The application was for a 6.13 hectare ± (15 acre) oversized vacant parcel with relatively low agricultural capabilities. The lot had been rezoned to Country Residential One (CR-1) District. Manager Rosson provided additional information as follows: Dedication by Plan of Survey would be 10.06 metres for road widening along the parcel frontage to continue with the existing road plan. The Municipal Planning Commission discussed the following: Members asked about the existing subdivision on the quarter. Manager Rosson responded that the existing subdivision was a separate title and would not be considered. Members inquired as to why 10.06 metres was being taken on this Subdivision rather than the standard 5.03 metres. Manager Rosson stated that 10.06 metres was being taken to continue with the existing road plan. 2

Moved by: MEMBER DALE GERVAIS That the Municipal Planning Commission (MPC) APPROVE Subdivision application S14-028, for a Second Parcel Out Country Residential One (CR-1) District lot of a 6.13 hectare ± (15 acre) parcel within SE-20-69-6-W6, as per the reasons and conditions attached hereto as Schedule A : Reasons: 1. Conforms to all statutory plan requirements; 2. No concerns expressed from adjacent landowners; and 3. Consistent with other subdivisions in the area. Subject to the following conditions: 1. Access to the parcel and balance of the quarter to meet the standards of the M.D. of Greenview No. 16 at the owner/developer's expense. Please contact the MD s Road Supervisor prior to commencing any construction as well as prior to back filling and completion. If the owner/developer wishes to register the subdivision prior to the construction of the approaches, a security deposit shall be taken. The security deposit will be forfeited to the M.D. if the approaches have not been constructed and approved within one year. 2. Any outstanding property taxes are to be paid on the land to be subdivided, or arrangements made which are satisfactory to the M.D. of Greenview No. 16. 3. No development, construction, or site work is allowed without an approved Development Permit from the M.D. of Greenview No. 16. 4. Dedication by Plan of Survey of 10.06 metres for road widening along parcel frontage (to be surveyed by the municipality). Pursuant to Section 662(a) of the MGA, owner/developer must: a) Sell 10.06 metres for future road widening to the M.D. of Greenview No. 16 in accordance with the MD Schedule of Fees; or b) Enter into an Acquisition of Land Agreement with the M.D. of Greenview No. 16 to allow purchase of 10.06 metres for future road widening, to be registered against the balance of the quarter by caveat along the balance of the quarter adjacent to Township Road 693 & Range Road 64. 5. This subdivision must be registered by Plan of Survey. 6. You may be located in the vicinity of an agricultural operation. Minutes of a Regular Municipal Planning Commission Meeting January 14, 2015 M.D. of Greenview No. 16 Page 4 Manager Rosson presented an overview of the proposed Subdivision application S14-047 in the Goodwin area, Ward 6. The application was to subdivide three (3) undeveloped vacant parcels. The lots were zoned Country Residential One (CR-1) District. Lot One (1) was 1.96 hectares ± (4.85 acres), Lot Two (2) was 2.22 hectares ± (5.49 acres) and Lot Three (3) was 2.22 hectares ± (5.49 acres). Manager Rosson provided additional information as follows: Approval of the subdivision required that the internal road and approaches be built by the landowner within one year s time. One time extension would be allowed if necessary but after two years time, a new Subdivison application would have to be submitted. This would be identified in the notice of decision to the Applicant. The Municipal District of Greenview No. 16 would request a density test because it would have become a municipal road owned by the Municipal District of Greenview No. 16. It was the responsibility and expense of the landowner to construct the road and approaches. If the landowner changed the location of the building site on the lot and needed the approach relocated, it would be the responsibility of the landowner to submit a Private Approach Construction application. The Municipal Planning Commission discussed the following: Members inquired as to why the internal road was ten (10) metres wide instead of eight (8) metres wide. Manager Rosson replied that ten (10) metres was required for larger equipment to have adequate field access. Members discussed the condition of base and paving of the internal road and approaches at the landowner s expense. Manager Rosson indicated that base and paving was only for the approaches but would receive verification from Construction and Maintenance Manager Sklapsky. BACKGROUND / PROPOSAL: The information provided came in from a Landowner in the Grovedale Ward 8 area on SE 5-69-8-W6M, Schedule B further describes the location and area in question. The Landowner first contacted the MD planning department, January 30, 2014. Pertaining to concerns over a small unnamed lake behind their house was being drained, as well as trespassing concerns. At that time administration explained, that there was only certain considerations that the Municipality could make within their legislative authority. Concerns over water where required to be addressed by Alberta Environment, and concerns over trespassing required RCMP involvement. However MD staff provided contacts, emailed aerial s, as well as requested the Land Owner keep the department informed. The Landowner contacted the MD with the concerns and expressed their frustration over other ongoing matters. The Land Owner was informed that the MD Planning Department, and the Municipal Planning Commission (MPC) only had control over specific Planning and relevant consideration. However an invitation was put out to the Landowner to provide them an opportunity to address and or send in information via the Planning Department to present to MPC and express their concerns to the Commission whereby making them aware of the situation, as for them to use the relevant considerations as the Commission deemed appropriate. OPTIONS - BENEFITS / DISADVANTAGES: Options Motion that the Municipal Planning Commission receive the attached information as correspondence, as well as the