Adoption of the Agenda 3.1 Thursday, August 22, 2013 Moved by: Councillor Neuman Seconded by: Mayor Shulist RECOMMENDATION: THAT the Roads, Property and Planning Committee Agenda for Thursday, August 22, 2013 be approved as presented. 4. Delegation 4.1 Mike Bohm RE: Follow up on 925 Old Barry's Bay Road Mr. Bohm attended the table at 9:01 a.m. and reviewed the information regarding the shoreline road allowance and the road right away that was to be an exchange of property between the Township and himself. He along with Mr. Simpson, Wally Simpson Surveying, reviewed the survey which changed the dimensions of the property and questioned the amount of land that will have to be considered as it will not be an equal exchange of property. Committee directed the Operations Manager to perform a site visit and provide a recommendation on if the Township should consider purchasing the road right of way. Direction was given to the Planning and Licensing Officer to contact the Municipal Solicitor to update her on the possible purchase/exchange of land. Mr. Bohm requested that Committee consider the original price be honored as his intent to purchase was expressed prior to the moratorium was placed on lakeshore road allowance sales. Committee discussed how the price would be established as it was not a straight exchange of land as originally considered. The

price before the moratorium will be honoured and Mr. Simpson will provide a recommendation for the calculation of the land to be considered by either parties. Mr. Bohm left the table at 9:15 a.m. 4.2 Brian Martin RE: Otter Lake Lane - Private Road Maintenance Mr. Martin, Otter Lake Lane Property Owners' Association President attended the table at 9:16 a.m. He referred to his letter requesting assistance from the Township to maintain and upkeep Otter Lake Lane. He referred to other roads the Township has provided private road maintenance for and questioned the policy on how it was determined which private roads receive assistance and what standard they must meet. The Operations Manager explained that some roads have been grandfathered into the system, others classified by bylaws and others are forced roads. Mr. Matthews also attended the table and requested Committee provide clarity on the policy including the history of the policy. He added that he would like Committee to consider assistance to Otter Lake Lane as it is used for approximately 17 residents, along with being an access road to the snowmobile/atv trails. Direction was given to the Acting CAO/Clerk/Treasurer and the Planning and Licensing Officer to provide a report regarding the difference between a private and a public road. This report will also include the process that has been established to assume private roads, particularly the required standard they must meet prior to their assumption. The Municipal Solicitor will be contacted to provide assistance in preparing this report. Mr. Martin left the table at 9:53 a.m. 4.3 Mike Gutoskie - July 29, 2013 Letter from W.J. Simpson Surveying Ltd. - July 29, 2013 RE: Road Allowance Across Part of Lot 12, Lot 11, and Lot 10, Concession 14 and Concession 1 Mr. Gutoskie was not available. 5. Severances 5.1 Severance Application B43/13 Owner: Lenc, Miroslaw Part of Lot 27, Concession 7, in the geographic Township of Jones, now in the Township of Madawaska Valley, in the County of Renfrew (99mx109m - 0.8 ha.) Location: 336 Wiltom Drive It was noted that the Septic Inspector approved the application. Moved by: Councillor Yantha Seconded by: Mayor Shulist RECOMMENDATION: THAT Severance Application B43/13, Lenc, Miroslaw, Part of Lot 27, Concession 7, in the geographic Township of Jones now in the Township of Madawaska Valley, in the County of Renfrew (99m x 109m - 0.8 ha.) be approved as applied for to sever a 1.97 acre parcel of land as a rural residential building lot, to be used for residential purposes subject to i) the municipality conveying the 0.3 metre reserve to the applicant. 5.2 Severance Application B184/12(1), B185/12(2) and B187/12(4) Owner: Mickus, Suzanne E.

