TITLE DEEDS The Vendors undertake to deliver to the Purchasers all the title deeds in their possession as well as a recent certificate of location showing the present state of the immovable. POSSESSION The Purchasers shall be the owners of the immovable from this day, with immediate possession and occupancy. TRANSFER OF RISK Notwithstanding paragraph 2 of article 1456 of the Civil Code of Québec, the Purchasers shall assume the risks attached to the immovable, in accordance with article 950 of the Civil Code of Québec, as of the date hereof. The immovable is not a recognized or a classified cultural property and is not situated in a historic or natural district, within a classified historic site, or in a protected area, within the meaning of the Cultural Property Act. 8. The immovable does not derogate from the laws and regulations concerning the protection of the environment. 9. They are not a non-resident of Canada within the meaning of the Income Tax Act and the Taxation Act, and has no intention of changing such residence. OBLIGATIONS The Purchasers undertake to 1. Take the immovable in its present condition, declaring having seen and examined same to their satisfaction, and having verified themselves with the relevant authorities that the use they intend to make of the immovable complies with the laws and regulations in force;

Pay the costs and fees of this deed, its publication, and copies for all parties; SERVITUDE OF RIGHT OF WAY The Purchasers hereby charges the immovable property described in this deed of sale, designated servient land, with a real and perpetual servitude of right of way in favour of the remaining property of the Vendors, designated dominant land, allowing for movement by foot and by vehicle of any kind between the dominant land and the public road. All construction, repair and maintenance (including snow removal) of the location of the right of way shall be carried out at the expense of the users. He also declared that this is their first marriage, that they have never been civilly united, and that neither their civil status nor matrimonial regime has changed or is in the process of being changed.
4 DECLARATIONS OF THE VENDOR CONCERNING THE GOODS AND SERVICES TAX (GST) AND THE QUEBEC SALES TAX (QST) IN RESPECT OF LAND 1. Exemption under s. 9, Part I, Schedule V of the E.T.A. and s. 102 A.Q.S.T. The Vendor declared that the land [or immovable] was not, immediately before the signing hereof [or immediately before the Purchaser took possession thereof], capital property of the Vendor used primarily in his business, that the sale is not being made in the course of his business, and that he has not filed or undertaken to file an election in the form prescribed in subparagraph 9(2)(b)(ii), Part I of Schedule V of the Excise Tax Act, and section 102, par. 2(b), of the Act respecting the Québec Sales Tax. Accordingly, this sale is exempt from the GST and the QST under the Excise Tax Act and the Act respecting the Québec Sales Tax.
