(Hammock absent) to find this item consistent with the Uniform Rules, contingent on planner verification of the production and planting requirements found in 2-2.1 B.2 of the Uniform Rules on page 28. 15. Conflict of Interest Code The Agricultural Preserve Committee will hold a hearing to consider the adoption of the county s single comprehensive conflict of interest code, a request that the Board of Supervisor s include the Committee in that code and the adoption of an exhibit, C-39, to be added to the code, as required by the Board of Supervisors. ACTION: Karamitsos moved, seconded by Jensen, and carried by a vote of 4 to 0 (Hammock absent) to adopt County Counsel s recommendations as follows: 1. Find the Committee s recommendations are regularly followed; 2. Adopt Santa Barbara County s Single Comprehensive Conflict of Interest Code; 3. Designate David Allen as the Filing Officer for Disclosure forms and request he submit the Minutes of the October 5, 2007 meeting to Enrique Sanchez, Senior Deputy County Counsel; and 4. Request the Board of Supervisors amend the County Comprehensive Single Conflict of Interest Code by adding, exhibit C-39. IV. DISCUSSION ITEMS: 16. 69-AP-004 Skyline Trust Los Alamos 01-DP-002 The Agricultural Preserve Committee will have a discussion concerning the use of the northern road and if it is used for motocross. (Continued from 6/1/07, 7/13/07) This item will be continued to the November meeting due to no site visit being scheduled.

Page 7 Parish Ag Employee 17. 72-AP-135 Dwelling, Barn & Greenhouse Hollister Ranch Errin Briggs, Planner (805) 568-2047 Consider the request of Christopher Price, Price, Postel and Parma, agent for the owner, Jacqui Parish, for a proposed Agricultural Employee Dwelling, barn and greenhouse and its consistency with the Uniform Rules. The property involves Assessor s Parcel Number 083-700-025, 105.84 acres currently zoned AG-II-320 with an A-II-320 Comprehensive Plan designation. The property is located at Parcel 135 in the Hollister Ranch area, Third Supervisorial District. The Committee was concerned that there is no agricultural production to justify a farm employee dwelling. The Applicant should return with a Business Plan which identifies the minimum infrastructure requirements for supporting the proposed two acre flower fields on the project site. Plantel Nurseries, Inc. 18. 96-AP-008 Greenhouse Development Plan Santa Maria No Planner Assigned Consider the request of Ray Severn, AICP, Penfield and Smith Engineers, agent for the owner, Scott Nicholson, President, Plantel Nurseries, Inc, regarding a greenhouse Development Plan proposal consisting of 21 greenhouse structures, plus office, warehouse, parking, water tanks, recycling system, and other ancillary facilities including approximately 1,000,000 square feet of covered structural area; and its consistency with the Uniform Rules. The property is a 60 acres out of a 136 acre parcel shown as Assessor s Parcel Number 129-170-004, zoned AG-II-100 with an AC Comprehensive Plan designation located on the north side of Clark Avenue, east of Lake Marie Estates/Telephone Road and west of Old Dominion Road in the Santa Maria area, Fourth Supervisorial District. The Committee saw no issues with this project. 19. 88-AP-003 Beckmen Demo/Rebuild Los Olivos No Planner Assigned Request of Ken Mineau, Appleton & Associates, Inc., agent for owners, Judy and Tom Beckmen, regarding demolition of an existing single family dwelling and detached garage; rebuild new two story single family dwelling, detached garage, guest house, pool and cabana and its consistency with the Uniform Rules. The property involves Assessor s Parcel Number 137-020-057, 37.06 acres currently zoned AG-I-40 with an AC Comprehensive Plan designation. The property is located at 2670 Ontiveros in the Los Olivos area, Third Supervisorial District. The Committee saw no issues with this project. The Committee clarified that the non-agricultural use is restricted to 3% of the parcel and not 2 acres.

Page 8 20. Special Meeting The Agricultural Preserve Committee will have a discussion concerning a special meeting with the Department of Conservation. (Continued from 5/4/07, 6/1/07, 7/13/07, 8/10/07) This item will be dropped from the agenda and taken up when necessary. 21. Modified Boundaries---Ag Preserve Contracts 70-AP-139 and 95-AP-013 (Ardantz) The Agricultural Preserve Committee will have a discussion at the request of Committee Member, Lisa Hammock, regarding the need for new contracts, replacement contracts or the non-renewal of existing contracts, and direct staff to put on a future agenda for any necessary action. Issues Requiring Resolution: 1) Parcel Map No. 14,661, PM 059/89-90, recorded 06-30-2006 has created new lot lines that no longer equate to the boundaries of the two separate agricultural preserve contracts referenced above. 2) The same recorded parcel map has resulted in two separate ownerships on newly created lot # 2. Background Information for Staff: a) Contract 70-AP-139 consists of original assessor parcels 113-090-012 & 113-090-023. b) Contract 95-AP-013 consists of original assessor parcels 113-090-021 & 113-090-022. c) Parcel Map No. 14,661, PM 059/89-90, recorded 06-30-2006 has created a lot line that bisects contract 70-AP-139 thus placing a portion of the contract on the newly created parcel to the east. Lot # 2 is now configured to have a portion of 70-AP-139 and 95-AP-013. d) The ownership vesting is in two separate ownerships which may be contrary to the provisions of the subdivision map act. In addition, for the assessor s office to bill the proper owner the ownership of each parcel must be in one entity (which could be several owners as joint tenants, tenants in common, partnerships, etc.). (Continued from 7/13/07) This item will be continued to the December meeting. V. REPORTS OF COMMITTEE MEMBERS: None.
