General Tenancy Agreement Annexure A This annexure has been prepared to highlight important issues during your tenancy. Some of the information is also contained in the Terms and Conditions of the General Tenancy Agreement and Body Corporate By-Laws, which must be read and understood. Property Manager The tenant/s has been given full contact details for the Property Managers (D & P Clement Pty Ltd). They understand that normal contact is through the office at 33/108 Alma Rd, Dakabin, Qld 4503. The tenant/s understand that this is the single point of contact and that in emergencies only the tenant/s should use the after hours emergency number. The tenant/s understand that (D & P Clement Pty Ltd has been appointed by the owner to act as their agent and all communication is to be via the property manager. Office Hours The property manager will be available either in the office or by phone during normal office hours, Monday to Friday & Saturday to 12pm.. Outside normal office hours the property manager will be available for EMERGENCIES ONLY. Tenant Details All of the approved tenants are listed on the tenancy agreement. The tenant has ensured all names are spelt correctly and understands that each tenants is equally responsible for the payment of the full rent on time and the care of the property. It is the tenants responsibility if contact details change that they are updated with the property manager. The tenant acknowledges that any communication received from the property manager is for the attention of all tenants and will ensure that messages are passed on to any other tenants. Change of Tenants. If a new tenant wishes to replace an existing tenant, the new tenant must be approved in writing. The new occupant is to complete an application form and have it approved before moving in. If an existing tenant wishes to move out of the property, the property manager must be notified even if no person is replacing them. Any change in tenants is subject to the approval of the owner. Any changes in tenants requiring changes to lease documentation including bond changes will incur an administration fee of $100.00 Approval to give out tenant details. Our office is required to collect personal information from the tenant in order to manage their tenancy. The tenant agrees that the agent may give out the tenants details to 3 rd parties related to the property or as required by law, ie tradesmen, termite and pest inspectors/controllers, valuer s, salespeople, insurance companies, tribunals and courts etc. Rental Bond The rental bond paid for the property occupied will be unless otherwise stated, be 4 weeks rent and will be lodged with the RTA. After the tenant has vacated and the final inspection conducted, the bond will be released less any deductions that may need to be taken for cleaning or repairs etc. Property Condition Report The tenant has received the ORIGINAL Tenancy Condition Report and is signed on all pages by the property manager. The tenant/s understands that they have 3 days from the beginning of the lease to complete the tenant s side of the condition report and return it to the property manager. If the tenant/s fail to return the condition report to the property manager within 3 days then it is deemed that they have accepted the condition of the property as per the property managers description on the condition report. Keys, Remotes and Instruction Manual s. The tenant/s accept the keys, remotes and manual s as issued and described in the condition report and photocopied description of the keys and understands that they are responsible for the replacement of any lost or damaged items upon leaving at the end of the lease or at any time during the lease. Folder replacement will be at a cost of $50. Anything else at market rate. Rent The tenant/s understand that the rental amount as stated on the lease is due on a fortnightly basis payable prior to the expiry of the previous fortnights rental payment. Payments made using electronic payments must be made prior to 3pm the prior day to ensure payments clear by the due date. Late Rent Tenant/s understands that rent must be paid on time. If rent is not paid by the due date, contact will be made with the tenant/s on each and every day that the rent is late and that formal notices will be issued as per the RTA schedule. Electricity, Gas, Telephone The tenants understand that they are responsible for the connection of all services with the relevant service providers and are responsible for all cost involved in connection and all ongoing costs. Phone Connection Costs The tenant may lodge a request for reimbursement of new phone line/ NBN connection costs, and they understand that the approval of this request is at the discretion of the owner. Water Charges The tenant understands that they are responsible for ALL water usage and they will be invoiced quarterly by the property manager as per the rate shown on the owners water utility s notice or as advertised by the Moreton Bay Council or its Utility Provider. Water meter reading will be taken quarterly and the tenant/s invoiced which will be payable within 30 days. Body Corporate By-Laws Are provided at the start of a tenancy and the tenant/s understand that they are required to comply with these