THE CORPORATION OF THE TOWNSHIP OF GEORGIAN BAY COMMITTEE OF ADJUSTMENT Minutes of the meeting of March 1, 2004 held in the Council Chambers, Baxter Ward Community Centre, Township of Georgian Bay, Port Severn, Ontario. The Chair called the meeting to order at 10:05a.m. 2. Minutes of the meeting of January 12th, 2003 were circulated for errors and omissions. No Errors or omissions were noted. Moved by H. Jackson Seconded by L. Braid That the Committee of Adjustment of the Township of Georgian Bay accepts the minutes of the previous meeting dated January 12, 2004 as circulated. 3. A-5/04 Herrmann Eric Herrmann To permit a front yard setback of 10.7 metres (35 feet) for an addition to the main dwelling unit, whereas Zoning By-law 91-19 establishes a front yard setback of 20 metres (65.6 feet). Applicant explained that the lot is well treed and the addition will be going in a clear area. Committee wanted to know what the current setback of the dwelling is and the use of the addition. Applicant stated that the addition was going to be used to expand a bedroom. Planner stated that the dwelling is currently 45 feet away from the shoreline. Committee requested that the applicant enter into a Site Plan Agreement. Applicant agreed on entering into a Site Plan Agreement. Moved by L. Braid Seconded by L. Keall That the Committee of Adjustment approves application A-5/04 to permit the construction of an addition to the main dwelling unit with a front yard setback of 10.7 metres (35 feet), and that approval of this variance is granted and fixed to the subject site plan, extent, location, scale and use contemplated in the application, for Eric Herrmann at 6576 Go Home Shore.
4. A-7/04 Hine That a building permit be obtained. v) That the applicant enters into a Site Plan Agreement to maintain tree cover and natural vegetation between the addition and the shoreline. Rick Hine To permit an increase in the lot coverage to 9% whereas Zoning By-law 91-19 establishes a maximum lot coverage of 7%. The Secretary Treasurer explained the nature and effect of the application and read the planning report. Committee member stated that he knows the property well and that the variance would have no impact at all on the neighbours or the shoreline. Seconded by L. Braid That the Committee of Adjustment approves application A-7/04 to allow for an increase in lot coverage to 9%, and that approval of this variance is granted and fixed to the subject site plan, extent, location, scale and use contemplated in the application, for Marie Hine at 2612 Island 1040 Georgian Bay. 5. A-8/04 Lotimer That a building permit be obtained. Jane Lotimer To permit a front yard setback of 12.8 metres (42 feet) for a single family dwelling whereas Zoning By-law 91-19 establishes a front yard setback of 20 metres (65.6 feet). Member Bowden declares conflict of interest and removes himself from the hearing.
Applicant states that she has spoken to the neighbours on the north by phone and they are in favour of the variance. She also explained that the topography is steep and the proposed envelope would be less obtrusive. Committee wanted to know what was the proposed foot print size and lot coverage? Planner stated that the proposed dwelling would be approximately 2000 square feet, which works out to be approximately 2% lot coverage. Committee wanted to know if there was a possibility of severing the property? Planner stated that it would not be possible to sever the property. That the Committee of Adjustment approves application A-8/04 to permit a front yard setback of 12.8 metres (42 feet) for single family dwelling, and that approval of this variance is granted and fixed to the subject site plan, extent, location, scale and use contemplated in the application, for Jane Lotimer at 9838 Island 1810 Georgian Bay. 6. A-9/04 Brydson That a building permit be obtained. Armin Grigaitis (Agent) To permit a boat dock to have a maximum length of 28.7 metres (94 feet), whereas Zoning By-law 91-19 establishes a maximum dock length of 15 metres (50 feet). Agent explained that there is an error in the drawing he submitted and that dock would be about 400 feet away from the neighbour s property line, and that it would have no visual impairment for the neighbour, and that the use is for a floatplane. Committee wanted to know what is the length of the current dock? Agent stated that the current dock is 40 feet in length. Committee wanted to know what the length of the finger docks would be? Agent explained that the dock would be 65 feet in length laterally. That the Committee of Adjustment approves application A-9/04, to permit a boat dock to have a maximum length of 28.7 metres (94 feet), that the dock be no closer than 61 metres (200 feet) to the interior lot lines, and the lateral distance of the dock not to exceed 65 feet, and that approval of this variance is granted and fixed to the subject site plan, extent, location, scale and use contemplated in the application for Sherry Brydson at 1215 Island 1450 Georgian Bay.
7. A-10/04 Mostowy That a building permit be obtained Richard and Yvonne Mostowy To permit a front yard setback of 6.7 metres (22 feet) whereas Zoning By-law 91-19 establishes a front yard setback of 20 metres (65.6 feet). Applicant explained that the addition would be to one side of the main dwelling, which would move it away from the septic, and it flows better with the house on that side. Committee wanted to know what is the current setback and how much closer they will be encroaching. Planner explained that the current dwelling is situated 26 feet away from the shoreline and the addition will be 22 feet away from the shoreline. Committee wanted to know what the character of the area is. Planner explained that most of the cottages are further back then the Mostowy s. Committee request s that applicant enter into a Site Plan Agreement. That the Committee of Adjustment approves application A-10/04,to permit a front yard setback of 6.7 metres (22 feet) for an addition to the main dwelling, and that approval of this variance is granted and fixed to the subject site plan, extent, location, scale and use contemplated in the application for Richard and Yvonne Mostowy at 275 Pratt s Road. That a building permit be obtained v) That the applicant enters into a Site Plan Agreement with the purpose to maintain all natural vegetation in front of the existing and proposed dwelling unit. 8.
