The repayment of the said loans is inter alia secured by mortgage of schedule mentioned property. The borrowers failed to pay the outstanding to the bank and therefore the borrowers were called upon to pay the amount due vide notice dated 30.12.2016 issued under Section 13(2) of the Act. It was made clear that if the payment is not made within 60 days, Bank will be constrained to exercise its rights by taking possession of the securities. As Borrowers failed to make payment, the undersigned took physical possession of the secured assets more fully described in the schedule hereunder as per the Possession Notice dated 27.07.2017. 5. The sealed covers will be opened by the Authorised on the date and time of sale. Offers which are not in accordance with the terms and conditions will be summarily rejected. 6. In case of receipt of more than one Offer by the Authorised Officer, the highest Offer will be accepted and the highest offeror will be declared as purchaser by the Authorised Officer. If two or more offers with equal sale price is received, the Authorised Officer may declare the successful purchaser by draw lots. 7. The purchaser shall deposit 25% of the amount of sale price offered (including EMD) on the same day of sale. The purchaser shall also execute such agreements, forms as may be required by the Authorised Officer for further proceedings of the sale. 8. The sale by authorized officer shall be subject to confirmation of the secured creditor Bank. The Bank reserves the right to accept or reject all or any of the offers of purchase or cancel the sale without assigning any reason thereof. 9. The balance 75% of the sale price offered by the Purchaser shall be paid within 15 days from the date of confirmation of sale by the secured creditor Bank or such other extended period as per agreed terms between the purchaser and secured creditor, in any case not exceeding three months. 10. In case of default in payment of the sale price as agreed by the purchaser and secured creditor Bank, the sale will be cancelled and the amount already paid by the purchaser will be forfeited to the secured creditor Bank and the property will be again put to sale. 11. Sale Certificate of the property will be issued in the name of the Purchaser only. Sale Certificate will not be issued in the name of any other person or to the purchaser jointly with any other person. 12.
