Eviction for non-compliance to the attached Rules & Regulations will be applied to the Tenant, pursuant of Florida Statutes. 3. No sub-leasing is allowed. Room rentals are not allowed. All unmarried, non-family members sharing a residence must apply. Guests occupying a unit for 30 days or more must complete and submit an application with fee for approval. 4. No exterior addition or modification/alteration to any residence shall be made upon any Lot including landscaping until the plans and specification showing the nature, kind, shape, height, materials and location have been submitted and approved in writing.

Pursuant to the Town Oaks Home Owners Association, Inc. Declaration of Covenants, Conditions, and Restrictions: The Town Oaks Board of Directors, as set forth in Article VIII Section 1, hereby makes resolution to continue to collect the capital contribution from each lot that is sold from this day forward. This is equal to one month of the Association's current annual assessment. INTRODUCTION AND GENERAL INFORMATION These Rules and Regulations supersede, revise and amend in full any prior rules, regulations, policies and interpretations (recorded or unrecorded) of the Board of Directors with regard to the Documents as further described below. As authorized by Article XVI of the By-Laws of the TOWN OAKS HOMEOWNERS ASSOCIATION, INC. ("HOA") the Board of Directors ("Board") hereby establishes and publishes these Rules and Regulations in Town Oaks. The Rules and Regulations shall consist of the published restrictions in the Town Oaks Declaration of Covenants, Conditions and Restrictions, the Articles of Incorporation of the HOA, and the By-Laws of the HOA (collectively, the "Documents") as well as the items listed below. This document will be deemed to have precedence over those items under the Architectural and Landscape Committee control specified in the By-Laws. As provided in the Documents, the Rules and Regulations shall be enforced by the Board of Directors and/or the Architectural and Landscape Committee ("ALC"). In the event an owner or resident of a unit wishes to make any changes to the outer appearance of their unit that are not specifically permitted by the Documents, written application for approval MUST be made to the ALC. Unless the ALC approves such application in writing, the contemplated change shall not be approved. Any changes to an individual unit shall not be approved unless in conformity with the Architectural design of Town Oaks. It is the responsibility of each owner to read the Documents and be informed as to the use restrictions and rules that apply to all homeowners and property in Town Oaks. - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - -

2. ROOFS Roofs shall be kept clean and free from mold and mildew. Any missing or damaged shingles or shakes will be repaired or replaced by the Homeowner in a timely manner. Replacement shingles and shakes shall be of the color and composition of the original roofing materials. Replacement shakes used on the Aspen units must be of the same grade as were originally installed. 3. GARAGE DOORS Garage doors will be kept free of mold and mildew and will be maintained in good working order and are to be painted the same color brown as the wood trim of the unit. Damaged door panels must be replaced. 4. DRIVEWAYS All driveway additions, alterations and replacements must be approved by the ALC and the City of Palm Beach Gardens (when required by the Building Department). The driveway will be constructed of concrete and when a surface treatment is used, it must be approved by the ALC. Driveways must be kept clean and free from oil stains and discoloration. 5. WINDOWS - SCREENS - STORM SHUTTERS Windows and screens will be kept in good working order. Screens are to be charcoal in color and window frames are to be black metal. No awnings are allowed in the development. Hurricane shutters may be of the temporary or permanent type. Permanent shutters (including fittings and hardware) will be black or dark brown in color. When not being used for storm protection, the permanent type shutters shall remain in the open position and the temporary type shutters will be taken down and stored. 6. ENTRYWAY The color of the front door and wood trim around the entryway shall match the color of the trim on the exterior of the unit. Any custom screening or enclosures to the entryway must be approved by the ALC. 7. DECORATIONS Decorative flags are allowed but may be flown only during the occasion. Only the American flag may be flown permanently. All flags must be in good condition and may not be offensive to others. The determination of the suitability of all flags is a responsibility of the ALC. If any flag is judged as offensive, it will be removed immediately. Flagpoles are not allowed in the community. 8. MAILBOXES/UNIT NUMBERS/SPORTS EQUIPMENT/PETS Mailboxes must be kept in good condition and have the unit number on both sides. They must be painted the same color as the appropriate trim color of the unit. The construction size, shape and appearance must conform to the mailbox design established for the Community. Unit Numbers shall be installed on the mailbox and on the wood trim over the garage door. Sports Equipment shall not be left in the yard or driveway when not in use. Pets must be leashed when off of the owner's property. Pet owners are required to pick up all of their pet's droppings. 9. LIGHTING Outside lighting must not shine into other units or produce objectionable color or glare. Floodlights and/or spotlights shall not be aimed at other units or the public areas of the development. Bare bulbs are not allowed. The front door exterior light must be in good condition. Motion sensing lights and yard lights are acceptable in the community. All control panels and transformers must not be visible from the street. 10. EXTERIOR No changes from the original appearance of the units are allowed. The appearance of each unit must be kept as close to the original as possible. Fascias, soffits, wood trim, plaster, doors, etc. shall be maintained in like-new condition. Plaster walls shall be periodically cleaned in order to remove mildew and stain. Paint colors are standardized and the mixing formulas are available on request from the Management Company or the ALC. 11. FENCES Fences must be of the shadow box style and 6 feet in height. All wood must be kept in good repair and replaced when it is rotted or broken. The color is to be the natural wood color. A sealer may be applied, but no stains. Gates must be kept in good working order 12. RENTAL OF UNITS For the safety and enjoyment of all residents of TOWN OAKS, when any owner is considering the leasing of a unit, the prospective tenant must fill out an application and pay a non-refundable application fee of $50.00 which shall be delivered to the Board. The Board will approve or deny the application and notify the homeowner of its decision. The Homeowner shall be responsible and liable for actions by the tenant. The Homeowner must insure that their tenant follows all of the Rules of TOWN OAKS. If any tenants cause problems for others, then both the tenant and the Homeowner will be liable.

