VILLE DE MONTRÉAL BY-LAW 09-049 BY-LAW CONCERNING THE ASSISTANCE PROGRAM FOR HOUSEHOLDS AWAITING RELOCATION AT PLACE DE L ACADIE In view of section 91 of the Municipal Powers Act (R.S.Q., chapter C-47.1); At the city council meeting of September 21, 2009, it was enacted: SECTION I INTERPRETATION 1. In this by-law, the following words mean: director ; the director of the Direction de l habitation du Service de la mise en valeur du territoire et du patrimoine; household : one or more persons occupying a dwelling unit; low-rent dwelling : a dwelling in low-rental housing, as defined in the Civil Code; Place de l Acadie : the 2 territories marked Volet social on the plan of schedule A; Place de l Acadie or Place Henri-Bourassa : the immovables bearing numbers 2000, 2010, 2030, 2050, 2060, 2110, place Henri-Bourassa, and 10550, 10560, 10570, 10610, 10620, 10630, 10640, place de l Acadie, and 10660 and 10670, boulevard de l Acadie; sponsoring organization : the sponsoring organizations of community dwellings under construction at Place de l Acadie: Ressources-Habitations de l Ouest, corporation having its business establishment at 18822, avenue du Bois-de-Boulogne, in Montréal, and Maison CACI, corporation having its business establishment at 2190, rue De Salaberry, in Montréal. SECTION II GENERAL PROVISIONS 2. Financial assistance is provided to households under the following conditions: (1) the household occupied a dwelling unit at Place de l Acadie or Place Henri- Bourassa on April 15, 2008; 09-049/1
(2) the relocation of the household was attested by the Office municipal d habitation de Montréal or by the Direction de l habitation du Service de la mise en valeur du territoire et du patrimoine; (3) the household is registered with a sponsoring organization and carries out all the steps required by the organization to conclude the lease of a community dwelling unit to be built at Place de l Acadie; (4) the household resides on the territory of the Communauté métropolitaine de Montréal on the date of filing of an application for financial assistance under this by-law. 3. No assistance is granted to a household: (1) occupying a low-rent dwelling unit; (2) receiving a rent supplement administered by the Office municipal d habitation de Montréal. SECTION III APPLICATIONS FOR FINANCIAL ASSISTANCE 4. Applications for financial assistance under this by-law must be submitted on the form provided for that purpose by the Direction de l habitation du Service de la mise en valeur du territoire et du patrimoine. The form must be submitted with the necessary documents that the director may require for the application of this by-law. SECTION IV FINANCIAL ASSISTANCE SUBSECTION 1 AMOUNT OF MONTHLY FINANCIAL ASSISTANCE 5. The amount of monthly financial assistance granted to a household is equal to the actual monthly rent paid by a household under the dwelling unit lease in effect on September 28, 2009, from which is deducted the amount of actual monthly rent under the dwelling unit lease at Place de l Acadie or Place Henri-Bourassa. The amount of the actual monthly rent taken into account in the calculation referred to in the first paragraph may not be greater than the rent threshold eligible for the 2009 emergency rent supplement program of the Société d habitation du Québec in schedule B. Despite the first paragraph, the monthly financial assistance may not exceed $150 for a household made up of one person, to which an amount of $50 is added per additional person for a household made up of more than one person. 09-049/2
No assistance is granted to a household when the amount of monthly financial assistance, calculated in accordance with the first paragraph, is less than $50. 6. The monthly financial assistance, calculated in accordance with article 5, is granted as of October 2009. It continues until the month following the one during which the household is informed, by the director, that a community dwelling at Place de l Acadie is available, provided the conditions under the third paragraph of article 2 are met, and that the household continues to reside on the territory of the Communauté métropolitaine de Montréal. SUBSECTION 2 TERMS OF PAYMENT 7. The monthly financial assistance is paid every month to the signer of the dwelling unit lease of the household in effect on September 28, 2009 or, if the signer no longer resides there, to the main household maintainer who is entitled to maintain occupancy of the dwelling under article 1938 of the Civil Code. SECTION V DURATION OF PROGRAM 8. The assistance program for households awaiting relocation under this by-law ends after the last monthly assistance payments, in accordance with article 6, or when the funds earmarked for the program are exhausted. SECTION VI ORDINANCES 9. The executive committee may, by ordinance: (1) extend the deadline under article 6; (2) set the maximum amount of actual rent, as well as the maximum and minimal amounts of monthly assistance; (3) amend the terms of the duration of the assistance program for households awaiting relocation at Place de l Acadie. --------------------------------- SCHEDULE A TERRITORY OF PLACE DE L ACADIE, MARKED VOLET SOCIAL ON THE PLAN PREPARED BY THE SERVICE DE LA MISE EN VALEUR DU TERRITOIRE ET DU PATRIMOINE, DIRECTION DE L HABITATION 09-049/3
