Huisreëls 20 Oktober 2016 Ref/Verw: Zev Rules Huisreëls vir Zevendal inwoners van toepassing op eienaars en huurders. Die Trustees van Zevendal mag die reëls soos vervat in die dokument van tyd tot tyd aanpas om: die grondwet in stand te kan hou n aangename omgewing te skep vir inwoners te verseker dat wetlike vereistes nagekom word die waarde van u eiendom te beskerm Indien u onseker is oor enige aangeleentheid rig u versoek skriftelik aan die Landgoedbestuur. Normale landswette en plaaslike owerheidswette geld en geen reël wat in die dokument vervat is, het ten oogmerk om teenstrydig met enige landswette te wees nie. 2 A. VERANTWOORDELIKHEID VAN EIENAARS EN HUURDERS 1. Huurders sal hulself onderwerp aan alle gedragsreëls wat van toepassing is op eienaars. 2. Alle persone wat hom/haarself binne die kompleks bevind of toegang verlang op enige tydperk sal die sekuriteit in hulle aktiwiteite behulpsaam wees of hulself op aanvraag onderwerp. 3. Risiko situasies moet aangemeld word by die Sekuriteitskantoor of by die Landgoedbestuur 4. Alle eienaars is verantwoordelik om die heffing soos per begrotingsgoedkeuring op die Algemene Jaarvergadering ooreengekom stiptelik vooruit te betaal voor die laaste van elke maand t.o.v. die komende maand. Dit kan slegs per debietorder of via internet geskied. Indien n inwoner herhaaldelik versuim om die internet betaling teen die laaste dag van die maand te maak sal sodanige inwoner aangesê word om n debietorder te teken. 5. Indien u tydelik nie kan betaal nie, moet u vooraf skriftelik aansoek doen om uitstel van betaling, met vermelding van redes en voorstelle t.o.v. betaling, welke aansoek die Trustees in hul uitsluitlike diskresie sal oorweeg. 6. U moet u verkose Trustees ondersteun en hulle taak so maklik as moontlik maak sodat n effektiewe bedryfstelsel in stand gehou kan word. 7. Klagtes teenoor eienaars wat reëls oortree moet skriftelik by die Landgoedbestuur aangemeld word. 8. Rente op laat betaling sal gehef word huidige prima oortrekkingskoers plus 2% van ons bankiers. 9. Geen vullisstorting van enige aard binne of buite die erf sal toegelaat word nie, ook nie onooglike en opsigtelike opgaar van enige rommel, materiaal, of enige ander items of goedere. Dit geld vir bourommel tot papiere in die strate. Eienaars is verantwoordelik om huisbewoners en besoekers hieroor in te lig. Eienaars sal vir die boete verantwoordelik wees. 10. Huurders sal onderworpe wees aan die huur-addendum van Zevendal wat bepaal dat huurders se oortreding tot opskorting van hulle verblyf kan lei indien die ZHEV so sou besluit. In geval van n koste sal die eienaar die koste dra en vir die regstelling verantwoordelik gehou word. B. BOETES VIR DIE NIE-NAKOMING VAN ENIGE REELS, REGULASIES,KODES ENS. 1. Indien n boete opgelê word vir die nie-nakoming van hierdie Huisreëls, asook alle ander reëls, regulasies en kodes van die Trustees, sal die oortreder eers skriftelik aangemaan word. In welke aanmaning hy/sy versoek word tot nakoming van die reëls of staking van sy ongeoorloofde optrede, by versuim waarvan die Trustees dan, n boete mag oplê, betaalbaar soos bepaal deur die Trustees. 2. Indien n ernstige geval, of waar n aanmaning geen doel meer sal dien nie, mag die boete opgelê word sonder enige vooraf aanmaning. 3. In gevalle waar regstelling vereis word, mag die Trustees besluit om vir elke kalendermaand, waartydens die probleem nie reggestel word nie, n boete op te lê, welke boete mag ook maandeliks eskaleer teen sodanige persentasie wat deur die Trustees bepaal, en sal voortduur totdat die regstelling plaasgevind het. Die onus rus op die person. wie in versuim is om die Bestuur skriftelik in te lig dat daar aan die betrokke versuim voldoen is. Totdat dit gedoen is, sal die boetes geld en maandeliks voortduur (indien van toepassing). 4. Tensy die Trustees anders besluit, sal boetes teen die heffingsrekening gedebiteer word. 5. Boetes sal afsonderlik mag opgelê word vir elke oortreding, maar die Trustees mag hul met uitsluitlike diskresie ook n boete oplê op n gesamentlike, gespesifiseerde aantal oortredings.

