construction is scheduled to last less than one week, no security deposit is required. (B) If the cost of any real property improvement (exterior or interior) is approximately less than $25,000.00 or construction is scheduled to last less than one month, the security deposit required is $1,000.00. (C) If the cost of any real property improvement (exterior or interior) is approximately greater than $25,000.00 or construction is scheduled to last more than one month, the security deposit required is $2,500.00. (D) If the cost of any real property improvement (exterior or interior) is approximately greater than $500,000.00 or construction is scheduled to last more than one year, the security deposit required is $5,000.00. (E) Dumpsters, for any use, shall require a $500.00 deposit. Dumpsters must be placed on the driveway or the deposit will be forfeited. (F) The security deposit or any portion thereof is subject to forfeiture in the absolute discretion of the Board and shall automatically be forfeited if construction lasts longer than 12 months; unless a written request for an extension is approved by the Board of Directors. (G) In the event legal services are incurred by Association for the purpose of interpretation, reviews or further documentation, Owner shall be responsible for any attorney s fees and costs incurred therein and the Owner s deposit may be charged for such fees and costs. NON-REFUNDABLE ROAD REPAIR FEE (A) $250.00 if the cost of any real property improvement (exterior or interior) is approximately greater than $25,000.00 or construction is scheduled to last more than one month. (B) $1,000.00 if the cost of any real property improvement (exterior or interior) is approximately greater than $100,000.00 or construction is scheduled to last more than three months. (C) $2,000.00 if the cost of any real property improvement (exterior or interior) is approximately greater than $500,000.00 or construction is scheduled to last more than one year. ARCHITECTURAL REVIEW FEE (A) The $1,500.00 fee will be partially refunded based on an hourly rate necessary for review and processing by the Associations agents. - 41 -