information provided by staff and Land Owner. Received by email February 3, 2015 at 9:06p.m. Schedule A Land Owner Concerns In the late fall of 2013, we decided that we wanted to put our vision in motion. Our vision to create and establish a remote relaxing, very private place for people to escape and enjoy what Mother Nature has given us. We were going to build a road into our beautiful quarter of land, and put up some kit cabins and the guest could enjoy the peace and the lake. Prior to moving forward we did some homework, contacted our MD office to Inquire what legal steps we needed to take and make sure that we met all requirements to build a road. Next we contacted a few individuals to see if there was any interest in staying at such a remote location. We had a company request that If we built caving they would book them for 6 months at a time. This would allow their employees to travel less and safe time and money for all parties. This would also allow us to stay closer to home and fulfill our dream of working for ourselves. Derrick and I went for a walk to our piece of land, when we got there it was to our surprise that there was no longer any water in the lake. The lake that would be the feature point of it all. We decided to go for a drive up the hwy to find a quarter of land kiddie corner us that was extremely busy with water hauling trucks. We decided to pull in and see what was going on... -there was a containment the size of a football field as full as could be in the middle of January -there were water access and top soil signs -large hoses pumping all the water into trucks ( being hauled for fracs) We decided to call the number on the sign and ask how they enjoyed being super busy, and if they had any idea where they were getting their water from. The answer was rather cocky and then humble. An employee agreed to meet us and walk our land to see the lack of water for himself. He was very surprised to see the water levels dropped as you could clearly tell by the lines on the trees, the dry beaver dams. We then walked to their property to show him the connect between both properties. Derrick asked he if could walk around the containment, the employee was very firm that we not look to much or take any pictures. Which was fine, as we were able to fly it days after. - there were trenches dug, to re direct the flow of the water that fill the Iroquois creeks. - suddenly the busy water hauling facility was abandoned and everything was hailed our of there. Derrick and I hired a lawyer, contacted Alberta environment, and did what steps we felt necessary. After a few months went by, we were contacted by secure energy for a face to face meeting. We decided that we would drop the lawyer and deal with the company on a neighbourly manner. We went to the meeting with Dan Stienke and Greg smith. - Dan is a leader of the grande prairie office - Greg smith is the environmental guy. - Greg used to be the boss of the people at Alberta environment ( major conflict of interest) - we were laughed at, and I quote " oh so, some little guy farmer finds out an oilfield company bought the land and is looking for a cheque" - we were promised that come spring the trenches that were dug would be filled in as soon as the ground became to thaw. ( that never happened) It is now May and nothing has moved forward except for some empty promises. Alberta environment officer Mr. Marqotte, had informed us that he investigated the situation and then we have never heard a thing. We had an employee at the time take some pictures for us, as he was going to quit his job. He agreed none of what was happening was right. 175 Greenview, Alberta 3

After flying the area a few times to see that the big promise of filling in the trenches had not yet been done, I decided to call their office again and speak with Greg. He told me he would send someone out to do it soon. Thanksgiving comes and goes. Derrick though that maybe putting up a post on their Facebook page would maybe help us get a response. Well we did. They again replied with sheer ignorance to the whole situation and then deleted and blocked Derrick from being able to post. I took a screen shot the post and their reply. Stating that they knew nothing about it and would have someone contact is asap. - that did not happen. At the end of October Dan Stienke called me, asked me what it is we wanted done. I said that we no longer wanted to be pushed around, or under the carpet. I suggested to him that land is always for sale and he could make us an offer we could refuse. He didn't like my comment and accused me of blackmail. I decided to call CBC Global and CTV news, both answered immediately and were and still are very interested in this story. They believe that a public owned company should be transparent and that the shareholders have the right to know what they are up to and how they treat people or as they state a little guy farmer...... To top of all of this Shinanigans, which I kept as short as possible, this summer on a completely different parcel of land. Secure had sent out a group to spray. Some how some way they claim to have ended up and sprayed on of our crops. I have three people from the pembina plant who can confirm this. The group who was spraying said they were sent there by a supervisor and just doing what they were told. They had their supervisor call me. I believe her name was Lindsay. She told me that she wasn't aware that it was private property and basically left it in our hands. They didn't make a single effort to correct what they did. They did not have permission to be on our land. They did not care that we lost the majority of our field... They simply did NOT care. It kinda felt extremely personal, considering we are dealing with such matters on our other quarter. I am asking to have this brought to a meeting, and I would like to be put on the agenda for the feb meeting. I cannot send all the emails and pictures by email as the files are to large. I am asking for permission to allow a late submission of a file, perhaps I could bring it to our local office and they can send a hard copy directly to you. We are asking for your support, and to please not approve secures request to re zone, or what ever they are trying to do until they make things right with the locals out here.
