5 EC2006-4 EXECUTIVE COUNCIL ACT ATTORNEY GENERAL AUTHORITY TO ENTER INTO AN AGREEMENT (PROJECT FUNDING AGREEMENT VICTIMS FUND) WITH THE GOVERNMENT OF CANADA Pursuant to clause 10(a) of the Executive Council Act R.S.P.E.I. 1988, Cap. E-12 Council authorized the Attorney General to enter into an agreement with the Government of Canada, as represented by the Minister of Justice, to set out the terms of renewed project funding under the Victims Fund to enhance victim services in Prince Edward Island for the period 1 November 2005 to 31 March 2010, such as more particularly described in the draft agreement. EC2006-5 AUTHORITY TO CANCEL A DEBT (SLEMON PARK CORPORATION) Having under consideration the recommendation of the Treasury Board (reference TB#387/05 of 21 December 2005), and pursuant to subsection 26(1) of the Financial Administration Act, R.S.P.E.I. 1988, Cap. F-9, Council authorized the cancellation of a debt of the Slemon Park Corporation to the Provincial Treasurer in the amount of $29,345.51. EC2006-6 AND LONG-TERM CARE SUBSIDIZATION ACT ESTATE OF PETER KOZAK CANCELLATION OF DEBT Pursuant to subsection 26(1) of the Financial Administration Act R.S.P.E.I. 1988, Cap. F-9, and as recommended by the Minister of Health pursuant to clause 11(4)(c) of the Long-Term Care Subsidization Act, R.S.P.E.I. 1988, Cap. 6 EC2006-7 AND LONG-TERM CARE SUBSIDIZATION ACT ESTATE OF GAVIN WOODS CANCELLATION OF DEBT Pursuant to subsection 26(1) of the Financial Administration Act R.S.P.E.I. 1988, Cap. F-9, and as recommended by the Minister of Health pursuant to clause 11(4)(c) of the Long-Term Care Subsidization Act, R.S.P.E.I. 1988, Cap. L-16.1, Council authorized cancellation of debt in the amount of thirty-one thousand, four hundred and eight dollars and thirty-seven cents ($31,408.37) owed by the Estate of Gavin Woods as follows: Outstanding Account for Cost of Subsidized Care Partial Payment Approved Balance Cancelled $37,408.37 $6,000.00 $31,408.37 EC2006-8 TRANSFER ORDER Pursuant to subsection 37.1(1) of the Financial Administration Act R.S.P.E.I. 1988, Cap. F-9, Council approved the transfer of $846,300.00 from the Corporate Policy Division of Executive Council as follows: To Amount Department of Agriculture, Fisheries and Aquaculture $ 122,600.00 Department of Education 271,200.00 Tourism PEI 146,500.00 Department of the Provincial Treasury 306,000.00 Council noted that this transfer returns monies transferred from the various departments to Corporate Policy Division, Executive Council in the Estimates of Expenditure for the fiscal year ending 31 March 2006. For budget purposes, this transfer of funds is deemed to have come into force effective 1 April 2005. EC2006-9 ADVISORY COUNCIL ON THE STATUS OF WOMEN DECLARATION TO RECOUP LOSS (FISCAL YEAR 2004/2005) Having under consideration the recommendation of the Treasury Board (reference TB#396/05 of 21 December 2005) and pursuant to section 72 of the Financial Administration Act R.S.P.E.I. 1988, Cap. F-9 Council declared that the

7 operating loss for the fiscal year ended 31 March 2005 of the Advisory Council on the Status of Women in the amount of $365.00 be recouped from the future operations of the Corporation. EC2006-10 MUSEUM AND HERITAGE FOUNDATION DECLARATION TO RECOUP LOSS (FISCAL YEAR 2004/2005) Having under consideration the recommendation of the Treasury Board (reference TB#395/05 of 21 December 2005) and pursuant to section 72 of the Financial Administration Act R.S.P.E.I. 1988, Cap. F-9 Council declared that the operating loss for the fiscal year ended 31 March 2005 of the Prince Edward Island Museum and Heritage Foundation in the amount of $67,633.00 be recouped from the future operations of the Corporation. EC2006-11 RICHARD FITZGERALD Pursuant to section 4 of the Prince Edward Island Lands Protection Act R.S.P.E.I. 1988, Cap. L-5 Council granted permission to Richard Fitzgerald of Cork, Ireland to acquire a land holding of approximately eleven decimal four four (11.44) acres of land at Summerside, Prince County, Province of Prince Edward Island, being acquired from the Summerside Regional Development Corporation Ltd. of Summerside, Prince Edward Island. EC2006-12 BARRY GERUS Pursuant to section 4 of the Prince Edward Island Lands Protection Act R.S.P.E.I. 1988, Cap. L-5 Council granted permission to Barry Gerus of Cumberland, Ontario to acquire a land holding of approximately twenty (20) acres of land in Lot 10, Prince County, Province of Prince Edward Island, being acquired from Gloria A. Hooper of Fort Myers, Florida. Further, Council noted that the said land holding, being Provincial Property No. 022921, was previously identified for non-development use in accordance with section 2 of the Land Identification Regulations (EC606/95) made under the said Act. Identification continues to apply.

