2 DISTRICT OF ELKFORD BYLAW NO. XX WHEREAS the Local Government Act provides that a local government may by Bylaw regulate the number, size, type, form, appearance and location of Signs within the District of Elkford; NOW THEREFORE, the Council of the District of Elkford, in open meeting assembled, enacts as follows: 1. Title This Bylaw may be cited as the No., 2011. 2. Definitions In this Bylaw: Abandoned Sign Advertise Animated Sign Awning Awning Sign Balcony Sign Balloon Sign Banner Sign means any Sign which no longer correctly advertises or identifies a business, Owner, lessee, product, service, or activity associated with a parcel, premises, or building on which the Sign is situated. means identify or promote by any method a business, service, activity, or goods or services for sale or otherwise obtainable. means any Sign which includes action, motion or colour changes on all, or any part of, the Sign. means flexible material supported entirely from the exterior wall of a building by a fixed or retractable frame. means a Sign painted on or affixed directly to the surface of an Awning, which does not extend vertically or horizontally beyond the limits of the Awning. means a Sign mounted on, or supported on, a balcony or balcony railing. means a Sign on an inflated structure or device that is attached to the ground, a building or another structure. means a Sign which is composed of lightweight and flexible material, including nylon, vinyl, cloth, canvas or

3 similar fabric, and which is attached to a building or other support structure, but does not include an Awning affixed to a building, a free-flying flag or a decorative banner which contains no words or Logos. Community Notice Board Sign means a permanent Sign used to display Posters relating to educational material and community events or notices. Copy Copy Area means the letters, characters, numbers or graphics which make up the message on a Sign. means the entire area of a Sign on which Copy could be placed.

4 Directional Sign Fascia Sign Flashing Sign Freestanding Sign Home Occupation Sign Identification Sign Illuminated Sign Inflatable Sign Logo Owner means any Sign which only communicates information regarding pedestrian or vehicular movement on the parcel or within the premises, or building on which the Sign is located. means a Sign which is in any manner affixed and parallel to, or painted on, the wall of a building. means a Sign which contains an intermittent or flashing light source or which creates the illusion of intermittent or flashing light by means of animation or an externally mounted light source, but does not include a Changeable Copy Sign. means a Sign, except a Billboard Sign, permanently fixed to the ground and supported independently of and physically separated from a building or other structure located on the same parcel as the Sign. means a non-illuminated Fascia Sign identifying the name or occupation of the occupant of a building carrying on an accessory home occupation use in accordance with the provisions of the Zoning Bylaw, and not containing any other advertising. means a Sign the Copy of which is limited to the name, Logo, address, or number of a building. means a Sign in which a source of artificial light illuminates the message Copy, and where Permitted by this bylaw means an externally lighted Sign designed and installed so that such light is shielded to direct light downwards and away from adjacent residential uses. means an inflated three-dimensional device which incorporates a Sign or serves to attract attention for advertising purposes and is anchored or affixed to a building, structure or parcel. means a symbolic representation not including any words, names or numbers unless part of a registered trademark, which is used to simplify advertising of a product, business, service, or activity, and which contains no additional identification, information or message. means any person in control of the parcel, premises, or building on which a Sign is located.

5 Parapet Permit Political Sign Portable Sign means any wall or railing constructed at the perimeter of a flat Roof. means an authorization in writing issued by the District pursuant to this Bylaw. means a Sign indicating that an election or referendum is to be, or is being, carried out, displaying only names and messages relating to the election or referendum. means a Sign which is self-supporting, easily moved, and not permanently attached to the ground, a building, a structure or a vehicle. Poster means any bill or notice containing direction, information, identification or advertisement intended to be temporary and which is affixed to public property or a community event Sign, but does not include material related to a court order or court process. Premises Frontage Prohibitory Sign Provincial Electrical Permit Real Estate Sign Revolving Sign Roof Roof Line means the length of a building wall, or portion of a building wall enclosing business premises, regardless of the number of storeys, which abuts or faces a highway or parking lot. means a Sign erected by a federal, provincial, or municipal government that prohibits specified uses or activities. means an authorisation by the Province of British Columbia to carry out electrical work. means any Sign indicating that the parcel, premises, or building on which the Sign is located is for sale, rent or lease. means any Sign or portion of a Sign which revolves or partly revolves. means the top enclosure of any building, and includes any extension or overhang of such enclosure beyond an exterior wall. means the top of the exterior wall of a building with a flat or gable Roof, the top of any Parapet wall above the exterior wall of a building, and the deck line of the Roof of a building with a mansard Roof.

