MINUTES ZONING BOARD OF ADJUSTMENT CITY OF RICHARDSON, TEXAS AUGUST 16, 2017 The Zoning Board of Adjustment met in session at 6:30 p.m. on Wednesday, August 16, 2017, in the Council Chambers, at the City Hall, 411 West Arapaho Road, Richardson, Texas. MEMBERS PRESENT: MEMBERS ABSENT: Brian Shuey, Member Shamsul Arefin, Member Jason Lemons, Alternate Marsha Mayo, Alternate James L. Menke, Chairman John Veatch, Vice Chair Chip Pratt, Member CITY STAFF PRESENT: Sam Chavez, Assistant Director of Development Services Connie Ellwood, Administrative Secretary BRIEFING SESSION Prior to the start of the regular business meeting, members of the Zoning Board of Adjustment met with staff to receive a briefing on agenda items. No action was taken. REGULAR BUSINESS MEETING Opening comments: Commissioner Shuey introduced City staff and explained the staff serves in an advisory capacity and does not influence any decisions the Board might make. Commissioner Shuey summarized the function, rules, and appeal procedures of the Zoning Board of Adjustment. 1. APPROVAL OF MINUTES FROM JULY 19, 2017. DRAFT Motion: Ms. Mayo made a motion to approve the minutes as presented; second by Mr. Arefin. Motion approved 4-0. 2. PUBLIC HEARING ON ZBA FILE V 17-08: A request by Desiree and Brad Johnson, for approval of the following variances to the City of Richardson Comprehensive Zoning Ordinance: 1) Article VII, Sec. 4(h)(1), to allow an attached carport in lieu of a required enclosed garage structure. Site location: 720 Winchester Drive, Richardson, Texas

ZBA MINUTES PAGE 2 AUGUST 16, 2017 Mr. Chavez presented regarding case V 17-08 720 Winchester Drive, a request to allow the installation of a detached carport in lieu of an enclosed garage structure. The subject property is zoned for the R-1100-M Residential zoning district as well as surrounding properties. The structure was built in 1958 with an attached garage as part of the principal structure but converted to living space. The applicants, who are new owners are requesting to construct an attached carport in lieu of an attached two car garage. Mr. Chavez said the Comprehensive Zoning Ordinance requires two (2) off-street parking spaces accessible from a driveway constructed of an approved parking surface and an enclosed garage behind the front building line to accommodate two motor vehicles. The required garage may be attached or detached from the principle building and the only area of concern for the current request was whether or not to allow the two car carport in lieu of the two car garage. Mr. Chavez concluded his presentation by stating it was the staff s opinion that a physical property hardship did not exist on the site. Ms. Mayo questioned if a new fence with a gate would be required as part of the access to the carport. Mr. Chavez indicated they would not be required to have a fence or a gate. With no further questions for staff, Commissioner Shuey opened the public hearing. Mr. Ronald Courtney, 802 Summerwood, Garland, Texas was present on behalf of the applicants. He explained there was currently a fence along the alley and a 24-foot mechanical gate would be installed at the opening into the carport area. He added the applicant was requesting this variance due to safety concerns of parking on a crowded street. DRAFT Ms. Mayo questioned why a carport was being built in lieu of a garage. Mr. Chavez clarified that an attached garage would have to meet the minimum setback for the main structure of 25 feet, and in this instance that was not possible. A detached garage could be installed and it would meet the current setbacks required for an attached or detached carport. Mr. Lemons inquired about the plan for the current driveway and how it would be utilized. Mr. Courtney indicated the residents would preserve the existing driveway. ZBA MINUTES PAGE 3 AUGUST 16, 2017 Mr. Arefin expressed that it was a good idea to keep the existing driveway to assist in providing off-street parking for visitors. He also asked when the construction would begin and how long it would take. Mr. Courtney responded that all plans were in place, (architecture and funds) and ready for construction to begin. No other comments in favor or opposed were received and Commissioner Shuey closed the public hearing. Mr. Arefin acknowledged installing a carport in the rear of the home inside the fenced area would not be a nuisance and would be safer for the residents as well as increase the value of the property. Mr. Lemons concurred with Mr. Arefin s comments. He also stated the request was a text-book example of a case being handled and managed properly by engaging the neighborhood. Motion: Mr. Arefin made motion to grant the request listed in Variance 17-08 as presented; second by Mr. Lemons. Motion Approved 4-0. Motion: Commissioner Shuey called for an action to adjourn the regular business meeting. Mr. Lemons made motion to adjourn the regular business meeting; second by Mr. Arefin. Motion Approved 4-0. EXISTING ZONING: R-1100-M Residential District EXISTING LAND USE: Residential SURROUNDING LAND USES: Residential STAFF COMMENTS: The subject residential structure was originally built in 1963. The attached garage that was part of the principal structure was converted into living space years ago by a previous owner. The current owner purchased the subject home in of December of 2016. The current owner proposes to build a new attached carport on the south (rear) side of the residential structure to replace the previously converted garage and, due to the location of an existing AT&T utility box, the proposed driveway from the paved alley to the property

