You have purchased property in a deed restricted community with Architectural control guidelines. All exterior changes and extensive landscape changes require ARC approval. This applies to independent homes as well as homes in a condo association. You can get this approval if your modifications meet Section 22 Restrictions by filling out and submitting an application, first through your neighborhood association with final approval by the master association. BURNT STORE MARINA OVERVIEW Burnt Store Marina is a community of approximate 1920 residences, or units, spread out over 600 acres with a diverse assortment of housing styles. We have independent single homes and over 40 neighborhood associations with single homes, duplexes, tri-plexes, four-plexes and high rise condominiums. The neighborhood associations have boards of directors and collect operating fees from their residents. The master association for all of BSM, including independent homes, is commonly referred to as Section 22 HOA. It collects an annual fee through its property manager to cover the maintenance of the common areas, roads, access systems and infrastructure. Residents of the Prosperity Point gated island have an additional board between their neighborhood associations and the Section 22 HOA board. Our community is also unique in that it is one of the few gated communities with both a 27-hole golf course and a marina. In fact, the marina is the largest deep water marina on the west coast of Florida. Additionally, there is a fitness center with both workout equipment and classes, tennis courts and a swimming pool. Don t forget to visit our 3 restaurants, Cass Cay and the Trading Post down at the marina, and, Linkside Café at the golf club. One very big advantage to living at BSM is our community access system which is in effect at all 3 of the points of entry: front gatehouse manned 24/7, and the 2 entries on Vincent Ave. The Matecumbe Key Rd. gatehouse is manned during the day, and, the Cape Cole Blvd. entry at the golf course has electronic gates (with cameras). This is a highly effective system incorporating the Gatekeeper System and bar codes issued for resident vehicles. Complex? A bit, but included in this packet of information is the annual Burnt Store Marina Address Directory & Information Guide. Not only does it have a map of the community, but it also lists all the neighborhoods and their codes so you know what association a new friend lives in. Plus, you will find frequently called and disaster emergency information numbers, resident contact information, Section 22 HOA Bylaws, rules governing the use of golf carts, local businesses and the list goes on. There is no reason not to know what is happening at Burnt Store Marina. The Beacon is our monthly newspaper featuring Board and resident contributions. It s delivered by neighborly volunteers to your door or to the lobby of your condominium. Additional copies are located at the BSGAC office, Harbormaster s office and Fitness Center. Be sure to take note of the Mark Your Calendar feature in The Beacon for meeting dates of Section 22 HOA Board, Burnt Store Book Club, Photography Club, morning bicycling group, local farmers markets and area events. Rules for Issuing Vehicle Bar Codes Community Access Committee (CAC) Section 22 HOA, Burnt Store Marina An owner is the party whose name appears on the deed as recorded in the Lee County Property Appraiser s Office, and who occupies their unit, full time, seasonally or intermittently. 1. Each resident/owner is entitled to one bar code for his or her personal vehicle. A second bar code may be applied for if the resident has more than one vehicle. The resident owner s name must appear on the registration unless provided otherwise in these rules. Every resident/owner must provide a copy of the vehicle registration for every vehicle to which a bar code is to be issued. 2. Full time family members, who occupy the unit with the resident may be considered for bar codes. Proof of resident s status is required. Temporary or short term visits are not considered to comply with this rule. 3. Resident/owners who own multiple units within Burnt Store Marina are not entitled to additional bar codes other than those assigned to their personal vehicles. 4. Renters of unit owners, for a period of less than 2 months, may be provided with a window pass for their rental period to help speed the process through the front gate. Renters of unit owners, for a period of more than 2 months, may apply for a self-terminating bar code. An administrative fee of $30 per season will be due at the time of application. 5. Rental cars for unit owners who occupy their units intermittently, with a rental vehicle not registered in their name, may apply for issuance of a self-terminating bar code or temporary bar code. Exact times and dates are required for the issuance of these bar codes and they are only for the owner s use. A copy of the rental lease will be required. For short duration stays by owners with rental cars, a refundable deposit may be required to obtain a special limited bar code decal. Rental bar codes are issued on regular bar code days/hours. 6. No bar codes will be issued for golf carts, ATV S or recreational vehicles. Motorcycles can be considered for bar codes if mechanically the motorcycle can have the bar code properly placed and affixed to the vehicle. 7. No bar code shall be issued in the name of a commercial entity, i.e., Realty Company, commercial partnership or corporation. A commercial entity may select an individual to receive a barcode as long as that individual meets the rules. Resident/owners who have vehicles registered in corporate names can be issued bar codes with proof of residency. 8. It is the resident/owner s responsibility to notify the Master Association Manager that their unit has been sold. -4-

