ARTICLE 455. PD 455. Bluffview Special Purpose District SEC. 51P-455.101. LEGISLATIVE HISTORY. PD 455 was established by Ordinance No. 22865, passed by the Dallas City Council on August 28, 1996. Ordinance No. 22865 amended Ordinance No. 19455, Chapter 51A of the Dallas City Code, as amended. Ordinance No. 22865 was amended by Ordinance No. 22963, passed by the Dallas City Council on December 11, 1996. (Ord. Nos. 19455; 22865; 22963; 26042) SEC. 51P-455.102. PROPERTY LOCATION AND SIZE. PD 455 is established on property generally bounded by Bluebonnet Road, Midway Road, Bachman Creek, the northeastern and southeastern boundary line of City Block S/4988, the walkway between Lots 5 and 6-A in City Block S/4988, Pomona Road, the rear of Lots 7-A through 12 in City Block O/4984, Catawba Road, and the rear of Lots 6 through 10-B in City Block H/4978. The size of PD 455 is approximately 140 acres. (Ord. Nos. SEC. 51P-455.103. DEFINITIONS AND INTERPRETATIONS. (a) Unless otherwise stated, the definitions and interpretations in Chapter 51A apply to this article. In this article, DISTRICT means PD 455, the Bluffview Special Purpose District. Unless otherwise stated, all references to articles, divisions, or sections in this article are to articles, divisions, or sections in Chapter 51A. (c) For purposes of determining the applicability of regulations in this article and in Chapter 51A triggered by adjacency or proximity to another zoning district, and for purposes of interpreting the DIR and RAR requirements of Division 51A-4.800, this district is considered to be a residential zoning district. (Ord. Nos. SEC. 51P-455.104. CONCEPTUAL AND DEVELOPMENT PLANS. The provisions of Section 51A-4.702 regarding submission of or amendments to a conceptual plan, development plan, site analysis plan, or landscape plan do not apply to this district. (Ord. Nos. SEC. 51P-455.105. CREATION OF SUBDISTRICTS. This district is divided into three subdistricts as described in Exhibit A attached to Ordinance No. 22865 and as shown on the map labelled Exhibit 455A. In the event of a conflict between Exhibit A attached to Ordinance No. 22865 and Exhibit 455A, Exhibit A attached to Ordinance No. 22865 controls. (Ord. Nos.
SEC. 51P-455.106. MAIN USES PERMITTED. The main uses permitted in this district are those uses permitted in the R-10(A) Single Family District, subject to the same conditions applicable in the R-10(A) Single Family District, as set out in the Dallas Development Code. For example, a use permitted in the R-10(A) Single Family District by specific use permit (SUP) only is permitted in this PD by SUP only. A use subject to development impact review (DIR) in the R-10(A) Single Family District is subject to DIR in this PD, etc. (Ord. Nos. 22865; 26042) SEC. 51P-455.107. ACCESSORY USES. (a) As a general rule, an accessory use is permitted in any district in which the main use is permitted. Some specific types of accessory uses, however, due to their unique nature, are subject to additional regulations contained in Section 51A-4.217. For more information regarding accessory uses, consult Section 51A-4.217. The following accessory uses are not permitted in this district: -- Accessory helistop. -- Accessory medical/infectious waste incinerator. -- Accessory outside display of merchandise. -- Accessory outside sales. -- Accessory pathological waste incinerator. (c) The accessory community center (private) use is permitted by SUP only. (Ord. Nos. SEC. 51P-455.108. YARD, LOT, AND SPACE REGULATIONS. (Note: The yard, lot, and space regulations in this section must be read together with the yard, lot, and space regulations contained in Division 51A-4.400. In the event of a conflict between this section and Division 51A-4.400, this section controls.) (a) Front yard. Minimum front yard is 30 feet. Side and rear yard. (1) Minimum side and rear yard for single family structures is six feet. (2) Minimum side yard for other permitted structures is 10 feet. (3) Minimum rear yard for other permitted structures is 15 feet. (c) (d) (e) (f) Dwelling unit density. No maximum dwelling unit density. Floor area ratio. No maximum floor area ratio. Height. Maximum structure height is 30 feet. Lot coverage.
(1) Maximum lot coverage for residential structures is 45 percent. (2) Maximum lot coverage for nonresidential structures is 25 percent. (3) Surface parking lots and underground parking structures are not included in lot coverage calculations. (g) Lot size. Minimum lot area for each subdistrict is as follows: (1) In Subdistrict A, minimum lot size is 32,670 square feet. (2) In Subdistrict B, minimum lot size is 21,780 square feet. (3) In Subdistrict C, minimum lot size is 16,000 square feet. (h) Stories. No maximum number of stories. (Ord. Nos. 22865; 22963; 26042) SEC. 51P-455.109. OFF-STREET PARKING AND LOADING. (a) Consult the use regulations (Division 51A-4.200) for the specific off-street parking and loading requirements for each use. Consult the off-street parking and loading regulations (Divisions 51A- 4.300 et seq) for information regarding off-street parking and loading generally. In this district, off-street parking must be provided at or below ground level. (Ord. Nos. SEC. 51P-455.110. ENVIRONMENTAL PERFORMANCE STANDARDS. See Article VI. (Ord. Nos. SEC. 51P-455.111. LANDSCAPING. All landscaping must be provided in accordance with Article X. (Ord. Nos. SEC. 51P-455.112. SIGNS. Signs must comply with the provisions for non-business zoning districts contained in Article VII. (Ord. Nos. SEC. 51P-455.113. RIGHT-OF-WAY AND PAVEMENT WIDTHS. Minor streets must be designed and constructed to meet the following standards: (1) Minimum and maximum pavement width is 20 feet. Pavement widths are measured from the edge of the pavement to edge of the pavement. (2) Minimum and maximum right-of-way width is 30 feet.
(3) No construction of sidewalks is required along public and private streets within the district. (Ord. Nos. SEC. 51P-455.114. NONCONFORMING LOTS. All previously platted lots or legal building sites established prior to August 28, 1996, may be platted or replatted, as long as the degree of nonconformity as to lot size is not increased. For example, two contiguous building sites or lots may be platted or replatted to create one or more larger lots, even if the larger lot or lots are less than the minimum lot size permitted in the subdistrict. An applicant requesting an amendment to this PD must notify the Bluffview Association by mail of the proposed amendment prior to or at the time of the filing of the application with the city. In this district, a lot for a single family use may be supplied by not more than one electrical utility service, and metered by not more than one electrical meter. The board of adjustment may grant a special exception to authorize more than one electrical utility service and more than one electrical meter on a lot in this district when, in the opinion of the board, the special exception will: (1) not be contrary to the public interest; (2) not adversely affect neighboring properties; and (3) not be used to conduct a use not permitted in this district. The entire Property must be properly maintained in a state of good repair and neat Development and use of the Property must comply with all federal and state laws and regulations, and with all ordinances, rules, and regulations of the city. All paved areas, permanent drives, streets, and drainage structures, if any, must be constructed in accordance with standard city specifications, and completed to the satisfaction of the director of public works and transportation. SEC. 51P-455.119. COMPLIANCE WITH CONDITIONS. The building official shall not issue a building permit or certificate of occupancy for a use in this PD until there has been full compliance with this article, the Dallas Development Code, the construction codes, and all other ordinances, rules, and regulations of the city.