rules which apply to tenants and their guests. Pets Tenants must obtain written approval from the Property Manager before allowing pets to be kept at the property, even if the pets are only to be kept on the property for a short time. If tenants keep any kind of pet at the property they are responsible for having he property professionally treated for fleas both inside and outside at the end of the tenancy at the tenants expense and provide to the property manager a receipt to prove treatment. The tenant is responsible for any damage done to the property, including lawns and gardens, by any pet kept on the premises. The tenant also agrees that if there is any sign of pet urine/faeces that it will be professionally treated and that if there is any delay in treatment or the treatment is unsuccessful they the carpet and or underlay will be replaced at the tenant s expense. The tenant accepts full responsibility for any animal/pet that the tenant brings or allows upon the property or common property with or without the consent of the property manager and will be solely responsible for all loss and damage or injuries suffered by any person with is attacked by any such animal. Additional clauses may apply if pets are to be permitted. Pest Control The tenant is responsible for the internal treatment of the property when vacated or as required through the tenancy for general pests, ie cockroaches, ants, spiders, fleas etc. It is the owner s responsibility to have completed inspections undertaken for termites. If upon general inspection the property is found to have an infestation of general pests then the tenant will be immediately responsible for the eradication of these pests and all costs associated. Additional clauses may apply if pets are to be permitted. Garage, Car Parks, Roadways and Driveways Motor vehicles are only to be parked in the designated areas. It is prohibited to park vehicles on grass, gardens or on the main internal access roads within the complex. Any damage done by tenants or guests vehicles must be repaired by the tenant or repairs will be carried out and the tenant invoiced for the repairs. Designated VISITOR car parks are prohibited by Body Corporate By-Laws from being used by residents. Damage or staining occurring from residents vehicles must by cleaned promptly or the tenant agrees that it will be cleaned and the tenant will be responsible for the cost incurred. Gardens and Back Yards. Unless included in the rental package, the tenant understands that they are responsible for the general upkeep of all private use areas within their property which includes pruning of trees and plants, watering of gardens as allowed under council water restrictions, weeding or gardens, mowing lawns, removal of all green waste. Failure to complete these tasks may result in professional cost for which the tenant would be responsible. The tenant understands that no timber products or personal possessions will be stacked or stored on or against external walls or fences within their property.

This encourages termites to breed in these areas allows them to gain access to the building structure. Carpet care during tenancy. The tenant agrees to immediately treat any stains/marks on the carpet to avoid the stains/marks becoming permanent. If necessary, a professional carpet cleaner should be engaged by the tenant at the tenant s expense. If carpets are not maintained as per the manufacturer s recommendations, (Regular vacuuming, immediate removal of stains and professionally cleaned when required then the carpets may require replacement at the tenants cost. Additional clauses may apply if pets are kept at the address. Smoking The tenant/s acknowledge that smoking is not permitted inside the premises and accept all responsibility for all damages resulting from such action such as discolouration and excessive odour build up to paint on ceiling and walls, blinds, curtain s, carpets and air conditioner units. Smoke Detectors As of the 1 st of July 2007 As of 1 July 2007, the Fire and Rescue Service Amendment Act 2006 requires that tenant/s clean and test all smoke alarms that are in their rentals home. This must be done at least once during a twelve-month tenancy. The cleaning and testing of alarms applies to tenancies of 12 months or longer, or if your tenancy is, or becomes a periodic tenancy. It is also a requirement that tenants change the battery in any smoke alarms/s when it is flat, or almost flat. If you become aware that a smoke alarm has failed or is about to fail, other than because of a flat battery please advise our agency immediately. If you are unable to fulfil your legislative duties personally, our agency can supply a list of preferred contractors that can carry out the work for you at your expense. Or, if you prefer, you can appoint your owner contractor. It is strongly recommended that you ensure that any contractors that are appointed on your own behalf carry adequate qualification (if required) and hold public liability insurance. This owner is responsible for this if you renew your tenancy agreement and at the start and end. Emergency Repairs The lease identifies the situations which are classified by the RTA as Emergency Repairs. All maintenance requests are to be directed