9. It is a resident/owner and/or barcode holder s responsibility to notify the Master Association Manager of the sale, transfer or other disposition of a vehicle with a bar code attached. Upon notification, the bar code shall be disabled. 10. The Master Association Manager shall not issue a new bar code for any newly acquired vehicle that otherwise would qualify for a bar code unless the previously issued bar code assigned to the resident/owner has been disabled. If the new vehicle is in addition to the existing registered vehicles, a copy of the registration must accompany the application. 11. The Access Control Supervisor or CAC will review all applications before a bar code will be issued. All bar codes shall be permanently affixed to the vehicle by the Access Control Supervisor or a duly authorized member of CAC. 12. On a regular basis bar codes that have not been used in a one year period will be disabled by the Access Control Site Manager. If any resident comes in with a disabled bar code, the Site Manager will reactivate said bar code after making sure the person is still a resident and the information for the bar code is accurate. 13. Any unauthorized use of a bar code may result in an automatic one year deactivation of all bar codes held by that resident owner or bar code holder. Anyone who has lost the privilege of a bar code may appeal this loss to the Section 22 HOA Board of Directors. The use of hand held bar codes not affixed to the vehicle is considered an unauthorized use. Before a bar code is issued to any resident their status as a member in good standing of Section 22 HOA must be verified by the Master Association Manager. As approved by the BOD, CAC may authorize the issuance of bar codes to full time employees of businesses or organizations within BSM that provide a list of current employees and will agree to provide notices of personnel changes. Each bar code decal will be subject to a $30 administration fee for these non-resident commercial or organization employees. The Control Access Committee is a standing resident committee tasked by the Board of Directors to advise them on issues of security and gate entry. Research and background information are provided to the Board along with recommendations to deal with resident concerns or problems referred from the Board to the committee. -4b- Rev. 12/2016

BURNT STORE MARINA GATEKEEPER VISITOR ACCESS SYSTEM INFORMATION The computer automated guest control access system is designed to allow guests and visitors whom you have designated on a pre cleared list to be granted quick and easy access through the front gate or the commercial (back) gate. Additionally, if you expect single-visit guests or service personnel, the system can authorize entrance to single entry or infrequent guests or service personnel. Call the Gatekeeper automated system at 941-639 0334. Provide the name of the guest or the service company and the expected time of the visit. This one-time clearance is cancelled after the designated visit or date. The Gatekeeper Resident & Permanent Visitor Information Form needs to be updated, filled out and sent to the front gate site manager. Any additions and deletions to this form must also be made in writing to the front gate site manager. Our residents use the Gatekeeper system. The system will deny entry to anyone not on the permanent list, anyone not been pre cleared by a phone call, or, if a call by the Access Control officer to the resident finds there to be no one home to authorize entrance. This is for your protection to prevent unauthorized visitors. A call will always be made before anyone is denied entry. Further provisions are available to identify those persons who you do not wish to allow entry to your residence. Notify the front gate site supervisor in writing if you wish to place restrictions on specific Guests. Please remember to update the system should any information change, including your preferred phone number. -7- Rev. 12/2016

Renting Your Property? Dear Burnt Store Marina Owners, Are you a BSM owner who rents, leases or loans their units? Too often renters arrive at the Front Gate and report that they are renting a unit but have no information other than the address. Often, they have no paperwork, such as a lease or rental agreement, and no contact number for the unit owner. Sometimes the unit owners are in the Gatekeeper system but the listed phone is for the local unit and not for the owners. While the renters may have the keys to the property (and this is not always the case) they have no documentation that they are authorized to occupy the property. When guests/renters arrive without paperwork and ask for entry, and we have no way of contacting the unit owner, the Front Gate personnel use their best judgment in allowing entry by documenting as well as possible the renters. They do this by examining and copying the driver s license and entering the data into the Gatekeeper system as a renter. In order to properly manage users/renters entry you should provide a written agreement, such as a lease agreement copy, rental agreement, a letter of authorization or a Renter s Gate Access Form (found in the welcome packet or on the BSM website, www.bsm22.org) indicating the guest, user or renter can enter your property. This can also be done by email to securitybsm@gmail.com. This paperwork should have the name and current phone number of the unit owner and the name of the individual using the property. It will allow the renter to be entered into the computerized Gatekeeper, so that when they arrive, they will already be in the system. It makes it easier for a renter s guests to gain entry, as well.