6 Roof Sign Sandwich Board Sign Search Light Sign Sign Sign Area Sign Face Special Event means a Sign erected upon or above a Roof or Parapet of a building, or a Sign affixed to a building and extending above the Roof Line of the building. means any one or two -faced non-illuminated Sign which is not affixed to the ground, typically hinged at one end, and directs attention to a business, commodity, service or entertainment offered on the parcel or within the premises or building on or adjacent to which the Sign is located. means one or more permanently installed or portable devices housing a light source or reflectors for producing and projecting light beams and includes the projected light, aerial lights, beacon lights, laser lights, strobe lights, spotlights and beams, and other similar devices or special effects used to attract attention to a site by projecting or reflecting light. means any visual representation, notice or medium, including its structure and other components, which is visible from any highway or adjacent property and that is intended to identify, describe, illustrate, communicate information, attract attention to or otherwise Advertise a product, place, activity, business, service, or institution, but does not include either a free-flying flag or a decorative banner which contains no words or Logos. means the entire area within the outer edge of the frame or border of the material of a Sign on which Copy could be placed. Where a Sign has no frame, border or background, the Sign Area is the area contained within the shortest line surrounding the Copy. Where the Sign is a Freestanding Sign, the Sign Area is the total area of all Sign Faces. means the entire area of a Sign on which the Sign Copy could be placed, and for a Freestanding Sign each surface whether the front, back or side of the Sign is a Sign Face. means the opening of a place of business, a change of proprietorship, name or use of a business, or a sale or promotion for a business.

7 Streamer Sign Third Party Sign Time-Limited Sign Under-Awning Sign Under-Canopy Sign Vehicle Sign Window Sign Zoning Bylaw means a Sign made of one or more ribbons attached at one end. means a Sign which directs attention to a business, commodity, service or entertainment which is conducted, sold or offered elsewhere than on the parcel, premises, building or highway on which the Sign is located. means a Sign which is Permitted for a limited period of time announcing or advertising a Special Event. means a Sign which is suspended from and entirely beneath an Awning. means a Sign which is suspended from and entirely beneath a Canopy. means a Sign erected on, painted on or attached to a vehicle whose principal purpose is to serve as a Sign or a Sign support structure. means any Sign painted on, attached to or installed on the inside or outside of a window or glazed area of a door for the purpose of viewing from outside the premises or building, but does not include the merchandise located in the window for display purposes. means the District of Elkford Zoning Bylaw XX / Section XX of the District of Elkford Development Code XX entitled Zoning Regulations. 3. Zoning Bylaw References in this bylaw to zones are references to zones established in the Zoning Bylaw. Where the regulations contained in this Bylaw concerning Signs conflict with regulations in the Zoning Bylaw, the regulations in the Zoning Bylaw govern. 4. Building Bylaw Where the regulations contained in this Bylaw concerning Signs conflict with regulations in the Building Bylaw, the regulations in the Building Bylaw govern.

Requirement for Permit (b) Every person, Owner or occupier of a parcel, premises, or building shall, before erecting, placing, allowing, rebuilding, reconstructing, altering or moving any Sign, make application for and obtain a Permit for the Sign unless the erection, placing, building, reconstruction, alteration or moving is expressly authorized by a building Permit issued under the Building Bylaw, or by a development Permit issued under Part 26 of the Local Government Act. All Signs provided with electrical connections require a Provincial Electrical Permit which shall be produced to the District at the time of inspection of the Sign by the Building Inspector. 6. Application for a Permit An application for a Sign Permit must be submitted to the District on an application form prescribed by the District, must be accompanied by the fee prescribed in the District of Elkford Fees and Charges Bylaw No. XXXX, and must contain the following information: The name and signature of the applicant; The name, address and telephone number of the Owner of the premises or building to which the Sign pertains, and if different, the name, address and telephone number and a letter of authorisation from the Owner of the parcel on which the Sign will be erected; The name, address, telephone number, and District of Elkford Business License number of the business engaged to make or install the Sign that is the subject of the Permit application; The estimated cost of the Sign and any supporting structure; Site plan and elevation drawings which provide the following information: (1) the type of Sign to be installed; (2) the locations of the Sign to be installed in relation to finished grade, vehicle parking and traffic areas, and property lines; (3) the Sign dimensions; (4) a description of the materials, finishes, and colours of the Sign and supporting structures; (5) a description of the message Copy to be displayed, including the style, size, and colours of all the letters, Logos or other Copy of the Sign; (6) the Sign Area, and where applicable, the Sign Face area and the Copy Area; (7) cross-sectional details illustrating the attachment of the proposed Sign to the premises, building or structure; (8) in the case of a Freestanding Sign, structural details of the base; (9) methods of illumination where a Sign is to be illuminated; and

