THAT, aware that Article 6(2) of the Constitution recognizes that the National and County governments are distinct and interdependent; and that Devolution is an important principle in the new structure of governance; further aware that recognizing the fundamental role of education worldwide in fostering economic and social transformation has prompted government to create specialized agencies to among other functions, regulate the training, registration, recruitment and deployment of teachers; noting that the function of pre-primary education is vested in the County Governments pursuant to the Fourth Schedule of the Constitution and that the County has inadequate teachers in pre-primary level, this Assembly urges the County Government of Nairobi to employ enough teachers in ECD centres. 13.02 2014. THAT, aware that of late there has been an increase in the number of street children/families within the Nairobi City Central Business District, greatly affecting business in the City Centre; further aware that this problem had turned into a social nightmare with more street 18.02.2014 Hon. children/families invading major streets within the CBD; concerned that these street children are now extorting money from innocent pedestrians and motorists through intimidation and threats of use of human waste, this Assembly urges the County Government to move with speed and address this issue. explaining the plan of action on it. 10. THAT, aware that the Nairobi City County is the hub of East and Central Africa with vast potential and resources for wooing foreign investors especially in the hospitality industry; concerned that there is poor location of food courts and eating hubs with most of the eating places being housed within or adjacent to major petrol stations within the city or along major highways thereby exposing consumers to pollution more so to the risk of exposure to the hazardous Benzene Toloen Ethylbenzen and Xylene (BTEX) commonly found in petroleum fumes; this Assembly urges the County Executive Committee to take necessary measures to relocate food courts situated within or adjacent to petrol stations to safer havens. 18.02.2014 Hon. THAT, aware that the Constitution of Kenya (2010) grants the citizens of this republic comprehensive rights and fundamental freedoms; further aware that law enforcement is crucial to harmonious living and the orderly conduct of business in the City; deeply concerned that the enforcement of City by-laws by County askaris most often borders on the illegal and unconstitutional, characterized by arbitrary arrests and harassment of Nairobi residents thus 18.02.2014 Hon. No. SUBJECT NOTICE OF infringing on their rights and fundamental freedoms; noting that such arbitrary arrest and harassment exposes the County Government to costly litigation from affected residents; this Assembly urges the County Government to urgently hasten the reorganization and retraining of the County Askaris to ensure compliance with the Constitution in enforcement of County legislations and by-laws. 12. THAT, aware that Nairobi City is getting overpopulated and there is need to have an efficient transport system; deeply concerned that Nairobi City streets have no special lanes for the motorcycles and many accidents occur on daily basis; further aware that some of these motorcycles are known to use pavements therefore causing unnecessary traffic jam; and that to avoid future disasters since our hospitals are recording a high number of motorcycle victims, there is need to urgently deal with the situation; this Assembly resolves that the County Government bans motorcycles and tuk tuks from entering the City Centre. 19.02.2014 Hon. THAT, pursuant to Section 45(1) (b) of the County Governments Act, this Assembly adopts the Third Report of the Sectoral Committee on Education, Children and Youth Affairs on the vetting of the Nominee for County Chief Officer- Education, Children and Youth Affairs. 16. THAT, aware that the Nairobi County Public Service Board is charged with the mandate of appointing persons to hold offices in the County Public Service and promote values and principles contained in Articles 10 and 232 of the Constitution of Kenya (2010); further aware that the Board failed to submit its report on the execution of its functions to this Assembly on the month of December, 2013 as provided for by Section 59 (5) (1) (a) of the County Governments Act 2012; deeply concerned that the Board has on two occasions forwarded to the County Assembly names of nominees who do not meet the standards set to hold County offices as provided for in Chapter Six of the Constitution; this Assembly resolves to remove the Members of the Nairobi County Public Service Board on the ground of incompetence and violation of the Constitution and the County Governments Act, 2012. 27.02.2014 Hon. THAT, aware that the Transition Authority under Legal Notice No. 177 provided for the transfer of the county transport function including county roads, mechanical and transport equipment and public road transport to county governments; concerned that this function is yet to be transferred despite Nairobi City County s compliance with all the pre-requirements and having 37 certified engineers; noting that the Fourth Schedule of the Constitution (2010) 04.03.2014 Hon. supports the devolvement of this function, this Assembly resolves that the Transition Authority should immediately undertake all the necessary measures to ensure the transfer of the county transport function to the Nairobi City County Government. 20. THAT, aware that Nairobi City County has the highest population with the fastest infrastructure development; deeply concerned that the failure to mark and name all roads and streets and to number all the buildings is hampering the aforementioned development; noting that this is crucial in order to see the provision of quick and efficient services such as courier, firefighting, security and postal services, this Assembly resolves that the County Government move with speed and ensure that all county roads, streets and buildings are marked and the building number should coincide with the land registration number where the building stands to facilitate land rates collection amongst other things. 05.03.2014 Hon. 22. THAT AWARE that refuse, dumps and solid waste disposal in Nairobi City County remains a serious issue and poses environmental and health hazard to the people of Nairobi City County. Noting that refuse collection is an employment and investment opportunity to huge refuse collectors. Acknowledging that Nairobi City County produces huge tons of solid waste and refuse coupled below capacity and inadequate manpower to effectively handle refuse and solid waste. This Assembly urges Nairobi City County Government to remove all the bottlenecks existing in the solid waste management industry and ensure that there is an enabling legal frame work to facilitate youth groups initiatives and companies managed by youth in solid waste and refuse collection are contracted alongside private collectors. 23. THAT, AWARE that over 55% of the residents of Nairobi City County live in the informal settlements that are poorly planned with inadequate basic infrastructure, who by either omission or commission are denied basic services and cognizant of the fact that these settlements are prone to fire outbreaks and other disasters which have led to massive losses of life and property, this Assembly urges the Government of Nairobi City County to immediately equip all wards with informal settlements, with minimum firefighting equipments, facilities for rescue, evacuation and recovery and further identify community members per ward to be trained in firefighting and disaster management skills. 24. WHEREAS, the Ward Development Fund is to be allocated to the wards through the County Assembly respective committees, WHEREAS the ward development committee is responsible for the managing of the funds for the proposed projects within the wards from the list submitted to the secretary of the committee, NOTING that there projects are community based including environmental activities 30.5.2013 Hon. No. SUBJECT NOTICE OF considered as development projects, AWARE that Section 48 of the County Act provides for the decentralization of the county services to the wards, CONCERNED that people are experiencing hardships due to stalled projects earlier funded through LASDAP at a cost of seven Million shillings per ward, this Assembly urges the County Government to establish Ward Development Fund for the Financial Year 2013/14 for a budget of Ten Million shillings per ward to be deducted from the Constituency Development Fund. 25. THAT, WHEREAS Langata Cemetery was established in 1956 in Nairobi measuring about 117 acres under the management of the defunct City Council of Nairobi; WHEREAS the cemetery was reportedly full by the year 1996 thus necessitating the recycling of the old graves and burying of the bodies in three layers henceforth; NOTING that the cemetery now belongs to the Nairobi City County and an alternative burial site need to be identified as a matter of urgency; AWARE that between the years 2007-2008 the funds which were allocated by the Government for that purpose were misappropriated and culprits charged in Court; CONCERNED that lack of a public health cemetery poses a clear and health hazard to the residents of Nairobi City County; this Assembly urges the County Government to declare that the Langata Cemetery is full and to urgently identify a suitable new cemetery ground 26.