13. LANDSCAPING The Association maintains the front, side and rear lawns through an Association contracted lawn Maintenance Company. This company mows, edges, fertilizes, sprays, etc. on a regular schedule. It is the homeowner's responsibility to maintain the irrigation of the lawn and landscaping such that it has a good appearance. If the lawn or areas of the lawn die, the owner must replace the sod with St. Augustine type of sod only (or such type sod as may be specified by the ALC). Each owner must follow the Palm Beach County no nuisance plants ordinance. Oak trees may not be removed without prior approval of the ALC. Window boxes are not allowed. Lawn furniture is to be kept clean and in good appearance. Any changes (either additions or deletions) to the existing landscaping plan/layout must be submitted to the ALC for approval prior to implementation. This rule covers only front yards. Landscaping refers to shrubs and trees; flowers are excluded. 14. VEHICLES AND PARKING Within Town Oaks, no trailers or habitable motor vehicles of any nature, motorcycles, mopeds, boats, jet skis, skidoos and the like, golf carts, inoperable vehicles, vehicles without current tags, vehicles which are an eyesore, vans and trucks (other than those of a type, if any, expressly permitted by the Board of Directors), pick-up trucks, service vehicles, vehicles having printing or advertising on exterior surfaces (other than auto dealer's license frames) or visible from the exterior, commercial or construction vehicles or equipment may be kept, stored or parked overnight except within a closed garage. Parking on the grass anywhere within the community is not allowed by any vehicle. Permitted Trucks: The Board will permit trucks that are sports utility vehicles, not including any that may have the appearance of a sport utility vehicle but have a flat bed or an enclosed flat bed of any kind. Permitted Vans: For the purpose of this rule, a vehicle is not deemed to be a van if it meets all of the following criteria: has permanent enclosed seating for at least five (5) persons, windows on both sides to the rear of the driver and right front passenger seat, and does not exceed the manufacturers standard length, height and width of a custom conversion van. "Overnight": For the purpose of the Documents, the term "overnight" shall mean the parking of any vehicle at any time between the hours of 12 midnight and 6:00 am of the same day. ALL OWNERS AND OTHER OCCUPANTS OF UNITS ARE ADVISED TO CONSULT WITH THE ASSOCIATION PRIOR TO PURCHASING, OR BRINGING ONTO THE PROPERTY, ANY TYPE OF VEHICLE OTHER THAN A PASSENGER CAR, INASMUCH AS SUCH OTHER TYPE OF VEHICLE MAY NOT BE PERMITTED TO BE KEPT WITHIN THE COMMUNITY. The use of a vehicle cover does not cure a violation as to any vehicle parked in violation of these rules. 15. PURPOSE AND SPIRIT OF THE RULES AND REGULATIONSN ARIANCES It is the intention of these Rules and Regulations to be reasonable and complement the peaceful enjoyment of the homes of the individual owners of Town Oaks. However, it is important to maintain the community in such a condition and appearance as to support the value of and the pride in owners of the homes in Town Oaks. As such, it is an important responsibility that INDIVIDUAL HOMEOWNERS, the Board Officers, Directors and ALC Committee Members must bear in helping to assure that these rights are maintained. In this spirit, there may be exceptions to the Rules and Regulations set forth in this document that will require individual judgment(s) to be made by the Board of Directors in order to assure the peaceful enjoyment and beauty of the community for the majority of the homeowners within the community. Every situation and issue cannot be addressed in the body of this document. When it is not addressed or is not clear, it will be the responsibility and authority of the Board to render a judgment within the spirit of these documents and the other recorded homeowners association documents. 16. DOCUMENT RESTRICTIONS/NON-WAIVER All covenants, conditions, restrictions, and other provisions contained in the Documents shall remain in full force and effect, notwithstanding that they are not included herein. A failure of the Board to enforce any particular rule should not be interpreted as a decision to not enforce that rule, or any other rule in the future. 17.
