That Planning Report Item PL 63-08 be received as information; and, 2. That the Planning Department report back to the Planning and Development Committee at such time as all public input and agency comments have been received and assessed. 2.0 EXECUTIVE SUMMARY: 3.0 ORIGIN: The Planning Department is in receipt of applications filed by Lillian Livingstone and Tony and Ida Albis for a draft plan of subdivision and an amendment to Zoning By-law No. 1784 to permit a plan of subdivision consisting of fourteen (14) single detached dwellings with 15 metre (50 foot) frontages, creating three (3) new lots for existing structures on the plan, and two (2) part blocks to be combined with the proposed residential subdivision to the north. 4.0 BACKGROUND: The subject properties were contemplated for residential development in the early 1990 s as part of the draft plan approval process associated with the neighbouring property to the north (C.K. Ho). The approved draft plan of subdivision to the north accommodated the future development of the subject properties by providing potential
Report to: Planning and Development Committee Report No.: PL 63-08 Page 2 of 4 road access through the extension of Jays Drive and Gilchrist Court (See Attachment #3). The owners of the subject properties expressed interest in the development of their properties in conjunction with the neighbouring subdivision to the north, however, they did not pursue approval at that time. The applicants have met with the land owner to the north (C.K. Ho) and have prepared a plan of subdivision on their lands that incorporates a revision to C.K Ho s approved plan of subdivision (MR-03-07). While the new subdivision application and red line amendment have been submitted under separate applications, the two plans were submitted at the same time and with all owners consent. The eastern portion of the proposed draft plan includes access from a proposed extension to Jays Drive. Eight (8) 15 metre lots are proposed on the plan with average depths of 48 metres. The Jays Drive extension is also proposed to provide access to the existing dwelling units and pool house on the subdivision lands. The pool house is proposed to be converted to a single detached dwelling. The western portion of the plan is proposed to be comprised of six (6) single detached lots with minimum 15 metre frontages around a proposed cul-de sac (Gilchrist extension) and two (2) part lots to be combined with the proposed plan of subdivision to the north. Area of Site : 2.55 hectares (6.3 acres) Present Use : Two single family dwellings, a pool house, and vacant lands Proposed Use : 14 single detached dwellings with 15 metre frontages, 3 new lots to accommodate the existing structures on the property and 2 part blocks to be combined with the proposed subdivision to the north Official Plan designation : Region: Living Area Town: Low Density Residential Present Zone Category : R1 and R2 (First and Second Residential Zones), By-law No. 1784, as amended Proposed Zone Category : Appropriate zone categories to implement the proposed plan of subdivision Surrounding Land Uses : North: Proposed Plan of Subdivision, C.K. Report to: Planning and Development Committee Report No.: PL 63-08 Page 3 of 4 5.0 DISCUSSION/OPTIONS: East: Brock Street West: Kapuscinski Park The proposed plan of subdivision has been developed in conjunction with the plan of subdivision to the north. As part of the review process, the applicants have retained a consultant to prepare a tree preservation plan and scoped environmental assessment to support the proposed lots on the extension of Gilchrist Court. The study has been forwarded to CLOCA, the Region of Durham and the Town of Whitby Works Department for review. 6.0 COMMUNICATION ISSUES/PLAN: 7.0 CONSIDERATIONS: A. PUBLIC Notice of this meeting was mailed to all property owners within 120 metres (400 feet) of the subject property at least fourteen day prior to the meeting. In addition, pubic notice signs have been erected on the site in accordance with the sign notification procedures prior to the public meeting date. Notice of this meeting was also advertised in the Whitby This Week on April 9th, 2008. B. FINANCIAL C. IMPACT ON & INPUT FROM OTHER DEPARTMENTS/SOURCES The applicant has submitted a number of studies and reports in support of their applications. The reports were circulated to relevant agencies and departments and a copy of each is available in the Planning Department for review. The following reports were submitted in support of the applications: Tree Preservation Plan and Scoped Environmental Impact Study; Conceptual Servicing Report; and, Noise Impact Study.