to the property manager and the tenant understands that if they choose to organise repairs themselves that they may be responsible for any costs incurred. Maintenance Requests All maintenance requests (apart from emergencies) must be submitted to the property manager in writing in the form provided. The tenant agrees to notify the property manager of any damage or repairs that may be required on the property. At all times the tenants first point of contact will be the property manager. If a tradesman performs work at the property, the tenant agrees to contact the agent when that work has been completed. If a tradesman performs routine maintenance at the property, the tenant will be given the opportunity to schedule a day/time with the tradesman during normal business hours so that the tenant can be present. If the tenant cannot be present during normal business hours then the tradesman will gain access to the property via the property manager s keys. If a tradesman performs work at a property and advises the property manager that the issue was caused by the tenant, then the tenant agrees to be responsible for the payment of the account. For example, power failure caused by a faulty tenant appliance, foreign object blocking a toilet or garbage disposal unit. Tenants are responsible for any light bulbs/globes that fail during the lease and replace any cracked or broken window screens. Picture Hooks/Blue Tack/Nails/Adhesives The tenant agrees that no such items will be attached to the property without written approval from the property manager. The tenant accepts responsibility for the cost of repairs if such items are used and cause damage upon removal during or at the end of a tenancy. Pay Television No tenant shall install or cause to be installed any external items in regard to pay TV without written authorisation from the property manager. If approved the installer must arrange a time with the property manager to be present to authorise the planned installation and while installing takes place. The tenant accepts full responsibility for any damage done during the installation of said equipment and the rectification of any improper installations which are not carried out to the instructions given by the property manager. Rubbish Bins Rubbish bins must be placed out in marked bin bays or assigned position for collection on advertised rubbish days for collection by the Morton Bay Council or its assigned contractor no earlier than the previous afternoon and taken in once collected within a reasonable time. Bins must be kept in a clean and sanitary condition to ensure that unwanted pests and flies are not attracted. Bins must be kept behind the side gate or in the allotted position at the front of units with no gates. BREAKING THE LEASE The Property Manager can assist the tenant should the tenant need to break the lease by leaving early. The first step in breaking the lease is to sign and return the Agreement to Terminate Fixed Term Tenancy. The tenant will be responsible for paying rent up until the day prior to the start date of a suitable replacement tenancy plus a re-letting fee of one-weeks rent plus GST. The tenant will also be responsible for paying for the smoke alarms to be function tested by an appropriately qualified technician and the receipt provided to the Property Manager. A suitable replacement tenancy is one in which: Applicants are approved by this office after reference checking; New fixed-term tenancy agreement is signed; Expiry date not before the end of your tenancy; Weekly rent of not less than your tenancy While the tenant is still living in the property, the property manager will be required to show the property to prospective replacement tenants. The tenant will be required to provide the Property Manager with a contact number that can be provided to prospective replacement tenants so that an inspection time can be arranged directly with the tenant. The tenant will also be required to complete the standard vacating procedure, such as carpet cleaning, pest control and general cleaning of the property. The tenant should allow sufficient time between vacating the property and the start date of the replacement tenancy (such as three business days) to complete the cleaning and bond refund inspection process. Procedure for End of Tenancy If the tenant wishes to move out on the end date of the lease, the tenant must still give 2 weeks notice prior to the end date. The tenant agrees that when giving notice that it must be in writing using the enclosed Form 13 Notice of Intention to Leave and handed or faxed to the Property Manager. The notice is not effective until the Property Manager receives the form. The tenant agrees that if the premises are not cleaned to the satisfaction of the Property Manager by reference to the initial condition report within a reasonable time upon vacating, then a professional cleaner will be engaged to return the property to the condition it was at the start of the tenancy and the cost will be deducted from the tenant s bond. The tenant agrees to have the carpets / soft-furnishings / curtains professionally cleaned and internal pest control done upon vacating and to deliver to the agent the original of the receipt when the keys are returned.