8 EC2006-13 DUFFY CONSTRUCTION LTD. Pursuant to section 5 and section 9 of the Prince Edward Island Lands Protection Act R.S.P.E.I. 1988, Cap. L-5 Council granted permission to Duffy Construction Ltd. of Kinkora, Prince Edward Island to acquire a land holding of approximately sixty (60) acres of land in Lot 27, Prince County, Province of Prince Edward Island, being acquired from Regis Duffy and Joan M. Duffy, both of Charlottetown, Prince Edward Island PROVIDED THAT the part of the parcel that is not located within the Community of Kinkora is identified for non-development use pursuant to the Land Identification Regulations (EC606/95) made under the said Act. EC2006-14 FURNESS FARMS INC. Pursuant to section 5 and section 9 of the Prince Edward Island Lands Protection Act R.S.P.E.I. 1988, Cap. L-5 Council granted permission to Furness Farms Inc. of Vernon Bridge, Prince Edward Island to acquire a land holding of approximately two hundred and eleven decimal eight five (211.85) acres of land in Lot 50, Queens County, Province of Prince Edward Island, being acquired from Gordon Furness and Sharon Furness, both of Vernon Bridge, Prince Edward Island PROVIDED THAT the said real property is identified for non-development use pursuant to the Land Identification Regulations (EC606/95) made under the said Act. EC2006-15 NEXGEN INC. Pursuant to section 5 of the Prince Edward Island Lands Protection Act R.S.P.E.I. 1988, Cap. L-5 Council granted permission to Nexgen Inc. of Charlottetown, Prince Edward Island to acquire an interest in a land holding of approximately ninety-two decimal five six (92.56) acres of land at Charlottetown, Queens County, Province of Prince Edward Island, being acquired from Roy Birt of Brackley, Prince Edward Island and Lori Birt and Steven Birt, both of Charlottetown, Prince Edward Island.

9 EC2006-16 PROPERTY NO. 174615, LOT 49, QUEENS COUNTY IDENTIFICATION FOR NON-DEVELOPMENT USE AMENDMENT Pursuant to subsection 9(2) of the Prince Edward Island Lands Protection Act R.S.P.E.I. 1988, Cap. L-5, Council amended the condition of non-development use made pursuant to section 2 of the Land Identification Regulations (EC606/95) in respect of approximately one hundred (100) acres of land, being Provincial Property No. 174615 located in Lot 49, Queens County, Prince Edward Island and currently owned by Hans Kouwenberg, Kees Kouwenberg and Theo Kouwenberg, all of Millview, Prince Edward Island. Council noted that this amendment will enable subdivision of a parcel of land of approximately four decimal seven (4.7) acres, and determined that following subdivision, identification for non-development use shall continue to apply to the new parcel as well as to the remaining land. This Order-in-Council comes into force on 10 January 2006. EC2006-17 PROPERTY NO. 446633, LOT 5, PRINCE COUNTY IDENTIFICATION FOR NON-DEVELOPMENT USE AMENDMENT Pursuant to subsection 9(2) of the Prince Edward Island Lands Protection Act R.S.P.E.I. 1988, Cap. L-5, Council amended the condition of non-development use made pursuant to section 2 of the Land Identification Regulations (EC606/95) in respect of approximately seventy-nine decimal five six (79.56) acres of land, being Provincial Property No. 446633 located in Lot 5, Prince County, Prince Edward Island and currently owned by Wallace Family Farm Limited of Cascumpec, Prince Edward Island. Council noted that this amendment will enable subdivision of a parcel of land of approximately six decimal eight (6.8) acres, and determined that following subdivision, identification for non-development use shall continue to apply to the new parcel as well as to the remaining land. This Order-in-Council comes into force on 10 January 2006.

10 EC2006-18 PUBLIC DEPARTMENTS ACT ACTING MINISTER APPOINTMENT Under authority of subsection 4(2) of the Public Departments Act, R.S.P.E.I. 1988, Cap. P 29 the following appointment was made: Honourable Jamie Ballem to be Acting Minister of Health and Acting Minister of Social Services and Seniors commencing on the 15th day of January 2006, and continuing for the duration of the absence from the Province of Honourable Chester Gillan.
