CANDLEWOOD PARK CONDOMINIUM RULES AND REGULATIONS March 31, 2004 These Condominium Rules are adopted for the benefit of owners of condominiums at the Candlewood Park Condominium. They are intended to contribute to preserving the clean and attractive environment and to assuring the peaceful enjoyment of the condominium. They are also intended to protect and enhance the value of owners property. They are not designed to unduly restrict or burden the use of the property. Rules may be added, deleted or amended by the Board of Directors. All residents of the Candlewood Park Condominiums and their guests are expected to abide by these rules which are meant to supplement the provisions of the Declaration and By-Laws. 1. Additions to Exterior of Building: Changes affecting the appearance of the exterior of the building, such as decorations, awnings, television and radio antenna, signs, screens, porch and terrace sun shades and covers, air conditioning equipment, fans or similar changes are to be made only with the consent of the Board or Directors of the Candlewood Park Condominium. In the case of television antennas, if a master TV antenna or a community system becomes available, any antennas installed by owners pursuant to the consent of the Board must be removed regardless of whether an individual owner makes us of the master antenna or community system. Decks and patios may be screened in with the prior written permission of the Board of Directors. Owners wishing to screen in their patios or decks must submit a completed Balcony Screen Agreement to the Board of Directors. Owners Wishing to install slider storm doors must submit a completed Balcony Glass Slider/Storm Door Agreement to the Board of Directors. 2. Signs: No advertisements, signs or posters of any kind shall be posted in or on the property. No open house events for the purpose of selling a unit without prior written consent of the Board of Directors. 3. Hanging of Clothes etc: No clothes, linens or other material shall be hung or shaken from windows, placed on window sills or otherwise left or placed in such a way as to be exposed to public view. Outdoor clotheslines or other clothes drying or airing facilities are not permitted on the inside area of the decks and patios. Hanging plants may not be placed on the outside of the deck or patio or on the deck or patio railing.

4. Noise: Owners, guests and lessees are expected to reduce noise levels from 10:00p.m. to 8:00a.m. so that neighbors are not disturbed. At no time are musical instruments, radios, tapes, speakers, TV or noise levels to be so loud as to become a nuisance. If so call your local authorities. 5. Maintenance of Limited Common Area: Unit Owners shall be responsible for the maintenance of the entryway serving their unit, which is Limited Common Area. All Limited Common Areas shall be kept in a clean and sanitary condition. Only patio type furniture will be allowed on the decks. 6. Smoke Detectors: Unit Owners are responsible to maintain the smoke detectors within their unit. The smoke detectors must be tested at least once a year and a completed inspection form to the Board of Directors. The form will be provided by the Board of Directors. All rentals are mandated to have CO 2 Detectors. 7. Emergency Registration Form: All unit owners must submit a completed Emergency Registration Form to the Board annually. The form will be provided to the unit owner by the Board. 8. Littering: There will be no littering. Paper, cans, bottles, cigarette butts, food and other trash are to be disposed only in appropriate trash containers and under no circumstances are such items to be dropped or left on the grounds or other Common Area. 9. Trash, Refuse and Garbage: No one shall place trash, garbage or other refuse in the Common Area, except in the appropriate closed receptacle place in a location designated by the Board for that purpose. At no time is trash or other articles to be left outside the dumpster or on the grounds surrounding the dumpster. 10. Outdoor Equipment: Bicycles, sporting goods, baby carriages, lawn furniture and other personal articles and equipment, shall not be left outside a unit, and when in use on the Common Area shall be maintained and used in accordance with rule 13. 11. Maintenance of Common Area: Improvements, maintenance and landscaping of the Common Area shall be performed only by the association, except where permission of the Board is granted. 12. Common Area Storage: Owners are prohibited from storing anything in the Common Areas without prior written approval of the Board of Directors. This includes placing door mats or other personal items in the common hallways. It also includes the garage. Nothing is to be stored in the parking spaces or driving lanes in the garages.

13. Improper Use of Common Area: There shall be no use of Common Area which the Common Area or the plantings thereon, increases the maintenance thereof, or causes unreasonable embarrassment, disturbance or annoyance to other owners in their enjoyment of the condominium. Per the Fire Marshall for the safety of all concerned shoes, decorations, etc. are prohibited from being placed on the floor in front of or around the entryway serving the units. 14. Outside Activities: There shall be no organized sports activities, picnicking or fires, except in areas approved by the board. 15. Household Pets: Household pets will be allowed, pursuant to the Declaration as amended, but only with the prior consent of the Board of Directors. No more than (2) pets per unit are allowed. Consent so given may be revoked at any time, should the pet create a disturbance to others. Each owner will hold the Board harmless against loss or liability for any actions of his pets within the condominium. Please refer to the Pet Bylaws Amendment approved on November 25, 2002. NO DOGS ALLOWED. 16. Motorbikes, Boats Trailers, etc: No motor or mini-bikes, trucks, mobile homes, motor homes, boats, trailers, campers, snowmobiles or all-terrain vehicles shall be parked outside within the Condominium Association Property. 17. Speed Limit: The speed limit for all vehicles is 10 mph in the parking lots and on the Candlewood Park Roadways. 18. Children and guests: Owners and lessees shall be held responsible for the actions of their children and guests. If occupancy by guests creates a nuisance to other owners, the Board shall have the right to require that the offensive guests leave. 19. Action in violation of the Law, etc: These shall be no use of or activity in any unit or Common Area which shall be in violation of any government law, ordinance, rule or regulation. 20. Passkey: The Association requires a passkey to each unit. No unit owner may alter any lock or install a new lock, including deadbolts, on any leading into the unit of such owner without the prior consent of the Board. If such consent is given, the owner shall provide the Association with a key for its use. It is not intended that an owner s privacy be intruded upon, and such key shall not be used except in a personal or property emergency to gain access for the purpose of the maintenance or repair of the unit or of the Common Area. This key will not be used for lockouts.