New Business Parts of Lot 8, Concession 3, in the geographic Township of Radcliffe, now in the Township of Madawaska Valley, in the County of Renfrew Location: 1737 and 1753 Lower Craigmont Road It was noted that the Septic Inspector approved the application. Moved by: Councillor Yantha Seconded by: Councillor Neuman RECOMMENDATION: THAT Severance Application B184/12(1), B185/12(2) and B187/12(4), be approved as applied for to sever a 3.8 acre parcel of land to be used for residential purposes as rural residential building lots. 7. Old Business 7.1 Letter from S.G. Gulyas - June 13, 2013 RE: Wilowski Drive Rebuild The Roads Supervisor addressed Mr. Gulyas letter noting that completion of Wilowski Drive is scheduled over the next 6 years. They will continue to rebuild one kilometer of road per year commencing in October. He added that the logging road is mandated through the Ministry of Natural Resources and not the Township. Direction was given to the Operation's Manager to respond to Mr. Gulyas's letter. 7.2 Email from Gord Krieger, Genivar - July 9, 2013 RE: Yantha Subdivision Committee discussed Mr. Krieger's email regarding the Yantha Subdivision. Direction was given to the Planning and Licensing Officer to forward Mr. Krieger's letter to the Municipal Solicitor and have her address Mr. Krieger's recommendations with the owners of the Yantha Subdivision. 7.3 Letter from CanAcre, Haseeb Amirzada Planning/Permitting Specialist - July 10, 2013 RE: Bell Mobility 90 metre Guyed Tower, Palmer Road Email from Haseeb Amirzada - August 8, 2013 RE: Guyed Tower, Palmer Road Committee questioned the reports provided regarding the Guyed Tower on Palmer Road and had concerns with the lack of explanations from CanAcre regarding the development. Direction was given to the Acting CAO/Clerk/Treasurer to contact CanAcre and invite them to send a representative to a Committee Meeting and answer any concerns they might have. Committee did not provide concurrence to CanAcre for the Guyed Tower. 7.4 Letter to John Holownia - July 30, 2013 - Silas Lorbetski RE: Pawlowski, Stanislaw A & Elizabeth G. - Application to purchase the Shoreline Road Allowance along Wadsworth Lake The Planning and Licensing Officer explained he has not received a response from the abutting land owners regarding the Pawlowski application for Shoreline Road Allowance. RECOMMENDATION: (Moved By: Councillor Yantha; Seconded By: Counicillor Neuman)

THAT the Roads, Property and Planning Committee recommend that Council proceed to move the Shoreline Road Allowance Application forward for Stanislaw and Elizabeth Pawlowski along Wadsworth Lake, in front of their property being that of part of Lot 21, Concession 13, geographic Township of Radcliffe in the Township of Madawaska Valley. 7.5 Letter from W.J. Simpson Surveying - August 6, 2013 RE: Reference Plan of Survey - M. Jablonski/T Zawidzki - Chickadee Lee Information. 7.6 Report to Committee - Hilary Kutchkoskie - August 15, 2013 RE: Wilno Rink Committee reviewed the Operations Manager report regarding the Wilno Rink. The Chairperson requested the removal of Shalla Street from the agenda and place it on the next Roads, Property and Planning Meeting and focus on the issue of the purchase of the Wilno Rink. Committee discussed the Charter that the current owners have with the Wilno Rink and if it was necessary to dissolve it. Committee questioned if the Charter had any impact on the Wilno Heritage Society, in which it was explained that it did not. Committee further discussed the purchase of the Wilno Rink and the potential costs involved with up keeping the facility. Direction was given to the Acting CAO/Clerk/Treasurer to contact Killaloe, Hagarty and Richards and request a meeting to discuss a joint committee and cost sharing agreement between the two Townships. 7.7 Public Works Road Report - July and August 2013 The Roads Supervisor reviewed the Public Works Road Report for July and August 2013. He added that guardrails will need to be addressed on Tamarack Road. Committee questioned if he was within the overall Roads budget, in which he replied they are within the overall budget. Committee also questioned the purchase of a paver and roller, he explained the roller has arrived and he is in the process of inspecting the paver. 8. In Camera 8.1 Moved By: Councillor Neuman THAT the Meeting enter into In-Camera Session at 10:30a.m. to discuss matters pertaining to "personal matters about an identifiable individual, including municipal or local board employees", "litigation or potential litigation, including matters before administrative tribunals, affecting the municipality or local board", Ontario Municipal Act 2011, c.25, s.239 (2)(b)(e). 1.
