Objective Community Care Fund Third Launch of the One-off Living Subsidy for Low-income Households Not Living in Public Housing and Not Receiving CSSA Programme Brief The Commission on Poverty endorsed to launch the assistance programme under the Community Care Fund (CCF) to provide a one-off living subsidy for low-income households not living in public housing 1 and not receiving CSSA (the Programme) for the third time to relieve their financial pressure. The Programme is administered by the CCF Secretariat (the Secretariat), and 242 service units operated by non-governmental organisations (NGOs) will assist in implementing the Programme (the service units). The list of these units is at Annex I. Eligibility Criteria 2. Applications under the Programme are divided into two categories: (a) (b) old applications (i.e. beneficiary households of the Programme which was relaunched during the period from 2 January to 31 August 2015 (the Relaunched Programme)) ; and new applications. 3. Target beneficiaries should meet all the following criteria: (a) (i) Renting on a monthly basis (or for longer tenures) accommodation in private permanent housing (private housing) 2, industrial buildings or commercial buildings; or (ii) Renting bedspaces offered under the Home Affairs Department s Singleton Hostel Programme; or (iii) Residing in temporary housing 3 ; or (iv) Living on board vessels; or (v) Homeless persons 4 ; 1 For the purpose of the Programme, households not living in public housing refer to those not living in public rental housing or subsidised home ownership housing (including flats under the Home Ownership Scheme and the Tenants Purchase Scheme). 2 Including all private residential flats, rooms (cubicles/solid partitioned cubicles), sub-divided units, bedspaces/cocklofts, villas/bungalows/modern village houses, simple stone structures/traditional village houses, staff quarters, subsidised home ownership housing (including flats under the Home Ownership Scheme and the Tenants Purchase Scheme) that are not bounded by alienation restrictions, and Tai Hang Sai Estate. 3 Including Temporary Housing Area units, and private temporary housing such as roof-top structures, squatter structures, licensed structures (i.e. domestic structures licensed by the Lands Department), huts, places not intended for residential purpose (such as landings, staircases, corridors, etc.), contractor s matsheds and nissen huts. 4 Homeless persons include: (a) Street sleepers; (b) Persons residing in the following temporary shelter/urban hostel for single persons operated by NGOs: (i) Caritas Hung Hom Hostel; (ii) Street Sleepers Shelter Society Trustees Incorporated s Shamshuipo Shelter, Yaumatei Shelter and Wanchai Shelter; (iii) The Salvation Army s Yee On Hostel; (iv) Christian Concern for the Homeless Association s Home of Abundant Grace, Home of Blessings, Home of Grace and Home of Lily; (v) St. James Settlement s Li Chit Street Single Persons Hostel; (vi) Neighbourhood Advice-Action Council s Jockey Club Lok Fu Hostel for Single Persons; 1

(b) The average monthly household income in the past 3 months 5 shall not exceed the specified income limit applicable to the relevant household size below: Household size (persons) Specified household income limit ($) 1 10,100 2 16,140 3 21,075 4 26,475 5 29,050 6 or above 32,540 (c) For persons renting accommodations in private housing, industrial buildings or commercial buildings, the average monthly rent paid in the past 3 months 6 shall not exceed the specified rental limit applicable to the relevant household size below: Household size (persons) Specified household rental limit ($) 1 5,050 2 8,070 3 10,538 4 13,238 5 14,525 6 or above 16,270 (d) Do not receive Comprehensive Social Security Assistance (CSSA) 7 ; (e) Neither the applicant nor household members own any property in Hong Kong (including jointly owned properties); (vii) Pok Oi Hospital Jockey Club Hostel for Single Persons; (viii) Missionaries of Charity s Home of Love; and (c) Persons residing in the Housing Department s Po Tin Transit, Tuen Mun and Lung Tin Transit, Tai O. 5 The average monthly household income in the past 3 months refers to the average monthly household income of the 3 months prior to the submission of application (i.e. the average of the total monthly income of the applicant and household members residing with him/her), including earnings from employment and other income (i.e. including salary, double pay/leave pay, job allowance, bonus/commission/tips, fees for rendering services, profits from business/investment, alimony, contribution from relatives/friends, interests from fixed deposits, stock and shares, etc., rental income, monthly pension/widow s and children s compensation). Employee s mandatory contribution to a Mandatory Provident Fund Scheme, financial assistance provided by the Government, charitable donations and financial assistance from other assistance programmes of the CCF, etc. of the applicant and household members residing with him/her are however not included. When calculating the monthly household income, applicants can refer to the monthly average of the two irregular income items (i.e. double pay and bonus) accumulated over the respective period of time. 6 Refers to the average monthly rent paid for the 3 months prior to the submission of application (calculated according to the amount shown on the rental receipt, the amount should exclude management fees, rates, or utility charges for water, electricity and gas etc.). 7 In case one/more member(s) of the applicant s household does/do not meet this criterion, the application will still be processed. However, this/these person(s) should be excluded for the purpose of calculating the number of household members, income, rent and subsidy amount. 2