9 (10) Any other information required by the District in order to determine compliance with this bylaw. (b) The District may require that all drawings and specifications, or any part thereof, be prepared and sealed by, and the construction carried out under the supervision of, a Professional Engineer registered in British Columbia. 7. Comprehensive Sign Plan Where a number of Signs and Sign types are proposed for a building, a group of buildings, a multi-tenant building or parcel, a planned shopping centre, a single development of substantial size on a large parcel or on 2 or more adjoining lots, the Owner may submit for the approval of the District a comprehensive Sign plan with a single Sign Permit application, and the District may issue a single Permit to authorize all Signs proposed in the Sign plan. 8. Permit Issuance and Inspections (b) (c) The Building Inspector may exercise in respect of a Sign Permit, any powers provided under Section 12 of the Building Bylaw in respect of Building Permits. The District may specify, in issuing a Sign Permit, the stages of construction at which an inspection by the Building Inspector is required, if any, and the Permit holder shall notify the District to request such inspections and shall not carry out any work beyond that stage of construction until the inspection has been performed and any corrective work required by the District has been carried out. If any Sign is installed or erected in contravention of this Bylaw, the District may issue written notice to the Owner or tenant of the premises requiring the removal of the Sign within the time specified in the notice, which shall not be less than five business days except in the case of a Sign that the District considers constitutes a hazard to any person or to the public, and upon the failure of the Owner or tenant to remove the Sign within the time specified in the notice, the District may do so at the cost of the Owner or tenant, and recover the cost of doing so in accordance with s. 258 of the Community Charter. 9. Prohibited Signs (b) No person, Owner or occupier of a parcel, premises, or building, shall erect, place, allow, rebuild, reconstruct, alter or move, a Sign on the parcel, premises or building, or on any highway, unless the Sign is in accordance with this Bylaw. No person, Owner or occupier of a parcel, premises, or building shall maintain, erect, place, allow, rebuild, reconstruct, alter or move or cause to be maintained, erected, placed, rebuilt, reconstructed, altered or moved, any of the following types of Signs, which are prohibited by this Bylaw: An Abandoned Sign; An Animated Sign;

10 (vi) (vii) (viii) (ix) (x) (xi) (xii) (xiii) (xiv) (xv) (xvi) (xvii) (xviii) (xix) (xx) (xxi) A Balcony Sign; A Banner Sign; A Billboard Sign; A Flashing Sign; An Inflatable Sign; A Revolving Sign; A Roof Sign; A Search Light Sign; A Streamer Sign; A Third-party Sign; A Vehicle Sign; A Sign on a highway; A Sign in a sightline area; A Sign that interferes with or has the shape or colour of a traffic control device (as referred to in the Motor Vehicle Act); A Sign that emits sound, odour or matter; A Sign that obstructs the movement, access or egress of vehicular or pedestrian traffic including part of a door opening, window opening, passageway, fire escape, walkway, vehicular driveway or similar feature; A Sign that interferes with any surface or underground facilities, conduits or lines for water, sewage, gas, electricity, or communications equipment; A Sign located upon or suspended over a public right-of-way, highway, sidewalk or public property unless the Owner of the building has complied with Section 12 Signs on Public Property of this Bylaw; or A Sign erected on a parcel, premises, or building that has fallen into disrepair, or become, or remains in, an unsightly, illegible, unsafe or hazardous condition. 10. Exempted Signs The following Signs are exempt from the requirement for a Permit, provided they comply with all other requirements of the Bylaw: A Sign erected on the parcel, premises, or building of any public institution, including hospitals, schools, and municipal, provincial or federal government buildings; A Sign erected on any public right-of-way, highway, sidewalk or public property under the authority of the municipal, provincial or federal government, which Sign may be illuminated or flashing as required for safety reasons;