3 6. a) n Persoon of Instansie aan wie n boete opgelê is en gegrief voel daaroor, moet binne 7 dae nadat kennisgewing daarvan ontvang is, skriftelik beswaar aanteken, met vermelding van die besware en gronde daarvoor, en dit by die Voorsitter of Landgoedbestuurder inhandig, met skriftelike ontvangserkenning van die dokument. (b) Hierdie besware sal dan op die eersvolgende Trusteevergadering bespreek word, verkieslik met die teenwoordigheid van die persoon in punt 6 vermeld. Dan sal n finale besluit geneem word met kennis aan die beswaarmaker, wie ook beperk teenwoordig mag wees. 7. Boetes wissel volgens die oortreding, van 'n minimum van R500 tot 'n maksimum van R1 000 (uitgesluit eskalasies). 8. Rente sal gehef word op boetes opgelê, teen 'n koers van prima plus 2%. 9. Die Trustees is gemagtig om reëls te vas te stel in oorleg met die Konstitusie. Wysigings aan die huisreëls sal aan alle eienaars gekommunikeer word en 14 dae sal toegelaat word om te reageer op die voorstel / wysiging en kommentaar of besware om te teken voordat dit uiteindelik goedgekeur word. C. BOUREËLS 1. Planne, op die standaard vir plaaslike owerheidsgoedkeuring, vir nuwe wonings, buiteaanbouings, veranderings, swembaddens en aanbou van mure moet aan die Trustees voorgelê word vir goedkeuring voor inhandiging by die Munisipaliteit. Planne moet deur n gekwalifiseerde tekenaar/argitek geteken word. 2. Alle aanpassings en of toevoegings van n roerende of nie-roerende aard wat esteties die aansig verander, van straat of groenarea af sigbaar of nie, moet deur middel van n goedgekeurde plan voorafgegaan word. 3. Ontwerpe moet aan die Guidelines en Addendum to the Guidelines for Zevendal Development voldoen. 4. Niemand mag sy nuwe woning betrek alvorens n Goedkeuringsertifikaat deur die Landgoedbestuur uitgereik is nie. Vorm 2. 5. Die deposito vir n nuwe woning beloop tans R 5000. n Aanbouing deposito beloop R3000 en n nuwe huis op die groot erwe beloop R 10 000. Die bedrae sal van tyd tot tyd aangepas word. Die geld word in Trust gehou en sal na uitreiking van die Goedkeuringssertifikaat aan eienaar terug betaal word. 6. Boudepositos moet teruggeëis word deur die eienaar, indien die deposito nie teruggevra word binne een jaar vanaf inbetaling nie, sal dit verbeur word en die fonds sal oorgedra word na die Zevendal kapitaalfonds. 7. Alle swembaddens moet omhein of bedek wees in ooreenstemming met die Munisipale regulasies. 8. Aanbouings en nuwe bouwerke sal nie goedgekeur word indien die eienaar uitstaande is op sy heffingsrekening of boetes verskuldig is nie. D. KONTRAKTEURS 1. Kontrakteurs mag slegs van Maandag tot Vrydag tussen 08:00 en 18:00 op die perseel werk verrig. Bestuur sal diskresie mag uitoefen om in verdienstelike gevalle of waar omstandighede dit regverdig vroeër toelating te verleen. 2. Indien n eienaar van n bestaande woning (gedefinieer deur die feit dat hy/sy in besit van n okkupasie Goedkeuringsvorm is) op n openbare vakansiedag of n Saterdag die dienste van n kontrakteur of tydelike werker wil gebruik, moet die eienaar namens die kontrakteur of tydelike werker by die hek kom inteken en vir die duur van die aktiwiteit op sy perseel wees

om toesig te hou (werker bly die verantwoordelikheid van die eienaar). Op sulke dae sal alle kontrakteurs (wat tuinwerkers insluit) teen 15:00 hulle aktiwiteite staak en die Landgoed nie later as 15h30 verlaat nie. Die aanvangstyd is 08:00 op Saterdae en openbare vakansiedae uitgesluit Kersdag, Tweede Kersdag en Goeie Vrydag. Dit is die eienaar se taak om by die hek te wees wanneer die kontrakteurs opdaag. Die sekuriteit sal u nie skakel in die verband nie. 3. Aansoek om laat of vroeg aflewerings kan aan die Landgoedbestuurder gerig word. Slegs eenmalige aansoeke sal oorweeg word. Geen vaste reël vir laat werk sal toegelaat word nie. Die doel van die reël is om ingelig te wees van aflewerings. 4. Indien noodgeval reël asseblief met Landgoedbestuurder sodat toestemming verleen kan word aan sekuriteit ter toelating van die kontrakteur. 5. Geen kontrakteur sal beplande werk op n Sondag, Kersdag, Tweede Kersdag of Goeie Vrydag op die perseel mag verrig nie. 6. Bouersvakansie sal vir een kalendermaand duur volgens diskresie van landgoedbestuurder. E. DIENSPERSONEEL 1. Huis- en tuinwerkers wat self by die hek aanmeld sal slegs van n tydelike kaart voorsien word indien die eienaar n Toegangspermit by die Landgoedbestuurder ingevul het ( Vorm 21). Indien u van huishulp verander is dit u plig om die aksie by die Landgoedbestuurder aan te meld en ons so te help met toegangsbeheer. 2. Dag werkers Casual workers moet ook by sekuriteit aanmeld en oor n geldige RSA ID beskik, die persoon wat die persone inbring moet seker maak dat hulle die dokument op hulle het. 3. Huishoudelike personeel sal nie toegelaat word om sonder identifikasie rond te dwaal nie. F. VERKOOP, VERHURING en GEBRUIK VAN EIENDOMME 1. Alle aksies om verhuring of om n verkoopsproses te begin word deur Vorms 10 en 11 hanteer. Dieselfde reëlings sal geld t.o.v. enige huurder wat wil onderverhuur. 2. Verkoopsagente moet registreer by die ZHEV. Die proses behels die invul en ondertekening van Vorm 9. 3. n Eienaar (of sy agent) wat beoog om n eiendom te verhuur, moet die huurder voorsien van n afskrif van hierdie reëls en n klousule in die huurooreenkoms invoeg in terme waarvan die huurder sal erken en toestem dat die Landgoedreëls bindend is vir hom/haar en deur die ZHEV op hom/haar afgedwing kan word. 4. Erwe mag deur eienaars of hulle aangestelde agente herverkoop word ooreenkomstig sodanige reëls en voorskrifte wat betref advertering, toegang tot die Landgoed, Te Koop/Te Huur-aanwysingsborde, reël van toonhuise ens., soos die ZHEV van tyd tot tyd redelik mag bepaal. Enige agent wat in gebreke bly om aan hierdie reëls en voorskrifte te voldoen, mag toegang tot die Landgoed geweier word. 5. Die volgende reëlings geld vir Sondae: a. Huise mag alleenlik op Sondae tussen 14h00 en 17h00 geskou word. b. Word vertoon borde mag vanaf 13h30 opgerig en nie later as 17h30 verwyder word nie. c. Tekens wat nie voor of op die bepaalde tyd verwyder word nie, sal deur sekuriteitspersoneel verwyder word en kan eers deur die Eiendomsagent teruggeëis word na betaling van n bedrag van R300 by die Besturende Agent in die ZHEV se bankrekening. d. Alleenlik 3 tekens sal in Zevendal toegelaat word; een teken voor die huis wat in die mark is en 2 rigting tekens. Geen vlae of enige vorm van advertering sal toegelaat word nie. Eiendomsagente se reklameborde mag vir vertoondoeleindes gebruik word. e. Tekens wat buite die grense van Zevendal in Langverwachtpad opgerig word, maak nie deel uit van die 3 toegelate tekens nie. 4