(f) (g) Hong Kong Permanent Residents, or holders of Hong Kong Identity Card who do not belong to those who have entered Hong Kong not for the purpose of settlement, and/or those who have demonstrated to the satisfaction of the Immigration Department (ImmD) that they have the financial means to sustain their living in Hong Kong before issuance of visas/entry permits 7 8 ; and If the applicant is renting an accommodation in private housing, industrial building or commercial building, the rented accommodation should not be a property owned by the father, mother, son, daughter 9, husband or wife of the applicant and/or of any household members. Application Arrangements 4. Old application households will receive notifications for confirming eligibility (notifications) 10 sent by the Secretariat, and they must send a written reply to confirm their eligibility. Old and new application households shall meet all the eligibility criteria as listed at paragraph 3 above when confirming eligibility/submitting an application 11 respectively. Please refer to Annex II for the application procedures. Old and new application households are required to confirm eligibility/submit new applications respectively in phases 12 having regard to their household sizes 13 from 4 January to 31 August 2016 (application period) as follows: From 4 January 2016 onwards From 1 February 2016 onwards From 1 March 2016 onwards From 1 April 2016 onwards To confirm eligibility or submit new applications (one-person households) To confirm eligibility or submit new applications (two-person households) To confirm eligibility or submit new applications (three-person households) To confirm eligibility or submit new applications (four-or-more-person households) 8 Persons who have entered Hong Kong not for the purpose of settlement, and/or those who have demonstrated to the satisfaction of the ImmD that they have the financial means to sustain their living in Hong Kong before issuance of visas/entry permits include: (a) Persons admitted into Hong Kong under the Capital Investment Entrant Scheme and their dependants; (b) Persons admitted into Hong Kong under the Quality Migrant Admission Scheme and their dependants; (c) Persons admitted into Hong Kong for employment as imported workers under the Supplementary Labour Scheme; (d) Persons admitted into Hong Kong under the Working Holiday Scheme; (e) Foreign domestic helpers; (f) Visitors; or (g) Persons admitted under the following immigration policies/arrangements and their dependants: (i) Training; (ii) Study; (iii) Employment under the General Employment Policy; (iv) Investment under the General Employment Policy (i.e. to establish or to join in a business); (v) Employment under the Admission Scheme for Mainland Talents and Professionals; (vi) Employment under the Immigration Arrangements for Non-local Graduates; or (vii) Employment under the Admission Scheme for the Second Generation of Chinese Hong Kong Permanent Residents. 9 Including legally recognised adoptive parents/children and illegitimate children. 10 Those who do not have a mailing address or are homeless persons, notifications will be delivered through the relevant service units. 11 The date of confirming eligibility shall be the date when the old application household signs the reply slip attached to the notification; the application date shall be the date when the new application household submits the duly completed application form (together with copies of all the required documents) to the service unit. 12 If the application households are eligible for the Programme during the period from 4 January 2016 to the date before the commencement of the respective application phase applicable to the relevant household size, but are not eligible after the commencement of the respective application phase applicable to the relevant household size owing to subsequent changes of their household situations, they can contact the Secretariat for special arrangement. 13 Refers to the number of eligible household members. 3

31 August 2016 End of application period (i.e. all eligible households (irrespective of household size)) (A) Old Applications 5. Old application households will, having regard to their household sizes 14, receive notifications sent by the Secretariat during the initial period of each phase of the application period. For households who meet the eligibility criteria for the Programme (including those who are still eligible despite changes in income, rent, residential address and/or a reduction in the total number of household members as compared with the application for the Relaunched Programme), they shall complete the reply slip with appendices 15 attached to the notification and send it back to the Secretariat for confirmation of their eligibility 16 before the end of the application period (i.e. on or before 31 August 2016) 17. 6. Each old application household should submit one reply slip only for confirmation of their eligibility and duplicate submissions will not be processed. Duplicate submissions may cause delay to the processing of cases and the arrangement of subsidy disbursement. The reply slip, once submitted, cannot be withdrawn except with special reasons. All information and documents submitted in relation to the case will not be returned. 