THE CORPORATION OF THE TOWN OF GREATER NAPANEE BY-LAW NO. 2012-38 BEING A BY-LAW TO AUTHORIZE: 1. The stopping up and closing of a certain part of Part of Lot 12, Concession 11 and Part of the Road Allowance (Highway) between Concessions 10 and 11, Geographic former Township of Richmond, Town of Greater Napanee, County of Lennox and Addington; and 2. The selling of the soil and freehold of the said part of the Road Allowance (Highway) stopped up and closed; WHEREAS it is deemed expedient by the Council of the Corporation of the Town of Greater Napanee that a portion of the road allowance, more particularly described on Schedule "A" attached hereto (the "Highway") be stopped up an~ closed and the land sold to the adjoining landowner; AND WHEREAS as per Section 34(1) of the Municipal Act, 2001, S.O. 2001, c. 25, before passing a by-law for permanently closing a Highway, a municipality shall give public notice of its intention to pass the by-law; AND WHEREAS notice of the intention to pass this by-law has been published for two consecutive weeks in local newspapers; AND WHEREAS Council has given any person who claims that his/her land will be prejudicially affected by this by-law an opportunity to be heard at a public meeting held on October 9, 2012; AND WHEREAS Council has determined that the stopping up of the Road Allowance (Highway) described herein will not deprive any person of the means of ingress and egress to and from his/her land or place of residence over such Highway or, i~ the alternative, another convenient road or way of acces~ to his/her land or place of residence is provided; NOW THEREFORE, the Council of the Town of Greater Napanee enacts as follows: 1. That a certain part of the Highway, more particularly described in Schedule "A" attached here to, be hereby stopped up and closed. 2. That the Road Allowance (Highway) hereby stopped up and closed shall be transferred from the Town of Greater Napanee to the owner of the adjacent lands, being Chris Tyner and Crystal Tyner. 3. That consideration for the selling of the land forming the Road Allowance (Highway) to be stopped up and closed by this by-law shall be $1.00.

4. That the Mayor and the Clerk of the Corporation of the Town of Greater Napanee be and are hereby authorized to execute on behalf of the Municipality under corporate seal; such deeds and other documents as may be necessary to convey that part of the Road Allowance (Highway) which has been stopped up and closed by this by-law. 5. The rights and requirements of any and all utilities affected by the closure of this Road Allowance (Highway) shall be protected. 6. This by-law shall not take effect until a certified copy has been registered in the Land Registry Office for the Registry Division of Lennox and Addington (No. 29).