f. Slegs die Zevendal te koop bord mag gebruik word, behalwe wanneer die huis geskou word. g. Skade aan die besproeiingstelsel, of aan enige privaat oop ruimtes of eiendom, sal vir die rekening van die Eiendomsagent wees. h. Sekuriteitspersoneel moet vooraf voorsien word van die agent se naam, telefoonnommer en adres van die huis wat vertoon word. 6. Geen biljette, advertensiemateriaal, kennisgewings, of enige ander pos, papiere of dokumentasie mag op n deur-tot-deur- basis versprei of by eiendomme afgelewer word nie, behalwe deur die Bestuur van ZHEV self, tensy vooraf skriftelike goedkeuring verkry is, wat in die absolute diskresie van die bestuur sal wees en sonder opgaaf van redes geweier kan word. 7. Die eiendom is gesoneer vir residensiële-gebruik alleen en mag nie buite die perke van hierdie sonering gebruik word nie, ook mag geen advertensie-materiaal van watter aard en in welke vorm ook, aangebring en/of vertoon word op welke wyse ook al wat dit sigbaar maak aan andere. 8. Geen lid sal toelaat of toestemming verleen vir die akkommodasie van meer persone in n woonhuis wat die maksimum oorskry soos vasgestel in ooreenstemming met ondergemelde uiteensetting: 2 (twee) slaapkamers: 4 (vier) persone 3 (drie) slaapkamers : 6 (ses) persone 4 (vier) slaapkamers : 8 (agt) persone 5 (vyf) slaapkamers : 10 (tien) persone G. PERSEEL TOEGANG 1. Nuwe eienaars/huurders moet reëlings tref met Landgoedbestuur vir toegangskaarte. Indien u nie oor n toegangskaart beskik nie moet daar op die gebruiklike wyse aangemeld word (ingeteken word by die hek). 2. Besoekers te voet en per fiets/motorfiets moet ook inteken. 3. Die bestuurder van n voertuig wat as besoeker by die ingang opdaag, sal deur die proses van identifikasie moet gaan. Doel van besoek, wie u besoek en motor registrasie inligting moet aangeteken word. 4. Toegang van werkers op Saterdae: Sien toegang kontrakteurs. 5. Geen sulke tydelike werkers, uitgesluit bona fide inwonende huishulpe, sal op Sondae toegelaat word nie. 6. Kontrakteurs sal by intekening ook die getal persone op die bakkie of binne die motor invul. 7. Reëls vir kontrakteurs sal by die ingang beskikbaar wees en alle nuwe kontrakteurs moet van Vorm 7 voorsien word. Die vorm sal die reëls ten opsigte van kontrakteurs soos in die dokument vervat in opgesomde formaat weergee. 8. Die eienaar sal te alle tye verantwoordelik wees vir hulle werkers of besoekers se optrede en skade deur hulle as sodanig aangerig. 9. Geen persone sonder toegangskaarte sal na 22h00 toegelaat word nie. (Besoekers moet by die hek afgehaal word). 10. Roekelose, nalatige en/of onbedagsame bestuur sal nie toegelaat word nie. Voetgangers/kinders geniet voorrang. 11. Toegangskaarte wat onder valse voorwendsels bekom is, sal lei tot regsaksie. 12. In beide gevalle vermeld in punte 10 en 11 hierbo, sal toegang permanent geweier kan word. 5

6 H. VOERTUIE Verkeersreëls geld. Eienaars, Huurders en Besoekers : 1. Voertuie: Geen toegang vir vragmotor met sleepwa tipe swaarvoertuie is toelaatbaar nie. Die Landgoedbestuurder sal slegs per aansoek oorweging skenk vir vragmotors om grond of meubels of ander items te vervoer, indien dit n vragmotor is wat binne hierdie kategorie ressorteer. 2. Swaar afleweringsvoertuie word nie sonder goedkeuring van die HEV op Sondae en publieke vakansiedae toegelaat nie, of voor 08:00 en na 17:00 op weeksdae. 3. Voertuie: Wees bedag op kinders en troeteldiere. 4. Voertuie: n Maksimum spoed van 30 km/pu moet gehandhaaf word. 5. Voertuie, bote, karavane en sleepwaens: Geen parkering op u bure se grasperke, oop erwe of groenareas is toelaatbaar nie. Eienaars sal hul motorhuise as eerste parkering benut en nie die openbare pad nie. 6. Bote, karavane en sleepwaens: Indien sigbaar vanaf die openbare paaie moet die eienaar toestemming van die trustees verkry vir n beslissing oor die posisie van die staanplek en bedekking, indien van toepassing. Indien bedekking volgens trustees benodig word, sal die tipe bedekking ook bevestig word. 7. Motorfietse: Slegs gelisensieerde en padwaardige motorfietse mag gebruik word en dan slegs om na en vanaf die ingang na u woning te beweeg. Indien u onnodige enjin geraas genereer en aksies uitvoer anders dan teen luierspoed na die woning van besoekpunt te beweeg, sal u vervoermiddel verbied word. U sal dit dan buite die ingang moet parkeer. 8. Motorfietse sal ook n toegangskaart gebruik of sal moet inteken soos in die geval van motorvoertuie. 9. Vierwiel motorfietse: Die normale wetgewing geld: Geen van die tipe voertuig mag in die strate rondry nie. U sal dus die voertuig met n sleepwa van en na die ingang moet vervoer. 10. Motorherstelwerk moet binne-in motorhuise plaasvind. Take wat binne n uur afgehandel kan word is die afsnypunt vir werk wat in n oprit mag plaasvind. 11. Geen publieke vervoer sal op die perseel toegelaat word nie, behalwe nood- of wetstoepassingsvoetuie. 12. Geen vragmotors mag oornag op die perseel nie. 13. Alle voertuie moet deur middel van die sekuriteitswag toegang tot die Landgoed verkry, behalwe diegene aan wie die HEV n toestel uitgereik het om die toegangshek te beheer. Hierdie toestelle word vir persoonlike gebruik uitgereik en mag nie deur iemand anders gebruik, met iemand anders gedeel of aan iemand anders oorgedra word nie. 14. Die voertuigingangspermit vir inwoners, bly van krag nieteenstaande hierdie toestel. Hierdie toestel mag onder geen omstandighede gebruik word om sekuriteitsreëls te verontagsaam of te vermy nie. Indien wel, kan die toestel vanaf die sekuriteitstelsel verwyder word op koste van die wettige eienaar daarvan. I. BESOEKERS SONDER TOESIG 1. Dit is wel toelaatbaar as u huis beskikbaar stel aan familie, vriende of ander persone indien u vir die tydperk van maksimum een maand uitstedig is. 2. n Tydperk wat n maand oorskry sal outomaties as verhuring gesien word en sal die reëls vir verhuring geld.