7. Upon receiving the reply slip with appendices, the Secretariat will verify an application household s eligibility for the Programme and send a notification of eligibility verification result 10 to the specified applicant who applied for the Relaunched Programme (old applicants). Eligible old applicants will collect the subsidy according to their chosen method 18 under the Relaunched Programme (i.e. either through direct payment into bank account or order cheque); the respective subsidy amounts for one-person households, two-person households, three-person households, four-person households and five-or-more-person households are HK$4,000, HK$8,000, HK$11,000, HK$13,000 and HK$14,000. For ineligible cases, the Secretariat will send the notifications of eligibility verification result 10 by registered mail. For old applicants who disagree with the eligibility verification results, they can seek a review in writing with justifications within 14 days after receiving the notifications of eligibility verification result (address: 4/F, Southorn, 130 Hennessy Road, Wan Chai, Hong Kong). 8. For households that have new eligible members (whether the total number of household 14 The Secretariat will send the notification to the old application households in phases having regard to their household sizes under the Relaunched Programme. Upon receipt of the notifications, such households shall complete and return the reply slips attached to the Secretariat for confirming eligibility. 15 As the eligibility verification will be made on a household basis, all the eligible household members should sign on the reply slip to give consent to the specified applicant under the Relaunched Programme to receive the subsidy on their behalf if the household was found to be eligible. If the eligible household member is under the age of 18, the declaration should be made and signed by his/her parents/guardians (must be Hong Kong residents at the age of 18 or above); if the person is incapable of managing his/her own affairs or mentally incapacitated, the declaration should be made and signed by his/her agent (see Footnote 28) or legal guardian (see Footnote 29) (must be Hong Kong residents at the age of 18 or above). 16 Households should meet the eligibility criteria of the Programme on the day they sign the reply slip. Applicant and household members (if applicable) should personally sign the relevant part(s) of the reply slip and the signature should be the same as that in the application form/reply slip for confirming eligibility under the Relaunched Programme. The Secretariat/service units may contact the applicants regarding the information on the reply slip. Applicants may be required to clarify or submit additional information. The Secretariat/service units may conduct audit checks, including home visits/visits and income test conducted by the service units on selected cases, in the course of processing the cases or after the disbursement of subsidy, which will help determine whether a household is eligible for the Programme on the day of signing the reply slip. 17 Postmark date (to the Secretariat) will be regarded as the date of submission. 18 If old applicants would like to change the arrangement for receiving the subsidy, please complete item (h) at Appendix A of the notification. 4

Such households shall complete Part 1 of the reply slip and return it to the Secretariat. The Secretariat will forward these households information to the relevant service units which will contact the households for follow up. For the relevant arrangements of submitting the new application form and required documents, please refer to items (B)(2) to (B)(5) below. For households who do not meet the eligibility criteria of the Programme, please complete Part 1 of the reply slip and return it to the Secretariat 19. (B) New Applications (1) Submission of Applications in Phases 9. New application households shall submit their applications in phases to the service units near their residences during the application period (according to the timetable at paragraph 4 above): (a) (b) (c) (d) General households: submit application forms to service units accepting general applications (see the list at Part 1 of Annex I). Households with elders only (i.e. all members in the household are at the age of 65 or above): submit application forms to elderly service units 20 (see the list at Part 2 of Annex I); Households with young people only (i.e. all members in the household are at the age of 24 or below): submit application forms to youth service units 21 (see the list at Part 3 of Annex I); and Homeless persons: submit application forms to service units accepting applications from homeless persons (see the list at Part 4 of Annex I). Please do not submit applications by fax or by e-mail. Applicants are recommended to submit the application forms in person to the service units near their residences, which will facilitate the verification by the service units of the eligibility of the application households and checking of documentary proof submitted. (2) Submission of Documents 10. Duly completed application forms of new application households, together with copies of the following required documents, should be submitted to the service units near the applicants residences (see items 9(a) to (d) above) during the application period. (a) Hong Kong Identity Card 22 of the applicant and all household members (may choose to produce the original copies in person at the service units); 19 If the households choose the option of not meeting the eligibility criteria of the Programme in Part 1 of the reply slip, it will be recorded. If the households meet the eligibility criteria of the Programme before the end of the application period (i.e. on or before 31 August 2016) subsequent to changes of their household situation and wish to receive the subsidy, they can contact the Secretariat at 2180 6666. 20 Namely district elderly community centres, neighbourhood elderly centres, social centres for the elderly, support teams for the elderly and other non-subvented elderly service units. 21 Namely integrated children and youth services centres, and children and youth centres. 22 Or Hong Kong Birth Certificate/other identity document (for those under the age of 11 only) or Certificate of Exemption (if applicable). 5

