All owners and their guests (including tenants) are expected to follow them for the benefit of all owners. CC&R and Rules Violations Reporting Protocol (Approved by Board of Directors January 20, 2015) The board of directors of Villagio has developed Rules and Regulations for the community that are in addition to the CC&R's. Some of those "Rules" are enforceable through a fine process that has been established by the board. In order for any violation of these Rules or the CC&R's to be properly prosecuted, the board has adopted this protocol. It is intended to reduce or eliminate unwarranted reports of violations by owners. When a resident of Villagio observes a violation of one of the CC&R's or Rules, they need to gather as much information about the violation as possible before reporting it. (Pictures are very helpful and should be taken as long as it does not risk the reporters safety.) It should include the date, the time, the person who did the violation and where the violation is outlined in the governing documents. The person needs to report the violation to the Community Manager as soon as possible but no later than 48 hours after it occurs. The person who reports the violation must give their name, phone number and unit number. They must understand that the person they are reporting does have the right to a hearing on the incident and their name must be given to the violator if it is requested. They will be called upon if necessary to attend the hearing. The Community Manager will attempt to contact the person who committed the violation by phone, and after discussing the violation, will mail the appropriate notice. A review of the resident files will be made to see if this is a recurring incident. If there it is a recurring practice of the violator, and we are at the step of accessing a fine, the issue will be brought up at the Executive Board meeting session and the board will decide what steps are appropriate. No fines will be assessed without the board's approval. Records will be maintained by the Community Manager of all violations and resulting sanctions. Grills and Heaters (Approved by Board of Directors September 15, 2014) No grills, heaters or other appliances with an open flame are allowed to be operated or stored on any Common Elements (including Limited Common Elements) of the condominium. In addition, no propane tanks or any other flammable fluids are allowed. 2
(Approved by board of directors May 19, 2014) Household Pet Regulations As per the CC&R's established by Villagio at Dove Valley Ranch the Board of Directors has established the following rules and regulations for keeping animals at Villagio condominiums. The CC&R's state: 6 4. Pets and Animals No animals, livestock or poultry of any kind shall be raised, bred or kept in any Unit or in the Common Elements except that a maximum of two household pets no larger than thirty (30) pounds may be kept or housed in Units when expressly permitted in writing by the Board of Directors. Each Owner who desires to keep a pet in his Unit shall apply in writing to the Board of Directors for permission to keep such pet. Walking of pets on the Common Elements shall he restricted by Rules and Regulations of the Association. In no event shall any pet be permitted in any portions of the Common Elements unless carried or on a leash not exceeding six (6) feet in length. No pet owner shall permit any pet to relieve itself on any portion of the Common Elements. It shall be the responsibility of the Owner, lessee or guest to remove immediately any droppings from pets. Each Owner who keeps a pet in a Unit shall indemnify and hold all other Owners harmless against any loss or liability of any kind or character whatsoever arising from or as a result of having such pet in the Project. If a pet disturbs other Owners, the Board of Directors will give notice to the Owner of such pet to cause such annoyance to be discontinued, and if such annoyance is not discontinued and corrected, the Board of Directors may Invoke its permission to keep the pet in the Project and the pet shall be removed there from. The board of directors reserves the right to approve any animals that will be on the common elements of the property. All pets must meet the requirements of the CC&R's with regards to number and size. It is up to the management company to maintain a complete record of such pets and provide a monthly report to the board of directors as to the number of pets and their respective owners. Failure to register a pet will result in a fine according to the following schedule. The first written notice is intended to put the pet owner on notice as to their failure to register the pet. Failure to register the pet will result in a written notice and warning of fine. If the pet owner 3
fails to register the pet and / or does not meet the requirements in the CC&R's a third offense will require a fine according to the following schedule. After the sixth offense, and while the fine process continues, the board of directors may proceed to have the animal removed from the condominium. Parking: (Approved by board of directors March 15, 2013 and amended April 21, 2014) Owners are encouraged to keep their vehicles in the garages that they own. Villagio Condominiums is not responsible for damage incurred in the parking spaces provided. In addition, vehicles must not be left in designated parking spaces if they are in-operable. Designated parking spaces are only those spaces appropriately marked with white stripes. Any other spaces are considered vehicle movement space. Unless vehicles are parked in areas designated accordingly, the vehicle is considered in violation of this policy. The vehicle will be subject to the fines established by the association. Security Doors: Your option for security door's are designated by what building number your unit is in. Below is a chart that shows based on your building and the original paint scheme, what door(s) you can apply to have approved. Approved security door vendors include Steel Shield Doors (623-581-3667) and Eco Advantage (602-710-2913). All doors must be approved by the board of directors before installation. Sun Shades: (Approved by board of directors April 21, 2014) The approved sun shade for Villagio is Coolaroo which can be purchased at Home Depot, Lowes or other home improvement retailers. The shades are called Exterior Sun Shades. The color is Sandalwood. The item is considered "Extreme Heat Block" and is available in 96" x 96" and 120" x 96". They can be special ordered up to 144". All sun shades must be mounted behind the upper inside wall of the patio or balcony so as to not be exposed in the sight line. The shades must be affixed to the wall securely to avoid the risk of falling down. They must not be left in the down position when the homeowner is not present in the unit. 5