11 (vi) (vii) (viii) (ix) (x) (xi) (xii) (xiii) A Poster or notice issued by the municipal, provincial or federal government, or a court; A Sign located wholly within the interior of a building, not including a Window Sign or a Home Occupation Sign located in a multiple unit residential zone; A Sign warning of a danger or hazard erected under the authority of the municipal, provincial or federal government; A Prohibitory Sign; A Directional Sign; A Poster placed on a Community Notice Board Sign; A Sign indicating the use of on-site security systems; A Sign displaying the words Neighbourhood Watch, Block Parent, Beware of Dog", "No Trespassing", "No Discharge of Firearms" or "No Dumping"; A Real Estate Sign; A Political Sign; and A Sign advertising the accessory sale of farm produce, to a maximum of one Sign per parcel in a zone Permitting an agricultural use. 11. Signs on Public Property (b) Whenever any Sign is installed or erected either wholly or partly over public right-ofway, highway, sidewalk or public property, the Owner or tenant of the premises to which the Sign is attached shall prior to installation enter into a licence agreement with the District in a form satisfactory to the District which requires the Owner or tenant to indemnify and save the District harmless from any and all liability resulting from injury to person or damage to property which results from the presence, collapse or failure of the Sign, and to obtain prior to installation and at all times thereafter maintain in full force and effect a policy of liability insurance covering bodily injury and/or property damage for claims arising out of the installation or erection of such Sign in the amount of at least $3,000,000.00 for so long as the Sign or any portion thereof remains over public property. The District shall be named as co-insured on any such insurance policy. The Owner or tenant shall provide the District with a certificate of insurance and any renewal thereof. In the event that the Owner or tenant does not maintain such insurance or allows such insurance to lapse without renewal the Permit issued for such Sign shall be deemed to be revoked and the Owner or tenant shall forthwith remove, take down, or demolish the Sign prior to the date of expiry of the insurance, in default of which the District may remove and dispose of the Sign at the cost of the Owner or tenant, and recover the cost of doing so in accordance with s. 258 of the Community Charter. 12. General Regulations All Signs shall be installed on the same floor and the same Premises Frontage as the business or other use to which they pertain.

All light sources, conduits, switches and wiring shall be weather proofed unless a permanent rigid sealed structure is provided which ensures that the electrical installation is kept dry at all times. All wiring and conduits shall be placed within building walls, located underground or otherwise concealed from view. No person, Owner or occupier of a parcel, premises, or building shall Permit an electrical cord for a Time-Limited Sign to pass over a highway, sidewalk, pedestrian walkway, driveway, aisle, or parking space. Except for banners, Permitted Time-Limited Signs, Portable Signs, and Window Signs, all Signs shall be constructed of durable, permanent materials and shall be permanently attached to the ground, a premises, a building, or a structure. All Signs shall be coordinated in colour, design and placement with the building façade, architectural elements and other Signs on the façade. All fastening hardware and support structures shall be structurally sound, form an integral part of the Sign design and blend with the Sign material and colour. The illumination of any Sign shall not direct any rays of light upwards or upon any surrounding highway, parcel or building. 13. Specific Regulations (b) An Identification Sign shall: be an Awning Sign, a Fascia Sign, or a Freestanding Sign; not have a Sign Area greater than 3.0 square metres; and not be illuminated. A Bulletin Board Sign shall: be limited to one bulletin board per building; not project more than 0.2 metres from the face of the Premises Frontage, building or structure to which it is attached; and not exceed a Sign Area of 2.5 square meters. (c) A Community Event Sign shall: be a Bulletin Board Sign; and only provide space for Posters, provided that the Poster Signs are posted for a time period not exceeding thirty days and are removed by the posting party within ninety-six (96) hours of the termination of the advertised event.

13 (d) A Home Occupation Sign shall: (vi) be a Fascia Sign; be situated wholly on the parcel where the home occupation takes place; refer to a home occupation licensed by the District; not have a Sign Area greater than 0.2 square metres; not be placed above the first storey; and not be illuminated. (e) An Awning Sign shall: (vi) (vii) be limited to one Awning Sign per Awning; not be placed above the first storey; be painted or affixed flat to the exterior of the Awning; be limited to the Logo, name, or principal product lines of the business occupying the premises to which the Awning is attached; not extend vertically or horizontally beyond the limits of the Awning; not have more Copy Area than 40% of the area of the face of the Awning it is on; and not be illuminated. (f) A Canopy Sign shall: be limited to one Canopy Sign per Awning; be attached to the edge of the Canopy; be limited to the Logo, name, or principal product lines of the business occupying the premises to which the Canopy is attached; not extend horizontally or vertically beyond the limits of the Canopy, provided that Canopy Signs for supermarkets and liquor stores may extend 1.5 m above the upper edge of a Canopy when located above the principal entrance of the Premises Frontage to which the Canopy is attached; and have a minimum Clearance of 2.75 metres between the bottom of the Canopy Sign and finished grade. (g) An Under-Canopy and Under-Awning Sign shall:

14 not project beyond the front edge or sides of the of the Awning or Canopy; be perpendicular to the face of the Premises Frontage to which the Awning or Canopy is attached; be limited to the Logo, name, or principal product lines of the business occupying the premises to which the Awning is attached; have a maximum vertical dimension that does not exceed 0.3 m; (vi) (vii) (viii) have a maximum horizontal dimension that does exceed 1.5 metres; have a maximum Sign Area of 0.4 m²; have a minimum Clearance of 2.5 metres between the bottom of the under- Awning or Under-Canopy Sign and finished grade; and not be illuminated. (h) A Fascia Sign shall: (vi) (vii) (viii) (ix) be limited to one per Premises Frontage; be limited to the Logo, name, or principal product lines of the business occupying the premises to which the Awning is attached; have a minimum Clearance of 2.75 metres between the bottom of the Fascia Sign and finished grade, unless the Fascia Sign is: painted on a building; located over a landscaped area wholly on private property; or entirely recessed into the wall of a building; not project more than 0.35 metres from the face of a Premises Frontage to which it is attached; not extend beyond the Roof Line, or if there is a Parapet on the building, the Parapet; and not extend over any guard rails or balustrades. A Freestanding Sign shall: be limited to one Freestanding Sign for each 30 m of highway frontage, to a maximum of two (2) Freestanding Signs per parcel; have a minimum separation distance of 30 m where more than one Freestanding Sign is Permitted;

15 (vi) (vii) not have a Sign Area greater than 4.0 square metres; not have a Sign Face greater than 2.0 square metres; where a Freestanding Sign projects over vehicular traffic on private property, maintain a minimum Clearance of 4.5 metres between the lowest portion of the Sign and finished grade; be located within a landscaped area extending a minimum of 0.6 metres around the entire base of the Sign; and not exceed a height of 4.5 metres. (j) A Changeable Copy Sign shall: be installed as part of a Canopy Sign, a Fascia Sign, or a Freestanding Sign; be limited to one Changeable Copy Sign per parcel; and not have a Sign Area greater than 3.0 square metres. (k) A Sandwich Board Sign shall: (vi) (vii) (viii) (ix) be limited to a maximum of one Sandwich Board Sign per Premises Frontage to which it refers; only be displayed during the operating house of the premises to which it refers; be located entirely on private property in front of the premises to which it refers; not be located in a parking area, loading area or right-of-way area; be located to provide a minimum radius of 1.2 square metres of unencumbered area around the Sandwich Board Sign; not have a Sign Area greater than 1.5 square metres; not have a Sign Face greater than 0.75 square metres; not exceed a height of 1.05 metres or a width of 0.76 metres; and not be illuminated. (l) A Window Sign shall: be limited to one Window Sign per Premises Frontage; and be limited to a Sign Area of 20% of the window area.

16 (m) A Time-Limited Sign shall: be limited to a Portable Sign or Banner Sign; be limited to advertising a Special Event, to a maximum of three Time-Limited Signs per calendar year, per parcel, premises, or building, and be erected only for the time period specified in the Permit, which may not exceed thirty (30) days; not have a Sign Area greater than 6.0 square metres; be removed within twenty-four (24) hours of the expiry of the Permit, or within ninety-six (96) hours of the termination of the event to which the Sign pertains, whichever occurs first; and where the Sign is a Portable Sign: (1) not be placed within a parking area, loading area or a right-of-way area; (2) if placed on a wheeled conveyance, not be placed in any landscaped area; (3) that includes wiring, be installed such that any wiring is concealed, selfcontained or pre-wired to an adjacent power source. 14. Permitted Signs by Zone The type, number, and dimensions of Signs described in the second and third columns of the following table in respect of the zones specified in the first column are Permitted in those specified zones, and all other Signs not so Permitted are prohibited. For each day that a violation is Permitted to exist, it shall constitute a separate offence.
