Per Sharonville Zoning Ordinance 1157.05, Planning Commission approval is required prior to issuance of a Building Permits. Date: August 30, 2018 The applicant, Anne McBride, on behalf of Anchor Properties, has submitted a request to rezone 12181-12187 Lebanon Road (Parcel ID #608-0027-0053-00, ID #608-0027-0161 and ID #608-0027-004-00) from OFFICE-PUD to CO-PUD, and a Preliminary Site Plan Approval of the proposed Planned Unit Development. The rezoning request was submitted following a Pre-Application Conference which was held at Planning Commission on March 14, 2018 at the request of Anchor Properties, a public input meeting held at the City of Sharonville on April 25, 2018 with residents 300ft from the property, and a second Pre-Application Conference was held at the Planning Commission on July 7, 2018 at the request of Anchor Properties to discuss public input from the April 25 th meeting and incorporation of the comments into the development of the properties. The proposal includes the development of the 2.5 acre property into a free-standing bank measuring approximately 2,700 square foot in size with drive through window service and a 9.600 square foot mixed use building for commercial/retail uses and a space for restaurant with drive-through window service. The plan includes landscaping and fencing details between the property and the residential properties to the rear along Bath Court. All buildings will be single story brick structures. A 40 foot wide landscaping area is proposed in the rear. If approved by Planning Commission, Resolution 18-3 will proceed to City Council for approval. Resolution 18-3 would recommend rezoning of the parcels planned for development from OFFICE-PUD to CO-PUD. In addition, a separate Resolution - Resolution 18-4 will need approval by the Planning Commission to amend the Sharonville Zoning Code Chapter 1144 for a Commercial Office Planned Unit Development (CO-PUD) to allow restaurants smaller than 4,000 square feet in floor area and allow drive through window services as a conditional use in order for the Anchor Properties Preliminary Development plan to be implemented. Recommendation for Rezoning and Preliminary Site Plan Approval: Conditions of Approval for Planning Commission Consideration: (1) Applicant will return to the Planning Commission for Final Site Plan Approval prior to the issuance of Building permits. (2) All final site construction plans must be approved by the City s Engineer. (3) All improvements and work indicated on construction drawings/documents approved as part of this approved site plan review be installed and maintained in good repair and

replaced as necessary to remain in compliance with the approved Final Site Plan (building exteriors, parking surfaces, landscaping, fencing, etc.). RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SHARONVILLE RESOLUTION NO. 18-3 RESOLUTION RELATING TO AMENDMENT TO THE PLANNING AND ZONING CODE OF THE CITY OF SHARONVILLE, OHIO, REGARDING REZONING REQUEST TO CHANGE THE ZONING DESIGNATION FOR 12181-12187 LEBANON ROAD (HAMILTON COUNTY, OHIO PARCEL ID# 608-0027-0053-00, 608-0027-0161-00 AND 608-0027-0054-00) FROM OB-PUD TO CO-PUD AND PRELIMINARY PLAN APPROVAL. WHEREAS, The Planning Commission did receive a request from Anne McBride, of McBride Dale and Clarion, on behalf of Anchor Properties, to consider changing the zoning designation on the subject properties and Preliminary Plan Approval; and WHEREAS, A Pre-Application Conference was held at Planning Commission at the request of Anchor Properties to discuss development on the properties; and WHEREAS, Public input was solicited by Anchor Properties from property owners within 300 feet from the parcels with proposed zoning changes on April 25, 2018; and WHEREAS, A second Pre-Application Conference was held at the Planning Commission at the request of Anchor Properties to discuss public input and development of the properties on July 7, 2018; and WHEREAS, After review, public comment, and consideration, the Planning Commission did approve the rezoning request and Preliminary Plan as presented; NOW THEREFORE BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF SHARONVILLE THAT: SECTION 1. STAFF SUMMARY For the Planning Commission Meeting of September 12, 2018 To: Planning Commission From: Sarah Dircks, City Planner Subject: Amendment to Chapter 1144 of the Planning and Zoning Code of the City of Sharonville - Resolution No 18-4 Date: August 30, 2018 The current Office Planned Unit Development (CO-PUD) zoning of the above referenced properties located at 12181-12187 Lebanon Road Resolution do not allow for the establishments of restaurants smaller than 4,000 square feet in floor area nor does it allow drive through window services. The proposed amendment will allow for the future establishment of restaurants (eliminating the minimum floor area requirement of 4,000 square feet) and will allow for the establishment of restaurants with drive-through window services as a conditional use minimum general design standards will also be created that can be modified or added to subject to review of any conditional use permit request. Specifically, this amendment if approved will facilitate the development of a restaurant smaller than 4,000 square feet with drive through window service in the Commercial Office Planned Unit Development (CO-PUD) the proposed rezoning for the properties located at 12181-12187 Lebanon Road. Recommendation: Community Development Department recommends that the Planning Commission consider approving Resolution 18-4 to amend the Planning and Zoning Code Chapter 1144 of the City of Sharonville regarding restaurant uses in the Commercial Office-Planned Unit Development (CO-PUD) District.