Swimming Pool Area Rules: (Approved by board of directors November 19, 2012 and amended June 17, 2013) 1. Pool and spa area is open to residents and guests from 7:00 am to 11:00 pm. Quiet hours must be observed after 9:00 pm. 2. The period of time from 9:00 pm to 11:00 pm will be designated as adult only. Anyone less than 18 years old must be accompanied by the owner of a unit or the tenant signed on a lease. 3. If you are an owner or renter presently not residing on the property, you may not have a guest use any of the facilities. 4. Pets are not allowed in the pool area. 5. Beverages must be in cans or plastic containers - no glass. 6. No drinks, candy, tobacco, popcorn, gum, alcohol or food of any kind shall be permitted in the pool or within the required walkways of the pool. 7. The Association does not employ a cleaning staff on a daily basis so all users are required to clean up after use and re-arrange furniture. 8. Children under the age of 16 must be accompanied by an adult at all times. Swimming Pool and Spa Hours: The pool is open to residents and guests from 7:00 am to 11:00 pm. Quiet hours must be observed after 9:00 pm. 9:00 pm to 11:00 pm is ADULT ONLY. Anyone less than 18 years old must be accompanied by the owner or the adult tenant signed on the lease. Tenant Registration Policy (Approved by board of directors June 17, 2013) The Villagio at Dove Valley Ranch Condominiums requires all owners of units in Villagio to submit required information to the Community Manager on all tenants for units under rent or lease. This information is to be maintained on an on-going basis in support of the Community's governing documents. All owners must submit the information to the association within 10 days of renting or leasing a unit on the Tenant Registration Form. The Board of Directors and 6
Management believe that this is a necessary step to ensure compliance with the CC&R's. It is the responsibility of the property owner to provide the tenant with all appropriate documentation. By formally registering tenants at Villagio the Board of Directors and Management feel that this will create greater accountability from homeowners and their tenants resulting in fewer CC&R violations, with less fines and fees incurred by the homeowner. The owner is to provide the tenant with copies of the CC&R's and any association rules. There is a $25 fee for processing the registration for homeowners who are or will be renting or leasing their unit. All existing contracts between owners and tenants are to be included in this program. There are no exceptions. If someone other than the owner on title resides in the unit, please complete the Tenant Registration Form and return it to Brown Community Management, Villagio at Dove Valley Ranch, 7255 E Hampton Avenue, Suite 101, Mesa, AZ 85209. On a semi-annual basis in January and July, Brown Community Management will inform owners of this requirement through the billing statement and via email. No additional cost will be incurred to the association. It is the owners responsibility to make sure that they are in compliance with this requirement. All lessees or renters names will be posted on the First Service community website with access only by the management and the board of directors. Trash Receptacles (Approved by board of directors August 18, 2014) In the interest of maintaining the appearance of Villagio's common areas, it is important that trash receptacles not be left in the development for extended periods of time. Residents are required to put their trash or recycling receptacles at their designated location for pick up no earlier than 2:00 PM prior to the day of scheduled pick up and must be returned to their garage no later than 10:00 PM the day of scheduled pick up. Window Replacement: (Approved by the board of directors July 21, 2014) The intent of this policy is to have all units comply with the CC&R's with regards to consistent appearance of all units and to avoid conflicts between owners. It addresses the appearance of the windows from both the inside and outside. 7
The approved window replacement vendor is Paramount Windows. The windows have been used in the entire phase 2 part of the development and therefore are consistent with the rest of the development as well. The approved window is a "full frame replacement". Retrofit window installation is not recommended for aesthetic reasons. Windows may be replaced on an individual basis or the entire unit. In the event the owner selects a vendor other than Paramount Windows, the vendor must agree to comply with the protocol for a "full frame replacement". The owner must have architectural approval from the board of directors prior to the commencement of any work. The owner agrees to indemnify the association for any problems associated with the window replacement. Because the area around the window exterior will be compromised, it is necessary to have it repainted to Villagio paint standards. Therefore, a contract from a designated Villagio painting company must be included with approval of the window architectural approval.
