REMARKS: General: Sale held on behalf of B D Mount and Sons who have diversified their farming business. The sales venue has been moved the Grange Farm for ease of access. A decision has been made to partake in share farming as part of the businesses ongoing diversified strategy. Having farmed in Barkby for many years the family have an excellent reputation within the farming community. The machinery has been very well maintained and used over approximately 400 acres of arable cropping. Messrs Mount have retained some farm equipment to maintain the supply of home grown vegetables through their farm shop. Location: Syston Grange Farm is located on the Queniborough Road in between Queniborough and Barkby. The farm is accessed by the set of traffic lights. Payments/Cheques: Cheques: Intending Purchasers not known to the Auctioneers must produce, prior to bidding, an acceptable Banker s reference. CONDITIONS OF SALE: (1) The highest bidder shall be the Purchaser and if any dispute shall arise between two or more bidders, the Lot in question may be put up again and resold at the Auctioneers sole discretion. (2) Each Lot after being knocked down shall be considered as delivered to the Purchaser thereof, and the Auctioneers will not neither will any person in their employ, hold themselves responsible for the safety of such Lot. (3) Payment in full shall be made by the Purchaser to the Auctioneers on the day of sale and if demanded by the Auctioneers or their Clerk at any time during the progress of the sale shall be paid forthwith. (4) (a) The risk in the Goods shall pass to the Purchaser on the fall of the hammer, but the ownership (whether it be equitable, beneficial, absolute, legal or otherwise) of the Goods shall not pass until payment in full to the Auctioneers by the Purchaser of all sums due has been made. (b) Until the time of such payment, the following provisions shall apply: (i) The Goods shall be stored or kept separate and apart from other Goods and livestock belonging to or in the possession of the Purchaser. (ii) (iii) The Purchaser shall take proper care of the Goods. The Purchaser shall be deemed to have authority to deal with the Goods as if the Purchaser were the owner of them, but the Purchaser must account to the Auctioneers or all sums payable to the Purchaser by a third party as a result of any dealing with the Goods until such time as payment in full to the Auctioneers has been made. (iv) Any product, by-product or living thing derived from, produced by, born to or derived from that born to the Goods shall be the property of the Auctioneers and shall be stored and kept separate and apart from any product, by-product or living thing belonging to the Purchaser and the Purchaser shall immediately account to the Auctioneers for any consideration passing under any contract for the sale of such product or living thing. (v) The Auctioneers may enter upon any premises where the Purchaser has stored the Goods or the Auctioneers reasonably believe the Goods to be stored in order to re-possess the Goods. (5) If the Purchaser shall fail to make payment in full on the day of sale, interest at the rate of 2% above the base rate from time to time of the National Westminster Bank Plc shall be paid by the Purchaser on any balance owing by the Purchaser from the date of sale until the date of payment unless the Auctioneers shall decide to waive the Condition. (6) In these Conditions of Sale, the words the Goods shall be deemed to include all manner of things living or dead, including livestock offered for sale by the Auctioneers. (7) The Auctioneers reserve on behalf of both themselves and of the Vendor the right to bid on behalf of the Vendor. (8) Upon any Purchaser failing to comply with these Conditions, the Lot or Lots bought by the Purchaser may be resold by Public Auction or Private Treaty, at the Auctioneers discretion and any expenses incurred or deficiency arising from such resale shall be made good by the defaulter at the present Sale. (9) Strangers paying by cheque must before the Sale produce to the Auctioneers their Bankers or other references. (10) The Terms and Conditions herein cannot be varied by any person acting or purporting to act as Employee or Agent of the Auctioneers. (11) The Terms and Conditions herein shall not be affected by any previous dealings between the Auctioneers and the Purchaser. Each particular Sale shall be regarded as a separate and new Contract, having no relation to other Contracts between the Auctioneers and the Purchaser. (12) The Purchaser shall be bound by the Auctions (Bidding Agreements) Acts 1927 and 1969. (13) All Goods whether livestock or deadstock shall be taken to with all faults and errors of description as to barrenness, time of calving, health or otherwise. (14) Should any question arise not provided or in the foregoing Conditions, the decision of the Auctioneers shall be final and binding on the Purchaser.