7 3. Vooraf kennis van die eienaar aan die Landgoedbestuur in die verband is verpligtend vir sekuriteitsredes. 4. Sulke besoekers sal gesien word as dagbesoekers met n besoekerspermit, tensy daar met die Landgoedbestuurder n reëling getref word. 5. Slegs die eienaar kan vir so n besoekerspermit aansoek doen. 6. Die besoekers sal hulle ten volle aan die huisreëls onderwerp. J. GEDRAG 1. Hou u bure in gedagte ten opsigte van gedrag, algemene optrede/leefwyse, werkery van enige aard en geraasvlakke, veral wanneer u onthaal, sodat dit nie ʼn onnodige steurnis vir u bure veroorsaak. 2. Totale stilte moet gehandhaaf word gedurende die volgende tydperke: 1. Vrydag en Saterdae: vanaf 00h00 tot 06h00 2. Sondae tot Donderdae: vanaf 23h00 tot 06h00 3. Geraasvlakke is ook te alle tye onderworpe aan owerheidswetgewing in die verband. 4. Geen onwelvoeglike taal sal teenoor die sekuriteitspersoneel of mede inwoners geduld word nie. 5. Geen harde-balspel sal op private oop ruimtes toegelaat word nie. K. TROETELDIERE 1. Troeteldiere mag nie n steurnis vir ander inwoners wees nie. 2. Munisipale wetgewing rakende troeteldier/huisdiere, getalle, lisensiëring en alle ander bepalings en fasiliteite is ook hier van krag. 3. Honde mag nie toegelaat word om in die landgoed, sonder toesig, rond te dwaal nie. Eienaars van honde moet asseblief seker maak dat, wanneer die honde op n uitstappie geneem word, hulle die gemors wat hulle agterlaat, optel. 4. Honde moet ter alle tye binne die erf gehou word. 5. Boete van R500 sal gehef word vir rondloperhonde indien n skriftelike klagte en identifisering ontvang word. 6. Honde moet aan n leiband gehou word wanneer die diere vir n wandeling geneem word. 7. Honde moet te alle tye op die eienaar se perseel gehou word en onder geen omstandighede vrylik rondloop nie. 8. Indien enige inwoner of werknemer van Zevendal deur 'n troeteldier aangeval en/of beseer word, sal die ZHEV hul die reg voorbehou om 'n siviele saak te maak teen die troeteldier eienaar. 9. Niemand sal voortaan toegelaat word om per huishouding/eiendom meer as 2 honde aan te hou, of 1 hond en 1 kat, en as enige inwoner tans meer as 2 honde of katte het, sal hy/sy dit nie mag aanvul maar moet beperk tot die voorafgaande getalle na die dood van die ander honde/katte wat tans te veel besit word. 10. Indien n eienaar enige vrylopende troeteldier wil aanhou op sy erf, buiten honde en katte, moet die inwoner (eienaars en huurders)aansoek doen by die Trustees. L. VULLISVERWYDERING In ooreenstemming met die plaaslike owerheidreels en regulasies, sal die volgende geld: 1. Vullisdromme moet voor die huis geplaas word (tans op Donderdae) en na die verwyderingsproses so gou moontlik gebêre word. 2. Geen vullissakke mag buite die dromme gelaat word nie. Die drom se deksel moet altyd dig sluit.

