B RECOMMENDATIONS: A. THAT municipal lands along a portion of Arthur Drive at Ladner Trunk Road be dedicated for road purposes. B. THAT the Mayor and Municipal Clerk be authorized to sign all documents pertaining to the dedication of these municipal lands as "road". B PURPOSE: The purpose of this report is to seek Council approval for the dedication of certain municipal lands along Arthur Drive at Ladner Trunk Road for road purposes. II BACKGROUND: The construction of the intersection improvements on Arthur Drive at Ladner Trunk Road is now complete. One of the subject lands was acquired in 2012 for this project while the rest are parkland and are held in fee-simple by Delta (Attachment A). Staff wish to complete the process to formally dedicate a portion of the three properties as "road". B DISCUSSION: The goal of the Roads Right-of-Way Program is to have all constructed roads within the municipality dedicated for road purposes. The highlighted areas of Attachment Bare fee-simple lands of which Delta holds title. The dedication of these properties will formalize them as "road". Following Council's approval, the reference plan will be registered at the Land Title Office. The cost of doing this work relates to survey services and legal registration fees. The total cost to complete the process and have this plan registered is estimated at $5,000.

The 2013 Road Right-of-Way Program is approved works within the 2013 Capital Plan, as detailed on Project Detail Sheet, Roads -18 (Attachment C). II CONCLUSION: As part of the Roads Right-of-Way Program, it is recommended that portions of three municipally owned properties, shown in Attachment B, be dedicated for road purposes and the associated reference plan be registered at the Land Title Office. Program Overview: There are a number of provincial and municipal gazetted roads in Delta which technically do not provide legal access. The objective of this program is to inventory gazetted roads and submit applications to the Provincial Land Titles Office to have the provincial gazetted roads converted to dedicated road rights-of-way, ensure the integrity of the road network, protect utilities present in the roads, provide legal access to properties in the municipality, and confirm existence of and acquire rights-of-way for capital roadwork projects.
