CDA Properties for sale or lease
Terms & Conditions A. Fee Simple purchase and Auctions: 1. The purchase price shall not be less than the listed Minimum Bid price. 2. A non-refundable deposit of ten percent (10%) of the purchase price must be paid upon award by cash, cashier s check or credit card (Visa or MasterCard), with the remaining balance due within ten (10) business days of the award. 3. Failure to make timely payment of the remaining balance will result in forfeiture by the buyer of the ten percent (10%) deposit, and any and all of the buyer s rights, title and interest in the property will automatically revert back to CDA. 4. A quitclaim deed will be given upon full payment of the purchase price.
Terms & Conditions B. Leasehold or Ground Lease with Option to Purchase (GLOP): 1. The Lease Price shall not be less than the listed Minimum Bid price. 2. A non-refundable up-front payment of five percent (5%) of the Lease Price must paid upon award by cash, cashier s check or credit card (Visa or MasterCard). 3. The balance of the Lease Price shall accrue interest at five percent (5%) per annum. 4. Monthly payments of the Lease will be considered rental payments only and not installments toward purchase and shall not grant the lessee any equity or ownership interest in the property or be construed in any way to encumber CDA s rights, title and interest in the property beyond the granting of a lease for a specific term of years. 5. Maximum acceptable Lease term shall be fifteen (15) years or 180 months.
Terms & Conditions 6. A lease agreement will be given and shall include: a. No alterations or improvements without the prior written consent of CDA. b. Lessee to insure property and improvements during the Lease term. c. Lessee responsible for all utilities and other charges associated with the property. d. Lease not to be assigned or mortgaged without prior written consent of CDA. e. Failure to make a monthly payment grounds for termination and eviction. f. Lease may, at the request of lessee, contain an Option to Purchase provision exercisable upon: (i) payment in full of the Lease Price; (ii) the Lease not having been declared to be in default; and (iii) payment of $100.00 option consideration. If the option is properly exercised, a quitclaim deed will be given. 7. Failure on the part of Lessee to close or execute a lease agreement within ten (10) business days of the award will result in forfeiture by the Lessee of the five percent (5%) up-front payment, and any and all of the Lessee s rights, title and interest in the property will automatically revert back to CDA.