3. Geen kartondose mag langs vullisdromme geplaas word nie. Kartondose moet opgeskeur en binne-in die vullisdrom geplaas word. 4. Geen boumateriaal of meubels mag voor u huis gelaat word nie dit sal nie deur die Munisipaliteit verwyder word nie. 5. Geen bourommel, sand, olie of metaalvoorwerpe (bv. enjinonderdele) mag binne dromme geplaas word nie, aangesien dit die munisipale kompakteertoerusting mag beskadig. 6. Onwettige storting van vullis sal vervolging tot gevolg hê. 7. Vullisdromme moet buite sig gehou word, behalwe vullisverwyderingsdae. M. INSTANDHOUDING VAN TUINE, HUISE,OPRITTE,ENS. 1. Alle verbeterings (geboue, opritte, mure, ens.) en tuine moet te alle netjies gehou word, in die besonder moet verfwerk behoorlik instand gehou en hernu word waar nodig, en grasperke, tuine, struike, bome, grasperke en enige ander aanplantings behoorlik onderhou en gereeld natgespuit en gesny word. 2. Tuinvullis mag nie op u perseel geberg word nie, maar in die vullisdromme wat aan u voorsien is, geplaas word of self verwyder word na die goedgekeurde munisipale stortingsterreine. 3. Geen los sakke mag langs die vullisdromme geplaas word nie. Die sakke sal nie deur die Munisipaliteit verwyder word nie. 4. Geen grassny of landskap aktiwiteite wat steurend vir bure mag wees mag voor 08h00 plaasvind nie. 5. Geen grassny of landskap aktiwiteite mag op Sondae plaasvind nie. Slegs normale tuinbou aktiwiteite wat nie steurend vir bure sal wees nie sal toegelaat word. 6. Indien n inwoner se tuin wat voor sy huis is, asook enige ander sigbare deel, of enige deel van sy geboue/verbeterings wat sigbaar is, hetsy van straatvlak of andersins, nie behoorlik netjies en in stand gehou word nie,sal die Trustees dit mag netjies maak/in stand hou op die koste van die eienaar, nadat skriftelike kennis gegee is aan die eienaar van beoogde aksies. Hierdie kostes sal van sy heffingsrekening verhaal word. N. GROENAREAS 1. Betreding en gebruik van groenareas geskied op eie risiko en die Huiseienaarsvereniging kan nie aanspreeklik gehou word vir enige skade gely of beserings opgedoen tydens die gebruik van die areas nie. 2. Die gebied is vir die inwoners om as ontspanningsarea te gebruik. 3. Alle aktiwiteite op die gronde moet ten alle tye ander persone, wat ook die park besoek, in ag neem. 4. Spanspele mag plaasvind waar die aktiwiteit veilig uitgevoer kan word. 5. Geen inwoners mag aan die besproeiingsapparaat verstel of dit verwyder nie. Probleme met die besproeiing moet by die Landgoedbestuur aangemeld word. 6. Geen blomme mag gepluk of plante verniel word nie. 7. Groenareas mag nie as parkeerplek of ryvlak vir enige tipe voertuig of sleepwa gebruik word nie. 8. Groenareas mag nie as tydelike stoorplek vir boumateriaal of rommel van enige aard gebruik word nie. 9. Geen vierwielmotorfietse of motorfietse mag op die groenarea rondry nie. 10. Geen georganiseerde partytjies mag gehou word op groenareas nie. 11. Geen spelery of enige ander aktiwiteite (bv. vang van vis) mag in die damme, waterslote of vleigebiede plaasvind nie. 12. Wasgoed mag nie sigbaar wees van enige parke of straat aansig nie. 13. Geen hardebal spele word toegelaat nie (bv golf, krieket, hokkiebal). Sagte bal moet gebruik word. O. OOP ERWE 1. Eienaars wat toestemming verleen aan n buurman om sy/haar erf as boumateriaal stoorplek of deurgang vir voertuie te gebruik, moet dit via die Landgoedbestuurder kommunikeer. Vorm 8 moet ingevul word. 2. Geen boumateriaal, rommel van enige aard, tuinvullis mag sonder die Landgoedbestuur op enige van die oop erf of groenarea geplaas word nie. Oortreding van die reël sal n onmiddellike boete tot gevolg hê. 8

3. Eienaars van oop erwe sal verantwoordelik gehou word vir die rehabilitasie van sodanige erwe wat hulle uitgeleen het en sal die koste van die herstel aktiwiteite moet dra. n Deposito van R1500 sal geld om die reël afdwingbaar te maak. Vorm 8. 4. Oop erwe sal maandeliks onder die Landgoedbestuur se toesig skoongemaak word. Eienaars is verantwoordelik vir die kostes. Eienaars wat voor die sewende van n maand self sny, volgens Zevendal standaarde, sal oorgesien word. P. WYSIGING EN AANVULLING VAN REELS 1. Hierdie reëls of enige deel daarvan mag van tyd tot tyd gewysig of aangevul word deur die Trustees en enige sodanige verandering of wysiging sal onmiddellik in werking tree sodra dit goedgekeur is deur die Trustees en in die notule van die vergadering aangeteken is. 2. Enige wysiging van hierdie reëls sal met 14 dae vooraf kennis aan alle inwoners vir kommentaar voorgelê word, alvorens dit in werking sal tree. Sodanige kommentaar sal dan eers deur die trustees oorweeg word voordat dit in werking tree, met of sonder wysiging, waarna die inwoners dienooreenkomstig in kennis gestel sal word. In geval van dringende gevalle, mag die Trustees afsien van hierdie reël. 3. Ingeval daar enige teenstrydigheid voorkom tussen hierdie reëls en enige ander beleidsdokument, sal hierdie reëls geld. 9

11 A. RESPONSIBILITIES OF OWNERS AND TENANTS 1. Tenants are subject to the same rules of conduct that apply to owners. 2. Security has the right to obtain assistance in the performance of their tasks from all persons present in the complex, or requiring access thereto. 3. Report any situation of actual or potential risk to either the Security Office or Estate Management. 4. All owners are responsible for paying the levy, as decided upon during budget approval at the Annual General Meeting, promptly in advance. The levy for any given month is payable on or before the last day of the preceding month. Only debit order or internet payments are accepted. Owners who repeatedly fail to make their internet payments by the last day of the preceding month will be instructed to sign a debit order. 5. If temporarily unable to pay the levy, apply in advance in writing for a concession, stating your reasons and payment proposals. The Trustees will then, at their sole discretion, consider whether to grant this application. 6. Support your elected Trustees by making their tasks as easy as possible, as this will assist in maintaining an effective management system. 7. Submit all complaints about persons who transgress rules, to the Estate Management in writing. 8. Interest will be levied on late payments calculated at our banker s prevailing prime overdraft rate, plus 2%. 9. No refuse dumping of any kind is permitted, either within or outside of your erf. This includes the visible accumulation of unsightly rubble, materials or other such goods and items. This provision covers the full spectrum from building rubble to litter in the streets. Owners are responsible for informing both occupants and visitors of this, as well as for paying any resulting fines that may be imposed. 10. Tenants are subject to the Zevendal lease addendum, whereby the ZHOA reserves the right to suspend the residence of tenants who transgress the rules. The owner is then responsible for any resultant costs incurred, as well as for any subsequent restitution that may be required. B. FINES FOR TRANSGRESSING RULES, REGULATIONS, CODES, ETC. 1. Where a fine is stipulated for transgressing any of these house rules, or any of the other rules, regulations and codes that the Trustees may impose, the offender will first receive a written warning. This warning will request him/her to abide by the rules and/or cease the offending behaviour, failing which the Trustees may then decide upon, and impose, a fine. 2. A fine may be imposed without prior warning for serious infractions, or when a warning no longer proves effective. 3. In cases where corrective action is required, the Trustees may impose a fine for each calendar month in which the problem remains unresolved. The Trustees may decide upon a monthly percentage by which to escalate this fine, to continue until the required corrective action has occurred. The onus is on the non-complying person to inform Management in writing that the issue concerned has been rectified. Until such time as this notification has been received, monthly fines will continue to apply (if applicable).

