WITNESSETH that for and in consideration of the sum of One Dollar and other valuable considerations, the receipt and sufficiency of which are hereby acknowledged, the grantor hereby gives, grants, bargains, and releases to the grantee a temporary easement for the purpose of removing existing mast arm signal devices. foundations. and appurtenances. and for tying in and harmonizing said property thereon with the construction to be undertaken by the Department in State Road A-1-A right of way adjacent thereto, in, upon, over and through grantor's undivided 1/6fh interest in the following described land in Broward County, Florida, described as follows viz: See attached Exhibit "A" sketch and legal description ("Easement Area") THIS EASEMENT is granted upon the condition that any work performed upon the above described land shall conform to all existing structural improvements within the limits designated, and all work will be performed in such a manner that the existing structural improvements will not be damaged. Grantee shall be responsible for any damage to existing structural improvements within the Easement Area caused by grantee, its agents, its employees, its subcontractors, and anyone exercising rights granted by the grantee. Grantee shall ensure that all improvements which it constructs or installs in the Easement Area, if any, are kept in a good, clean, and safe condition at all times and grantee shall promptly make all necessary or desirable repairs, maintenance, and replacements thereto.
Page 2 of 6 Nothing herein is intended to serve as a waiver of sovereign immunity by any party nor shall anything included herein be construed as consent to be sued by third parties in any matter arising out of this Easement or any other contract. Both parties are state agencies or political subdivisions as defined in Chapter 768.28, Florida Statutes, and agree to be fully responsible for the acts and omissions of its respective agents or employees to the extent permitted by law. It is understood and agreed by the parties hereto that the rights granted herein shall terminate upon completion of this transportation project, but no later than the last day of October 2016.
