The RESIDENT(S) agrees that the rules and regulations herafter adopted by LANDLORD shall have the same force and effect as the Lease Agreement. RESIDENT(S) agrees that the RESIDENT(S) and RESIDENT(S) S guests and invitees will observe all rules and any violation thereof shall constitute a breach in the Lease Agreement. a. OFFICE HOURS except in case of emergency, RESIDENT(S) shall contact LANDLORD only during the hours of 8:30 am and 5:00 pm 785-832-8728 or through online portal. b. RENT: Rent is to be paid on the first (1 st ) day of each month through the online portal, or by check or money order dropped in the black rental drop box provided. The drop box is located at Summer Tree Townhomes, 605 Eldridge Building A. Absolutely no cash is accepted. All checks must have the apartment/townhome/duplex number clearly displayed on the check. A $35.00 late fee will be assessed on any rent received later than the fifth (5 th ) day of any month after 5:00 pm. An additional $5.00 per day will be charged each day thereafter beginning on the tenth (10 th ) day of any month. Eviction proceedings will also begin after the tenth (10 th ) day of any month for non payment of rent. Weekends, holidays and vacations will not be considered for late payments and are not an extension of the grace period. Checks must be written to the complex, or duplex, in which you are living. Please refer to your individual lease for that information. Ask management if you are unsure who to write checks/money orders to. c. RETURNED CHECKS /ELECTRONIC TRANSACTIONS: A $30.00 fee will be assessed for checks and/or electronic payments returned by the bank. In addition, all late fees will apply. After the second offense, only a money order will be accepted for the remainder of the Lease Agreement. d. POSSESSION: All dates and times concerning the ability to either gain or relinguish possession of the Contracted Property shall be limited to business days unless agreed upon by RESIDENT(S) and LANDLORD. At move-in, all deposits and rent must be paid before keys and possession of the Contracted Property will be turned over to the RESIDENT(S). All utilities must be in RESIDENT(S) name, and a copy of the confirmation numbers given to LANDLORD, before keys will be issued. Relinquishing possession must occur on, or before, the date the lease ends before or at 12:00 (noon). Relinquishing possession means all tenant property is removed from the Contracted Property and Complex, the Contracted Property is thoroughly cleaned, and all keys/garage door openers are returned to the manager. An inventory checklist must be scheduled and completed to finalize contractual requirements. e. NUMBER OF OCCUPANTS: It shall be a breach of the rental contract for any person to reside in the Contracted Property without being a party to the Lease Agreement. Anyone staying longer than seven (7) days shall be considered residing in the Contracted Property. f. MAINTENANCE and EMERGENCIES: Non emergency maintenance requests shall be submitted during the hours of 8:00 am 5:00 pm Monday through Friday only through the online portal. If the required repairs are due to the negelect or misue of anyone other than the LANDLORD, the RESIDENT(S) shall be charged for all labor and replacement costs. Non-Emergency repairs will be completed between the hours of 8:00 am-5:00 Monday-Friday, or as scheduled, within 48 hours of request. Any concerns or problems with the unit should be reported promptly. What might appear to be a minor problem, may in fact, effect adjacent units and cause greater damage if not reported. Emergencies would include fire, flood, water breaks, backed up drain to unit, structure damage, gas/electrical related issues, Damage to Contracted Property as a result of RESIDENT(S) actions, or inactions, including but not limited to shower doors, doors/door handles/ windows, all appliances, all faucets, blinds, clogged toilets/drains/garbage disposals, torn carpet, etc. will be the charged to the RESIDENT(S) accordingly. 1

Maintenance requests are made through online portal. Emergencies: fire, flood, water breaks, backed up drain to unit, structure damage, gas/electrical related issues, should be called in to 911 if needed, or 785-832-8728. GAS LEAK Black Hills Energy 888-890-5554 g. GARBAGE DISPOSALS: Garbage disposals require care when using and please be aware of what is being put down the disposal. A reset button is located on the bottom of the disposal, and a wrench should also be located under the dispoal/kitchen sink. If there is a buzzing sound and the disposal is not working, turn it off and insert wrench in bottom center of disposal and rotate in order to break the jam before turning back on. Please call if there is an additional problem. h. LIGHTBULBS: RESIDENT(S) are responsible for changing all standard lightbulbs. Large LED bulbs will be replaced by LANDLORD. TOILETS: All plumbing has been delivered in working condition. If there are normal stoppages, tenants are responsible to plunge their own toilets. Do not flush anything down toilet other than toilet paper. RESIDENT(S) will be charged if lines are clogged due to use of paper towels, sanitary napkins/tampons, toys, etc. The water turn off for the toilet is behind the toilet if an overflow occurs. Please call if there are extensive problems. All tenants need to be aware of the main water shutoff in the unit. It is usually located in the water heater closet, or on the basement wall closest to the front of the property. Please be aware of shutoff valves for toilets in case of an overflow. In the case of a backed up drain, absolutely no water should be run in the entire unit. This will only make the problem worse! i. PARKING: Any vehicle parked in fire lanes, designated dumpster areas, no parking zones, red or yellow painted curb areas, or on the grass will be towned at Owner s expense. Storages of boats, trailers, inoperable vehicles, unlicensed vehicles, recreational vehicles is prohibited. The LANDLORD shall not be liable for any vehicle or expenses incurred as a result of the vehicle being towed. All vehicles must be in proper operating condition, for example: vehicles must be properly tagged, no flat tires, no missing parts, no broken windows, not on a jack or a lift, etc. Only authorized vehicles as stated in Lease Agreement will be allowed permanent (overnight) access to the Contracted Property and Complex. Parking is limited to 2 registered vehicles per unit. Any additional vehicles must be approved by LANDLORD. Any unauthorized vehicles, and vehicles that do not belong the RESIDENT(S) on Lease Agreement will be towed at owners expense. 901 Illinois On KU football home game days, tenant vehicles are to be removed from the parking lot on the west side of the building 5 hours prior to game time and until 1 hour after the game. There is street parking available for tenants on the east side of the building. It is recommended that tenants move their cars the night before to insure a parking place. SUMMER TREE TOWNHOMES 605 Buildings PARKING absolutely no parking in front of business doors at any time. No parking is allowed at the office building during the hours of 8:00 am to 5:00 pm Monday - Friday. Cars may be towed during these times. Summer Tree Townhome tenants, and visitors, may park at the 600 Eldridge buildings where there is plenty of parking. j. WINTER PRECAUTIONS: All outside spigots must have hoses disconnected from October 1 through April 1 in order to prevent freezing and/or bursting. Thermostats - RESIDENT(S) is required to have the heat set at a minimum of 60 degrees at all times during the winter months, including travel or absence. This is to prevent pipes from freezing and/or bursting. RESIDENT(S) will be strictly liable for all costs incurred by frozen/broken/burst pipes due to negligence or misuse of the heating and cooling systems. k. WATERBEDS: Waterbeds are not allowed unless proof of renter's insurance, including waterbeds, is provided to the LANDLORD. l. PETS: Absolutely No PETS are allowed unless previously approved by management with a fully executed Pet Policy and Pet Addendum attached to Lease Agreement. Review Lease Agreement for pet policy. 2

m. BALCONIES AND PATIOS AND WALKWAYS: All balconies, walkways, and patios shall be kept neat and clear of any obstructions which could affect the safety of other RESIDENT(S). Yard, deck, and patios are the RESIDENT(S) responsibility to keep areas free of litter, clutter and potential hazardous situations. RESIDENT(S) with pets are required to pick up dog waste. There is a $100 fine per occurrence for pet waste being left in the grass. This is out of respect for all RESIDENT(S) using the same grassy area. Balconies shall not be used as storage or to hang laundry. Banners, signs, or flags of any kind shall not be hung from balconies or patios at any time. Only outdoor patio furniture may be kept on balconies, decks, and patios. The City of Lawrence does not allow grills on multifamily decks. Complexes with concrete patios may use a grill 10 feet from the building. The International Fire Code section 308.1.4 specifically states: Charcoal burners and other open flame cooking devices shall not be operated on combustible balconies or within 10 feet (3048 mm) of combustible construction. All barbecuing/grilling shall be done at least 10 feet from any structure. Grills are not allowed on wood decks or balconies. This is a City of Lawrence ordinance and citations may be issued by Lawrence Fire Personnel. n. UTILITY CLOSETS: Furnace/utility closets shall not be used for storage at any time. Using the furnace closet as storage is a fire hazard, RESIDENT(S) are responsible for proper use of the Contracted Property. o. SNOW REMOVAL: Ice and snow removal in front of the the Contracted Property is the responsibility of the RESIDENT(S). LANDLORD is responsible for plowing parking lot and main sidewalk snow removal. RESIDENT(S) at the Jana Drive duplexes are responsible for all snow removal on driveway, porch, and sidewalk. p. LAWN CARE: Provided by LANDLORD. q. QUIET ENJOYMENT: No RESIDENT(S) shall disturb the quiet enjoyment of neighbors. RESIDENT(S) shall be responsible for all guests and invitees actions on the Contracted Property and the Complex. RESIDENT(S) will be charged a $100 fine for their first noise or disturbance offense. RESIDENT(S) will be charged a $200 fine for a second noise or disturbance offense. A fine in no way constitutes LANDLORD S right to waive eviction proceedings (breach may be asserted for any noise or disturbance offense notwithstanding the fines.) There shall be no soliciting at the Complex. RESIDENT(S) shall notify the LANDLORD/management immediately of any solicitation taking place at the Complex. Contracted Property shall be kept up, clean and habitable as described in the Lease Agreement. RESIDENT(S) shall not disturb the enjoyment of other residents in the structure or neighborhood. Trash, bikes, toys and other belongings shall not litter the property. Misuse of the property, and neighbor's complaints will be taken seriously. Quiet, clean, and peaceful enjoyment is a must. Anything less will be considered a violation of the lease and appropriate action will be taken. VIDEO GAMES AND MUSIC: video games/ TV /music can be heard through the walls at loud volumes. Volume must be at a level that doesn t disturb neighbors. RESIDENT(S) agrees to limit