12 4. Unless the Trustees decide to the contrary, fines are debited against the offender s levy account. 5. Fines are imposed individually for each separate offence, but the Trustees retain the right to impose a fine for a specified joint number of offences. 6. (a) Any party who has a grievance concerning a fine received, must within seven days of receiving it lodge a written objection with the Chairman or Estate Manager. This objection must stipulate the grounds for the objection and supporting reasons. A written acknowledgement of receipt must be obtained. (b) The objection will then be discussed at the following Trustee meeting, with the complainant concerned preferably being present. A final decision will then be made and communicated to the complainant (who may also attend the meeting to a limited degree). 7. Fines vary in accordance with the offence, from a minimum of R500 to a maximum of R1 000 (escalations excluded). 8. Interest will be levied on fines imposed, at a rate of prime plus 2%. 9. The Trustees are authorized to house rules to suit under the Constitution. Alterations to the house rules will now be communicated to all owners and 14days will be allowed to respond to the proposal / amendment and comments or objections to sign before it finally be approved. C. BUILDING RULES 1. Plans for new residences, external additions, alterations, swimming pools and the erection of walls must meet the required standard for local authority approval, and be presented to the Trustees for approval before being submitted to the Municipality. A qualified draftsman / architect must draw up all such plans. 2. All alterations or additions that change the aesthetic appearance must be preceded by an approved plan, regardless of whether or not they are visible from the street and/or a green area. 3. Designs must comply with both the Guidelines and the Addendum to the Guidelines for Zevendal Development. 4. The Estate Management must issue an Approval Certificate (Form 2) before anyone may occupy their new residence. 5. The deposit for a new residence is currently R5 000. The deposit for additions is R3 000, while that for a new house on a large plot is R10 000. These amounts may be amended from time to time. These deposits are held in Trust, and are refundable upon issue of the Approval Certificate. 6. The owner must reclaim building deposits. Such deposits are forfeited if not reclaimed within one year of being paid, with the funds being transferred to the Zevendal capital fund. 7. All swimming pools must be fenced in or covered, as per municipal regulations. 8. Extensions and new building projects will not be considered for owners who are in arrears regarding the payment of fines and/or levy accounts. D. CONTRACTORS 1. Contractors may only perform work in the Estate between 08h00 and 18h00 on Mondays to Fridays. Management will exercise discretion and may, in deserving cases or where circumstances warrant it, allow earlier access to contractors. 2. The owner of an existing residence (defined as possessing an occupation Approval Certificate) who needs the services of a contractor or temporary labourer on a public holiday or a

Saturday, must sign in that contractor at the gate. It is the owner s responsibility to wait at the gate until the contactor arrives Security will not contact anyone in this regard. He/she must also remain at the premises for the full duration of the activity in order to supervise (during which time the contractor / labourer remains the owner s responsibility). The permitted working hours for these contractors on Saturdays and public holidays (of which Christmas Day, the Day of Goodwill and Good Friday are specifically excluded) are from 08h00 until 15h00. On these days contractors (including gardeners) will stop work by 15:00 and leave the Estate by not later than 15:30. 3. Apply to Estate Management for permission for early or late deliveries. This is required in order to keep Management informed of events. Only once-off applications will be considered permission for a standing arrangement to work late will be refused. 4. In the event of an emergency service, please arrange with Estate Management that Security receives permission to admit the contractor. 5. No contractor may perform scheduled work in the Estate on a Sunday, or on Christmas Day, the Day of Goodwill and/or Good Friday. 6. Builders holidays will last for one calendar month, at the discretion of the Estate Manager. 13 E. SERVICE STAFF 1. Domestic servants and gardeners who report to the gate themselves are issued with a temporary card only, provided that the owner has completed an Access Registration Form at the Estate Manager (Form 21). Please report any changes in your domestic help to the Estate Manager, in order to help us with access control. 2. Casual workers must also report to Security, and must possess a valid RSA ID book. The person responsible for such workers must ensure that the workers in question carry this document on them. 3. Domestic staff will not be permitted to wander within the estate without identification. F. SALE, RENTING AND USE OF PROPERTIES 1. Forms 10 and 11 cover all actions required for renting or initiating the selling process. The same stipulations apply to any tenant who wishes to sublet. 2. Estate agents must register with the ZHOA, by completing and signing Form 9. 3. An owner (or his/her agent) intending to rent out a property, must give the tenant a copy of these rules. The rental agreement must include a clause whereby the tenant acknowledges and agrees to the Estate rules being binding on him/her, and accepting the right of the ZHOA to enforce them on him/her. 4. Owners or their appointed agents may resell an erf, subject to the applicable rules determined by the ZHOA from time to time regarding advertising, access to the Estate, displaying For Sale / To Let boards, the arranging of show houses, etc. Any agent who transgresses these rules may be refused access to the Estate. 5. The following rules apply to Sundays: a. Houses may only be shown on Sundays between 14h00 and 17h00. b. On Show boards may only be erected as from 13h30, and must be removed by no later than 17h30. c. Security will confiscate any boards that have not been removed by the stipulated time, whereupon the Estate Agent must pay R300 into the ZHOA s bank account in order to reclaim them.