21. Consent Revocable: Any consent or approval of the Board or it authorized agent given under these rules shall be revocable at any time. 22. Complaints: Complaints of violations of these rules should be made to the Board of Directors or Property Manager in writing. After investigation, if the complaint is found to be justified the Board of Directors will take whatever action it deems necessary. The complainant will be notified in writing by the Board as to what action has been taken. All complaints are kept in strict confidence. In order for the Board to act on a complaint the complaint must be signed. 23..Amendment: These condominium rules may be revised in any way at any time by the Board as conditions warrant, with written communication is sent to each Owner advising him/her of the changes within 30 days of adopting such changes. 24. Delegation of Powers: The Board, in its discretion, may delegate it powers and duties with respect to the granting of consents, approvals and permission under these rules, to any person or other agent. 25. Yard Sale and Other Activities: No yard sales, flea markets or similar activities for profit shall be conducted in a unit or on the Common Area without prior written approval of the Board of Directors. 26. Schedule of Fines: Violations of the Condominium Rules and/or restrictions on use of units are subjected to fines as posted in the adopted policy resolutions by the Board of Directors. i. Fines no specific Warning First Offense i. $50.00 Second Offense ii. $100.00 Third and Fourth Offense b. Failure to remit assessed fines and interest will result in the referral of the account to the Association s legal counsel and other such actions that may be deemed necessary to collect such. Legal fees, etc. associated with such referral or collection will be charged to the unit owner. 27. Vehicles: No vehicles other than cars or small vans and pick-up trucks use for an owner s transportation shall be parked or stored within the condominium property (MAXIMUM

TWO (2) VEHICLES PER UNIT). Tractors, trailers, walk-in vans, etc. and other commercial vehicles are strictly prohibited. Nor shall any unregistered or un-inspected or inoperable vehicles be kept on the property. Any vehicle with writing or advertisement will be considered commercial and may not be parked overnight on Association property. 28. Rental of Units: In addition to the requirements noted in paragraph 3(h) (i)and (ii) of the Declaration, the owner agrees to execute a written lease with any proposed tenant of a unit. A copy of the lease must be provided to the Board of Directors. The unit owner must submit a completed Rental Affidavit and a Moving Affidavit to the Board of Directors. The Rental and Moving Affidavit Form will be provided to the owner by the Board of Directors. Subleasing is prohibited under State Statue, in order to limit occupancy in accordance with paragraph 3 (h) (iii) of the Declaration. Each adult person who occupies the leased unit shall be considered a tenant and shall execute the written lease. 29. Occupancy of Unit: Occupancy is limited to no more than (4) persons per unit. Additional occupancy requires written consent of the Board of Directors. 30. Minimal Heat: During with winter season (November March), the heat in all units must be maintained at a minimum of fifty-five degrees F. This minimal heat requirement must also be maintained during any absence from the unit for vacation and seasonal relocations. 31. Open Flame Devices: All open flame devices, barbecue grills, etc are prohibited on the property. This includes propane, charcoal, electric and any other type grill. Grills of any type may not be used or kept anywhere on the property. 32. Smoking Restriction: Smoking in any of the Building Common Areas is prohibited. This includes the hallways, stairwells, garages, entrances and elevators. 33. Condominium Fees: Each owner must remit condominium fee payments on or before the first day of each month. All fees received after the fifteenth (15 th ) day of the month are considered late, and are subject to late fines and all collection procedures. Unsettled delinquent accounts may be referred to the Association s attorney for collection. Associated legal and collection fees and costs will be assessed to the unit owner. 34. Collection Policy and Procedures: When an account becomes fifteen (15) days delinquent past due the due date of payment, a $25.00 late fee will be assessed or as the Late Fee Policy may determent to be amended from time by the Board of Directors. An additional $25.00 late fee will be assessed for each thirty (30) days that the account remains delinquent. These late fees are assessed in addition to the actions outlined in paragraph 33

above. All accounts 90 days overdue are subject to a lien and sent to the Associations Attorney for collection. All cost to collect this debt are charged to the Unit. 35. Right of Appeal: All unit owners have the right of appeal for any Violation by submitting a written notice to the Board of Directors or its Agent within 30 days of the notice of violation. The Board will schedule a hearing on the merits of the violation within 45 days of receipt of notice. 36. This amended and revised Rule shall become effective after being signed by the Board of Directors and sent to all unit owners of record.
