Enclosed is an Application for Approval form. The Amended and Restated Declaration of Restrictions of Villa Monterey Unit II states that all transfers of property within the subdivision must be approved by the Board of Directors. The restrictions further state that the Boards has 21 days after receipt of the Application within which to either approve or disapprove the transfer. We therefore ask that you complete the Application for Approval form and submit it to the Board as soon as possible. Please know that your signature(s) on the application must be notarized and proof of age of all prospective occupants of the home is required. In 2004, Section 33-1806(A)(3)(h) of the Arizona Revised Statutes was added and requires all purchasers of property in a planned community to sign a statement which states that the purchaser(s) acknowledges that the Declaration of Restrictions, Bylaws and Rules of the Association constitute a contract between themselves and the Association and that by signing the statement, the purchaser acknowledges that he/she/they has read and understands the Association s contract and that by accepting the contract, the purchaser may be giving up his/her/their rights to the homestead exemption protection regarding a lien of the Association for any unpaid assessments and late fees. A form for this purpose is enclosed and must be signed before a Notary Public and returned to the Association within fourteen (14) calendar days after the form is submitted to you by the Association. HISTORY Villa Monterey Unit II is a planned community subdivided and built in the early 1960 s containing 136 homes and 7 parcels of common property areas. The first Declaration of Restrictions controlling the use of the land was recorded in January, 1962. These restrictions are binding upon all owners or renters of property within the subdivision.
, a non-profit recreational corporation, was formed in May, 1962 for the purpose of ownership and control of the common areas and to take any action necessary to enforce the covenants, reservations and restrictions. The Board of Directors of consists of 7 members who must all be members of the corporation and are charged with the duties of management of the corporation.