d. A maximum of three boards per show house are permitted in Zevendal; one in front of the house being marketed, and three giving directions to it. No flags or any form of advertising is permitted. Estate Agents advertising boards may be used for display purposes. e. Boards erected in Langverwacht Road, outside of Zevendal s boundaries, do not form part of the permitted three-board limit. f. Only the Zevendal For Sale board may be used when the house is not on show. g. Any damage caused to the irrigation system, private open areas or property is for the Estate Agent s account. h. Security personnel must be informed in advance of the agent s name and telephone number, as well as the address of the house on show. 6. Unless prior written consent to the contrary is obtained from the ZHOA Management, only ZHOA Management may distribute pamphlets, advertising material, notices or any other form of mail, paper or documentation to properties, whether door-to-door or by any other delivery method. Such consent is granted at Management s absolute discretion, and may be refused without providing a reason. 7. The properties have been zoned for residential use only, and may not be used for purposes that extend beyond the scope of that zoning. In addition, no advertising material of any form or nature that contravenes the zoning limits may be effected or displayed in any fashion that makes it visible to others. 8. No member will be permitted to provide accommodation for more individuals within a single residence, exceeding the maximum allowable as determined forthwith: G. ACCESS TO THE PREMISES 2 (two) bedrooms : 4 (four) people 3 (three) bedrooms : 6 (six) people 4 (four) bedrooms : 8 (eight) people 5 (five) bedrooms : 10 (ten) people 1. New owners/tenants must arrange with Estate Management for access cards. Should you not have an access card, you will need to sign in at the gate. 2. Visitors who arrive on foot or by bicycle/motorbike must also sign in. 3. An identification procedure exists for visiting drivers when they arrive at the entrance, which requires recording the purpose of the visit, whom they are visiting and their vehicle registration number. 4. Access for workers on Saturdays: See D. Contractors. 5. No temporary workers besides bona fide live-in domestic workers will be granted access on Sundays. 6. Contractors must record the number of people travelling on or inside their vehicle when signing in. 7. Rules for contractors are available at the entrance. All new contractors must complete a Form 7, which summarises the rules applicable to them. 8. Owners remain responsible at all times for the conduct of their workers or visitors, as well as for any damage that they may cause. 9. No access will be granted after 22h00 to anyone without an access card. (Visitors must be met by the resident at the entrance). 14

15 10. Reckless, negligent and/or inconsiderate driving is not tolerated. Pedestrians / children always have right of way. 11. Legal action will be taken regarding access cards obtained under false pretences. 12. Access may be permanently refused as a result of offences committed in terms of both points 10 and 11 above. H. VEHICLES The standard rules of the road apply. Owners, Tenants and Visitors: 10. Vehicles: No access to truck and trailer type heavy vehicles is permissible. The Estate Manager may only consider permission on an individual application basis for trucks within the mentioned parameters, when required for transporting earth, furniture, etc. 11. Heavy motor vehicles are not permitted within the estate without HOA approval on Sundays and public holidays, or prior to 8:00 and after 17:00 on weekdays. 12. Vehicles: Be alert for the presence of children and pets. 13. Vehicles: The maximum speed limit is 30 km/h. 14. Vehicles, boats, caravans and trailers may not be parked on a neighbour s lawn, open erfs or green areas. Owners shall first utilise their garage for the parking of vehicle/s and not the public road area. 15. Boats, caravans and trailers: Should it be visible from a public road, the owner must obtain the trustees permission regarding the parking spot s position and shade cover, where applicable. Should the trustees decide that a cover is necessary, the type of cover needed will also be confirmed. 16. Motorbikes: Only licensed and roadworthy motorbikes are permitted, and then only for travelling between the entrance and your residence. Excessive engine noise, or performing any actions besides travelling at idling speed between the entrance and your residence, will result in your bike being banned. You will then have to park it outside the entrance. 17. Motorbikes must also use an access card, without which the rider must sign in - as is the case with motor vehicles. 18. Four-wheel motorbikes: As per normal legislation, these vehicles may not travel on the streets - you must transport it in a trailer to and from the entrance. 19. All repair work to cars must occur inside your garage. Work performed in the driveway is restricted to those tasks that can be completed within one hour. 20. No public transport besides emergency or law enforcement vehicles is permitted on the Estate. 21. Trucks may not park overnight in the Estate. 22. All vehicles must gain access to the estate via security guards, except those that entered via a device issued by the estate to control the access gate. Said device is issued for personal use and may not be utilised by any other party, shared with another party or be transferred to another party. 23. The vehicle permit for residents will remain in force notwithstanding such device having been issued. The device must under no circumstances be utilised to circumvent security