playing of such equipment between the hours of 10:00 p.m. and 7:00 a.m. to a volume that cannot be heard by persons outside of the Contracted Property. RESIDENT(S) agrees not to play televisions, radios, musical instruments or musical playback equipment in a manner which disturbs other tenants, and shall maintain the volume of such equipment at reasonable levels. r. FIREPLACES: RESIDENT(S) who have Contracted Property with a fireplace should use these with care. It is the responsibility of the RESIDENT(S) to dispose of ashes by properly bagging after the ashes have cooled, and place in the dumpster or trash. s. TRASH: All trash and garbage shall be bagged and placed in dumpster. Remove trash promptly and regularly. No trash shall be left in front of the Contracted Property front/back doors or on balconies, decks, or patios. A $100 fine will be assessed for each violation occurrence. All trash is to be placed in dumpster and not left on the ground. Summer Tree Townhomes, Gateway Court Apts., and 901 Illinois have dumpsters provided. Jana Drive Duplexes have City of Lawrence trash cans. t. SATELLITE TV: Satellite and dish TV is prohibited at all of our properties. Another option would include streaming. 3

u. FIREARMS AND EXPLOSIVES: All firearms, fireworks, and explosives are strictly prohibited at the Complex or in the Contracted Property, including but not limited to RESIDENT(S) vehicles located at the Complex. v. PESTS: All units are free of pests including, but not limited to, bed bugs, fleas, roaches, ants. RESIDENT(S) will be responsible for extermination of bed bugs, fleas, roaches, and any other pests brought into unit. Common house bugs, ants, spiders will be treated as needed by LANDLORD. w. SMOKING: Smoking is PROHIBITED inside Contracted Property. Smoking outside of unit must be done with caution and in an area that does not let smoke blow into neighbors windows, doors. All smoking materials must be extinguished properly and disposed of so as not to cause a fire. A $100 fine per occurrence will be assessed for non-compliance including but no limited to cigarettes butts on ground, ashes around Contracted Property and Complex. Smoking inside Contracted Property or inside any dwelling on the Complex shall be grounds for deposit forfeiture and additional fees to eliminate smoke damage/yellowing and removal of smoke odor. Please review Lease Agreement for detailed smoke policy. x. CLEANING: Total general cleaning for the unit will be added and charged the hourly labor charge. Full paint jobs less than 1 year old will be charged at labor + materials. Doors, woodwork, fixtures and other appliances/will be charged according to replacement costs plus labor. Holes in walls will be charged by amount of estimated labor at move out with a minimum charge of 1 hour. Carpet and ceramic tile damage is charged by the square foot. A large enough damaged area may require total replacement. Small stains and cigarette burns will be charged according to the extent of the damage. RESIDENT(S) responsible for bringing in fleas, roaches, bed bugs will be charged for all costs to cover professional extermination. Charges for loss of use of the unit will be on an individual basis. Odors including pet, smoke, grease, etc. will result in AUTOMATIC DEPOSIT FORFEITURE and additional charges to remove the odor. y. LOCKOUTS: In the event a RESIDENT is locked out of the Contracted Property during the hours of 8:00 am and 5:00 pm Monday-Friday, LANDLORD may unlock the Contracted Property at the LANDLORD S earliest convenience. Lockouts other than during the times of 8:00 am and 5:00 pm Monday-Friday may be unlocked at LANDLORD S discretion and will be charged a lockout fee of $25.00. APPLIANCES RESIDENT(S) should use appliances responsibly and according to directions. Any misuse will result in RESIDENT(S) being responsible for replacement and/or repair and labor costs. Dishes should be free of food before putting into dishwasher (commercials are not reality, food cannot be left on dishes in the dishwasher. Dishwashers are essentially used to sterilize). Leaving food on plates in the dishwasher will clog lines and cause a backup into the unit. RESIDENT(S) will be responsible for all plumbing costs related to plumbing issues caused by misuse. Garbage disposals are not to be used to grind up things other than food. Anything other than food like coins, glass, plastic, metal, etc. will break the disposal. Some food like large amounts of potato skins, roots, whole citrus fruits, watermelon rinds, need to be put in the trash. These can also damage the disposal. Never pour grease down drains. Dipose of grease in a container and throw in trash. Grease will clog the drain and potentially cause a major back up in the unit. Clothes dryers should never be overloaded. This can cause a fire and it will also take much longer for clothes to dry. A rule of thumb with all dryers is the drum should only be half to three-quarters full. This allows clothes to move freely and air to circulate and dry clothes thoroughly. Always remove gum, candy, food, pens, belts, coins, etc from all pockets. Remove lint from lint screen after every use. If lint isn t removed, it can cause a fire and will also contribute to clothes not drying properly. Washers should never be overloaded. Overloading a washer will cause it to overflow and cause water damage to the unit. Pillows and oversized comforters tend to float in a washer and cause water to overflow. If in doubt, use commercial washers at a Laundromat to wash large blankets,pillows, etc. Bathroom fan should be running during hot showers. This allows the steam to escape and keep it from causing moisture damage to paint/sheetrock. 4