Zoning Text Amendments (Shown in Red) Requested in Resolution No 18-4: 1144.02.01 PERMITTED USES. The following uses shall be permitted within the CO-PUD District: a) Office buildings for: professional, financial, governmental, public utility, sales, executive and administrative. b) Retail stores and services with the following conditions: (1) A minimum of twenty percent (20%) land area for each parcel within the CO- PUD District shall be allowed for freestanding retail and personal service uses with the following limitations: A. A maximum of two individual stores not exceeding 70,000 square feet each. B. One store not exceeding 25,000 square feet. C. All other retail/personal service uses shall not exceed 7,500 square feet each c) Hotels and motels for the traveling public. d) Sit down restaurants having a minimum size of 4,000 square feet. Drive-in and drivethrough services are prohibited permitted. e) Similar uses as determined by the Planning Commission in accordance with the provisions of Chapter 1161. f) Accessory buildings and uses as defined in Sections 1123.01 and 1125.02. g) Related recreational facilities such as tennis courts, golf courses, swimming pools, health clubs, etc. (Ord. 89-58. Passed 9-12-89.) h) Drive-Thru Service Windows are permitted provided that the use abides by the General Standards outlined as a conditional use in Section 1144.02.02. 1144.02.02 CONDITIONAL USES. a) The General Standards for Conditional Use Permits for Drive-Thru window services are as follows: 1. The principal use is a sit down dine-in restaurant. 2. Property must abut a major arterial roadway. 3. Drive-through shall not be located on building elevation that fronts a public street. 4. Drive-through hours of operation would generally operate between 6AM and 9PM. 5. The restaurant has a minimum of 40 percent of the gross building area devoted to indoor dining seating. b) The Planning Commission may add additional conditions or modify any of these general standards upon review of the Conditional Use Permit application.

WHEREAS, Resolution No. 18-3 was approved by the Planning Commission regarding rezoning request to change the zoning designation for 12181-12187 Lebanon Road (Hamilton County, Ohio Parcel ID# 608-0027-0053-00, 608-0027-0161-00 and 608-0027-0054-00) from OB-PUD to CO-PUD and Preliminary Plan approval; and WHEREAS, The Preliminary Plan proposed by Anchor Properties includes a restaurant facility less than 4,000 square feet in floor area and includes a drive-through window service; which are currently not permitted in the CO-PUD zoning district; and WHEREAS, After review, public comment, and consideration, the Planning Commission did approve the proposed zoning amendments relating to restaurant uses in the CO- PUD zoning district; NOW THEREFORE BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF SHARONVILLE THAT: SECTION 1. The Planning Commission herewith recommends that the City Council give due consideration to this Resolution for zoning text amendments. SECTION 2. RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SHARONVILLE RESOLUTION NO. 18-5 RESOLUTION RELATING TO AMENDMENT TO THE PLANNING AND ZONING CODE OF THE CITY OF SHARONVILLE, OHIO, REGARDING REZONING REQUEST TO CHANGE THE ZONING DESIGNATION FOR 3639 E KEMPER ROAD (HAMILTON COUNTY, OHIO PARCEL ID# 608-0019-0088) FROM GENERAL INDUSTRIAL GI TO PUBLIC FACILITIES PF. WHEREAS, The Planning Commission did receive a request from The City of Sharonville, on behalf of the Sharonville Police Department, to consider changing the zoning designation on the subject property; and WHEREAS, Public input was solicited from all property owners within 300 feet from the parcel with proposed zoning changes. The rezoning request was presented to the Planning Commission on September 12, 2018; and WHEREAS, After review, public comment, and consideration, the Planning Commission did approve the rezoning request. NOW THEREFORE BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF SHARONVILLE THAT: SECTION 1. The Planning Commission herewith recommends that the City Council give due consideration to this Resolution for zoning map amendments. SECTION 2. That the City Council initiates the necessary legislation at the earliest time allowed by law. SECTION 3. The Secretary of the Planning Commission is hereby instructed to cause a copy of this Resolution and any exhibits to be forwarded to the City Council.
