What is an Accessory Dwelling Unit or ADU? granny flats in-law units backyard cottages secondary units Self contained dwelling unit (living space) with a full kitchen, bathroom and a place to sleep. Accessory to a principal dwelling. A manufactured home can be utilized as an ADU. 2

Background New State Law & Interim ADU Ordinance January 1, 2017, the State s new ADU law went into effect. March 14, 2017, the Board adopted the ADU Interim Ordinance. September 19, 2017, the Board provided direction on developing a permanent ordinance. March 13, 2018, the County s ADU Interim Ordinance will expire. 6
ADU Types and Sizing Requirements An ADU can be either attached, detached or located within an existing dwelling or accessory structure. Attached (Addition) (Up to 50% of principal dwelling or 1,200 sq. ft. max., whichever is less) 2. Detached Structure (1,200 sq. ft. max.) 3. Interior ADU (Conversion of existing space) (No size limits.) *An 1,800 sq. ft. detached/attached ADU can be developed on lots 40 acres or more in size 7
Interior ADUs under the New ADU Law Interior ADUs (Conversion of Existing Space) The ADU will be on a single-family zoned lot; The ADU is within the existing space of a single-family residence or an accessory structure; The ADU has it s own outside access, independent from the single-family residence; and The side and rear setbacks are sufficient for fire safety. If all the above conditions are met, local ordinance standards such as maximum unit size, minimum parcel size, parking space requirements, etc., may not be imposed. 8
ADU Parking Regulations Requirement reduced from one parking space per bedroom to one parking space per accessory dwelling unit. When existing parking spaces (i.e. garage/carport) are removed to accommodate an ADU, the replacement parking can be placed in any form including covered, uncovered, or tandem in a driveway. 9
ADU Parking Exemption No Parking is required if an ADU meets any one of the following criteria: ½ mile radius to public transit; The ADU is part of the existing primary residence or accessory structure (Interior ADU); When on-street parking permits are required but not offered to the occupant of the ADU; The ADU is located within a historic district; or When there is a commercial car share vehicle drop-off/pick-up within one block of the ADU (ex: zipcar). 10
Proposed Fire Hazard Impact Area Lots that are eligible for parking exemptions may still be required to provide onsite parking for their ADU if there is a conflict with fire access. 11
Other Regulations New ADUs that are rented out may only be rented for 30 consecutive days or more- no short-term rentals (Airbnb, VRBO, etc) ADUs cannot be sold separately from the principal dwelling Maximum one ADU per lot 12
