There were two houses (9050 and 9126 70 th Ave SW), and two accessory buildings visible during the time of the site visit. According to the owners, the house located at 9126 70th Ave SW was built in the 1980's; however, the owners have recently been doing major renovations to the house including replacement of the foundation. The house located at 9050 70th Ave SW was built in 1970. According to the owners, there was a third house at 9044 70 th Ave SW, but it no longer exists. FINANCIAL: No financial implications to the CSRD at this time. KEY ISSUES/CONCEPTS: The Board gave Bylaw No. 2557 second reading at the July 21 st, 2016 Board meeting. A public hearing was held on August 16, 2016. It is now appropriate for the Board to consider third reading and adoption. Water According to the owner, the water source for 9050 70 th Ave SW is from Symes Brook, and the house at 9126 70 th Ave SW draws water from a well. If the redesignation/rezoning is successful, source of water will be addressed at the time of subdivision. Sewage Disposal According to the owner, the two existing single family dwellings are both currently serviced by individual on-site septic systems. If the redesignation/rezoning is successful, proof of an adequate sewage disposal for each lot will be required at the time of subdivision. Access Access to the property is from 70 th Ave SW in the City of Salmon Arm. Public Hearing The public hearing was held on August 16, 2016 at the CSRD office in the Boardroom. There were 7 members of the public in attendance, including the applicant. The applicant offered a covenant restricting future subdivision on the remainder lot to 2 lots. There were concerns regarding the subdivision affecting a spring that provides water to neighbouring properties and the potential for increased traffic in the area; however the applicant explained that he is offering a covenant restricting Page 2 of 4
Board Report BL2557 October 20, 2016 future subdivision on the remainder lot, and that the total number of lots created in this subdivision proposal will be 3. Staff is in receipt of a letter of undertaking from Leanne Rutley of Nixon Wenger Lawyers, dated September 27, 2016 stating that the covenant will be registered on title concurrently with subdivision. IMPLEMENTATION: Consultation Process As per CSRD Policy No. P-18 regarding Consultation Processes-Bylaws, staff recommended the simple consultation process. Notice of development signs were posted on the property on March 31, 2016, following first reading on March 17, 2016. No written submissions from the public were received by the close of the public hearing. SUMMARY: The proposal is to redesignate and rezone the property from R Rural to RR Rural Residential to facilitate a 3 lot subdivision. Staff is recommending that the proposed bylaw amendment be given third reading and adopted for the following reasons: There were no major concerns from the responding referral agencies; APC 'D' recommended approval subject to a covenant restricting further subdivision; There were no written submissions received; and, During the public hearing, some residents had some concerns about the potential impact the proposed subdivision may have on the surrounding properties, but the concerns will be dealt with at the subdivision stage.