(b) (c) (If applicable) rental receipts for renting accommodations in private housing, industrial buildings or commercial buildings (showing the applicant or any of the household members as the tenant of the accommodation concerned, the residential address and the monthly rent); (If applicable) documentary proof of living in the following hostels/shelters (e.g. the rental receipts or occupation certificates issued by the hostels/shelters): (i) Bedspaces under the Singleton Hostel Programme operated by the Home Affairs Department; (ii) Temporary shelters/urban hostels for single persons operated by NGOs (see Footnote 4); or (iii) Po Tin Transit in Tuen Mun and Lung Tin Transit in Tai O operated by the Housing Department; (d) For applicants who choose to receive the subsidy through direct payment 23 into bank accounts: documentary proof of bank account (e.g. the relevant page of passbook showing the name of the account holder or bank statement of the bank account concerned, etc.); and (e) For household members who are incapable of managing his/her own affairs 24 or mentally incapacitated 25 : supporting documents which prove that the household member concerned is incapable of managing his/her own affairs or mentally incapacitated (e.g. a certificate of appointment issued by the Court or certificates issued by registered medical practitioners of Hong Kong). (3) Notes to Applicants 11. New application households should note the following: (a) Applications should be made on a household 26 basis, yet there is no requirement on the relationship among the persons in a household. (b) For households with more than one person, each household should nominate one eligible adult 27 as the applicant. Other household members should sign on the application form to give consent for appointing the specified applicant to apply on their behalf. For household members who are under the age of 18, their parents/guardians (must be Hong Kong residents at the age of 18 or 23 The applicant must provide the information of his/her local Hong Kong dollar sole-name savings/current account. 24 For the purpose of the Programme, a person who is incapable of managing his/her own affairs refers to a person who needs to have his/her affairs managed by other persons appointed by the Court. 25 For the purpose of the Programme, a mentally incapacitated person refers to a person who is incapable of managing and administering his property and affairs by reason of mental incapacity. According to the Mental Health Ordinance (Cap. 136), mentally incapacity means mental disorder; or mental handicap, and mental disorder means: (a) mental illness; (b) a state of arrested or incomplete development of mind which amounts to a significant impairment of intelligence and social functioning which is associated with abnormally aggressive or seriously irresponsible conduct on the part of the person concerned; (c) psychopathic disorder; or (d) any other disorder or disability of mind which does not amount to mental handicap. 26 For the purpose of the Programme, a household consists of a group of persons who live together and make common provision for essentials for living. These persons need not be related. If a person makes provision for essentials for living without sharing with other persons, he/she is also regarded as a household. In this case, the household is a one-person household. 27 Adult means a person who has reached the age of 18 on the day when he/she submits the application. 6

For household members who are eligible for the Programme but are incapable of managing his/her own affairs or mentally incapacitated, their agents 28 or legal guardians 29 (must be Hong Kong residents at the age of 18 or above) should make the declaration and sign on their behalf. Should the application be successful, the subsidy for all eligible members in the household will be disbursed to the specified applicant (e.g. the specified applicant of a two-person household will receive HK$8,000 of subsidy (see item 13(a) below)). (c) (d) (e) (f) Each household should submit only one application form to one service unit, duplicate submissions will not be processed. Duplicate submissions may cause delay to the processing of application and the arrangements of subsidy disbursement. The application form, once submitted, cannot be withdrawn except with special reasons. All information and documents submitted for application under the Programme will not be returned. Applicants are required to declare on the application form that the average monthly household income in the past 3 months does not exceed the specified income limit applicable to the relevant household size, but relevant documentary proof of income is not required 30. Applicants are required to declare that they and their household members are residing at the accommodations of a local address indicated in Part 1 of the application form on the application date and that the accommodations are under the coverage of the Programme (see item 3(a) above). Applicants who rent accommodations in private housing, industrial buildings or commercial buildings should note that: (i) each rental receipt 31 32 shall be used by one household only for application purpose. The rented accommodation shown on the rental receipt should be the same as the local residential address indicated in Part 1 of the application form. The applicants should declare that the average monthly rent of the accommodation in the past 3 months does not exceed the rental limit applicable to the relevant household size; (ii) applicants who are unable to provide a rental receipt are required to make a self-declaration 33 that they and their household members are the tenants of the accommodation in private housing, industrial building or commercial building as indicated in the application form, and the reason for not being able to provide a rental receipt; and (iii) the rented accommodation should not be a property owned by the father, mother, son, daughter, husband or wife of the applicant and/or of any household members. Applicants and the household members should make a declaration on meeting this criterion. 