SITE FEATURES LAD: Based on aerial photograph interpretation, the property has complete forest cover besides the development of the BC Rail line and 265 RD that dissects the subject property. COMMETS AD OBSERVATIOS APPLICAT: ALR: OCP: ZOIG: IMPACT AALYSIS It is the intent of the landowners to subdivide the parcel into two sections that is separated by the railroad. Would like the property to be passed down to their sons when the time comes. The area is close to the Elementary School and would be great for raising a family in a rural setting. The subject property lies within the Agricultural Land Reserve. Therefore, Agricultural Land Commission approval is required. ote: Pursuant to the Agricultural Land Commission Act, an application may not be considered by the ALC unless the Regional Board authorizes the proposal to proceed to the ALC. This is intended to provide local governments with latitude to consider and weigh the local community interests of each application, in addition to its zoning and official community plan. Should the Regional District forward the application to the ALC, the information and recommendation offered by the Regional District is taken into consideration by the Commission but should not be construed as being binding on the Commission s opinions or decisions. The subject property is designated Ag-Rural within the Peace River Regional District Rural OCP Bylaw o. 1940, 2011. This designation has minimum parcel size of 63ha (155 acres), however Section 7.0 Policy 3(b) states the minimum parcels size does not apply if the proposed new parcel is separated from the remainder by a railway, road right of way, or significant topographical constraint. The BC rail line would be considered a topographical constraint. Therefore an amendment to the OCP is not required. The subject property is designated as A-2 (Large Agricultural Holdings Zone) within the Dawson Creek Rural Area Zoning Bylaw o. 479, 1986. This zone has a minimum parcel size of 63 ha (155 ac), however Part 6.11((viii(c)) states for those portions of a parcel which are situated on either side of a railway right-of-way, road right of way or a watercourse there is no minimum parcel subject to the Local Services Act only so far as to permit subdivision along the railway right of way, road right-of way or watercourse Therefore a zoning amendment is not required AGRICULTURE: The proposal would have minimal impact on the agricultural use of the land, as the land has high fluctuations in soil moisture. The railroad separates the land creating difficulty with harvesting or use for any large scale agricultural use. COTEXT: This area consists of mostly large agricultural quarter sections, however directly south of the subject property there is the McLeod Elementary School, the McLeod Recreational Centre and one small residential lot. POPULATIO & TRAFFIC: The proposed subdivision may increase the population of the area by 5.4 people (based on Stats Can 2011 census estimate) per dwelling and about 4 vehicles per dwelling.