16 regulations or to avoid them. In the event of any such contravention, the device can be removed from the security system for the cost of the legal owner. I. UNSUPERVISED VISITORS 1. You may make your home available to family, friends and other persons to stay in while you are away, for a maximum period of one month. 2. Any period lasting more than one month is automatically seen as being a rental agreement, and the rules regarding renting then apply. 3. The owner must give the Estate Manager advance notice of such arrangements, for security reasons. 4. Such visitors are regarded as being day visitors who require a visitors permit, unless prior arrangements are made with the Estate Manager. 5. Only the owner may apply for such a visitors permit. 6. Such visitors are fully subject to the house rules. J. CONDUCT 1. Be considerate towards your neighbours concerning your behaviour, general conduct / lifestyle, work activities of any kind and noise levels, especially when entertaining, so that these do not unduly disturb your neighbours. 2. Complete silence must be maintained during the following periods: 1. Fridays and Saturdays: from 00h00 until 06h00 2. Sundays to Thursdays: from 23h00 until 06h00 3. Noise levels are in all instances subject to the relevant local authority legislation that pertains in that regard. 4. The use of indecent language when addressing the Security staff or fellow residents is not acceptable. 5. No hard-ball playing is permissible on any of the open areas. L. PETS 1. Pets must not disturb other residents. 2. All municipal legislation applies concerning pets/animals kept at home, their numbers, licensing and any other provisions and facilities. 3. Dogs may not roam freely around the Estate unsupervised. Owners must please ensure that, when taking their dogs for a walk, they clean up any resultant mess. 4. Dogs must be kept on the owner s premises at all times. 5. A fine of R500 will be imposed for dogs found wandering around, should a written complaint be received identifying the animal concerned. 6. Dogs must be kept on a leash when being taken for walks. 7. Dogs must remain on the owner s premises. Under no circumstances may they wander freely around the Estate. 8. Should any Zevendal resident or employee be attacked and/or injured by a pet, the ZHOA reserves the right to open a civil case against the owner of the pet concerned.

17 9. No household/property is permitted to keep a total of more than 2 dogs or 1 dog and 1 cat any longer, or any combination thereof. Those persons who currently own more than two dogs and/or cats may not acquire any further such animals after any died, so as to comply with the aforesaid limit. 10. Any owner or tenant who wishes to keep any type of pet (besides cats and dogs) that is generally free-roaming on their premises, must apply for this to the trustees. L. REFUSE REMOVAL In conjunction with local authority rules and regulations, the following applies: 1. Leave your refuse bin in front of the house on refuse collection days (Thursdays presently), and remove it again as soon as possible after the refuse has been collected. 2. Place all rubbish bags inside the bin. The bin s lid must always be able to close properly. 3. Do not place cardboard boxes next to refuse bins. Fold/tear such boxes into pieces, and place them inside the refuse bin. 4. Building rubble or furniture may not be placed in front of your house the Municipality will not remove it. 5. Building rubble, sand, oil or metal objects (e.g. engine parts) may not be placed inside refuse bins, as they may damage the municipal rubbish compacting equipment. 6. The illegal dumping of refuse will be prosecuted. 7. Refuse bins must be kept out of sight, except on refuse collection days. M. MAINTENANCE OF GARDENS, HOUSES, DRIVEWAYS, ETC. 1. All added improvements (buildings, driveways, walls, etc.) and gardens must be kept neat. This applies specially to maintaining paint finishes, repainting when necessary, and regularly maintaining, watering, trimming and mowing lawns, gardens, shrubbery, trees and other vegetation that is planted. 2. Garden refuse may not be accumulated on your premises; either place it in the supplied refuse bin, or else take it yourself to an approved municipal dumping site. 3. Do not place loose bags next to the refuse bins. The Municipality does not remove such bags. 4. The mowing of lawns or any landscaping activities that could disturb your neighbours may not begin earlier than 08h00. 5. The mowing of lawns and landscaping activities are prohibited on Sundays. Only normal gardening activities that do not disturb other residents are permitted then. 6. Following written notification to the owner of their intention to do so, the Trustees may arrange that the visible portion of a resident s garden be kept neat and/or maintained, should the owner fail to do this. This also applies equally to any buildings / improvements that are visible from the street or elsewhere. The costs so incurred are the owner s responsibility, and will be debited to his/her levy account. N. GREEN AREAS 1. You enter and use the green areas at your own risk. The Home Owners Association accepts no responsibility for any damage incurred or injuries suffered while using these areas. 2. The green areas are intended as recreational sites for the residents. 3. Activities in these areas must always be considerate of other persons also present.

18 4. Team games are permitted if the activity concerned is exercised safely. 5. Residents may not adjust or remove irrigation apparatus. Report any problems with the irrigation system to Estate Management. 6. The picking of flowers and destroying of plants is prohibit. 7. Green areas may not be used as parking spaces, or as an area in which to use any type of vehicle or trailer. 8. Green areas may not be used as a storage facility for building material or refuse of any type. 9. No four-wheel or standard motorbikes may ride in the green areas. 10. No organised parties may be held in a green area. 11. No games or any other activities (e.g. fishing) are permitted in the ponds, irrigation troughs and/or wetland areas. 12. Washing (laundry) hung up to dry may not be visible from any of the parks or streets. 13. No hard ball games (e.g. golf, cricket, hockey) are permitted in the parks. A soft ball must be used. O. VACANT PLOTS 1. Owners who grant their neighbours permission to use their premises as a storage area for building material, or as a thoroughfare for vehicles, must inform the Estate Manager of this. Form 8 is used in this regard. 2. Building material or rubble / refuse of any kind may not be left in any vacant plot or green area without the Estate Manager s permission. An immediate fine will be imposed for transgressing this rule. 3. The owners of vacant plots are responsible for their rehabilitation after lending them out for such purposes, and must carry the cost of any such repair activities. A deposit of R1 500 is required in order to enforce this rule. Complete Form 8. 4. Vacant plots are cleaned on a monthly basis under Estate Management supervision, with the owners responsible for the costs thereof. Owners who perform the necessary maintenance activities themselves (to Zevendal standards) before the seventh of the month, are exempted. P. AMENDING AND SUPPLEMENTING THESE RULES 1. The Trustees may amend or add to these rules, or any part thereof, from time to time. Any such changes or additions made, once approved by the Trustees and recorded in the minutes of the meeting concerned, will take immediate effect. 2. Any proposed changes to these rules will be submitted to all residents for comment, 14 days before they are due to become binding. The trustees will consider any such comments received, and should the changes thereafter be implemented, with or without amendment from the original, the residents will be notified accordingly. The Trustees reserve the right to waive this procedure in the event of emergencies. 3. These rules will take precedence should they conflict with any other policy document. END