28 For the purpose of the Programme, agents refer to people who are appointed by the Court to manage the affairs on behalf of the persons who are incapable of managing his/her own affairs. 29 Refer to legal guardians for those mentally incapacitated persons as appointed under the Mental Health Ordinance (Cap. 136). 30 But application households must show the relevant documentary proof of income during the home visits/visits and income test conducted by the service units (see item 12(c) below). 31 Must show that the applicant or any of the household members is the tenant of the accommodation concerned, the residential address and the monthly rent. 32 If there are more than one household in one accommodation, and these households rent part of the accommodation concerned and have their own rental receipts, they can submit application with their own rental receipts respectively. 33 Please contact the service units for the self-declaration form in specified format. 7

Applicants and their household members should declare that they do not own any property in Hong Kong. Applicants and their household members should declare that they do not belong to those who have entered Hong Kong not for the purpose of settlement, and/or those who have demonstrated to the satisfaction of the ImmD that they have adequate financial means to sustain their living in Hong Kong before they have been issued a visa/entry permit from the ImmD (applicable to non-hong Kong Permanent Residents, see item 3(f) above). For eligible applicants under the age of 18, if their household members are not eligible for the Programme (e.g. two-way exit permit holders or CSSA recipients), their parents/guardians (must be Hong Kong residents at the age of 18 or above) can submit the application on their behalf, and receive the subsidy for them when their eligibility under the Programme have been confirmed (for special arrangements please contact the Secretariat at 2180 6666). (4) Processing of Application 12. The procedures of processing new applications 34 are as follows: (a) (b) (c) (d) The Secretariat and the service units will vet every application, including verifying the applicant s eligibility and checking the supporting documents submitted by the applicant. They may contact the applicants regarding the information on the application forms. Applicants may be required to clarify or submit additional information. To determine the eligibility of an application under the Programme, the Secretariat/service units will conduct the vetting in accordance with the applicants situation on the date when they submit the application (i.e. the date the duly completed application form (together with copies of all the required documents) is submitted to the service unit). The Secretariat/service units may conduct audit checks, including home visits/visits and income test conducted by the service units on selected applications, in the course of processing of application or after the disbursement of subsidy. The Secretariat/service units will issue a notification of result to applicants after vetting the applications concerned. Notifications to unsuccessful applicants will be sent by registered mail. For applicants who do not have a mailing address or are homeless persons, notifications will be delivered through the service units. Applicants who disagree with the application results can seek a review in writing with justifications within 14 days after receiving the notifications (address: 4/F, Southorn, 130 Hennessy Road, Wan Chai, Hong Kong). 34 Including new applications submitted by old application households as a result of changes of household situation. 8

(5) Disbursement of Subsidy 13. The subsidy disbursement arrangement is as follows: (a) (b) (c) The Secretariat will disburse a subsidy of HK$4,000 to eligible one-person households, HK$8,000 to eligible two-person households, HK$11,000 to eligible three-person households, HK$13,000 to eligible four-person households and HK$14,000 to eligible five-or-more-person households. For applicants who choose to receive the subsidy through direct payment into bank accounts, the subsidy (including that of the applicant and those received by the applicant for other eligible persons in the household) will be deposited directly into the bank accounts as specified in their application forms through autopay. The applicants must provide the account number of his/her local Hong Kong dollar sole-name savings/current account. Do not provide the account number of a joint account, credit card account, loan account, fixed deposit account, investment account or foreign currency account. For applicants who choose to collect the subsidy in the form of order cheques, the service units concerned will inform applicants to bring along their Hong Kong Identity Card 35 and collect the notifications of application result and the cheques in person at the service units at the specified time, after verification of his/her name and Hong Kong Identity Card number. If applicants fail to collect the cheques at the specified time without reasonable explanations, no subsidy will be given to them. Enquiries 14.