line for the proposed attached carport is being reduced to ten (10) feet in width to avoid the AT&T utility box. As submitted, the applicant is requesting a variance to allow an attached two-car carport in lieu of the required two-car garage and to allow the driveway to be reduced to ten (10) feet in width. The Comprehensive Zoning Ordinance (CZO) requires two off-street parking spaces, accessible from a driveway constructed of an approved parking surface, in an enclosed garage structure behind the front building line to accommodate two motor vehicles. The garage may be either attached to or detached from the principal building. In addition, the CZO requires a minimum driveway width of eighteen (18) feet where parking spaces are nine (9) feet in width. As proposed, the attached carport conforms with the allowable rear yard setback for an attached or detached carport. If an enclosed attached garage was constructed the required twenty-five (25) rear yard setback could not be met; however, a detached garage could be constructed which would then be subject to the rear yard setback of an accessory structure, which is three (3) feet. The majority of the driveway meets the minimum driveway width requirement with the exception of the portion between the south property line and the existing paved alley as a result of the existing AT&T utility box. The applicant met with AT&T and was informed that the utility box could not be moved or made flush with the pavement as it served a very large service area. The applicant considered a J-Swing configuration of the driveway; however, the design would encompass the majority of the desired backyard. The owner states their hardship for requesting the variances is based on the lack of adequate covered off-street parking spaces and the existence of the AT&T utility box which requires them to narrow the driveway as the utility box cannot be moved or modified as opposed to constructing a J-Swing driveway which eliminates their desired backyard. (Article IV, Sec. 4(e)(3)). EXISTING ZONING: R-1500-M Residential District EXISTING LAND USE: Residential SURROUNDING LAND USES: Residential STAFF COMMENTS: The original 2,930 square foot single-story residential structure was constructed in 1967,with an additional 160 square feet added to the structure sometime afterwards, bringing the size of the structure to 3,090 square feet. The applicant intends to increase the size of the current home by constructing an additional 120 square feet of living space and an unenclosed front porch to the north side of the home.

The subject element of this request encroaches approximately four (4) feet into the platted 35-foot front setback, with an eighteen (18) inch roof overhang for the proposed unenclosed porch. To ensure that both the addition and the porch s roof eave are captured with the request, a total variance of 5.5 feet is being requested. The applicants stated hardship is unique in that the lot is encumbered with easements. A 7.5-foot wide utility easement is located along the entire length of the east property line and a 42-foot wide floodway and utility easement is located on the southern portion of the lot. Based on these encumbrances, the only side of the lot that could support an addition to the structure would be along the west side of the structure; however, a significant variance to the side yard setback would be required. TECHNICAL RECOMMENDATION: Variance Request: Based on the information provided by the applicant, and applicable codes and ordinances, it is staff s opinion that a property hardship does exist.
