THE CORPORATION OF TOWNSHIP OF RAMARA BYLAW NO. 21.9 BILL NO. 21.9 A BYLAW REGULATING MANDATORY WATER METER INSTALLATION ON ALL MUNICIPAL WATER CONNECTIONS WHEREAS Section 8 of the Municipal Act, 21, c.m.25, provides that a unicipality has the capacity, rights, powers and privileges of a natural person for the purpose of exercising its authority; AND WHEREAS Section 9 of the Municipal Act, 21 provides that Sections 8 and 11 shall be interpreted broadly so as to confer broad authority on unicipalities to: a) enable unicipalities to govern their affairs as they consider appropriate; and b) enhance their ability to respond to unicipal issues; AND WHEREAS Part II of the Municipal Act, 21 authorizes the Municipality to construct and operate water services and to require owners of property and buildings to connect to these services and to regulate the use of such services; AND WHEREAS Sections 8, 27, 3 and 31 of the Municipal Act, 21 authorizes the Municipality to enter onto property and into buildings to connect to these services and to regulate the use of such services; AND WHEREAS The Township of Raara has contracted the supply and installation of a water eter package on all existing unicipal water connections (referred to as the water eter progra ); NOW THEREFORE the Council of the Corporation of the Township of Raara enacts as follows: 1. DEFINITIONS 1.1 Council eans the Municipal Council for the Corporation of the Township of Raara. 1.2 Doestic water eans any water used for the purpose of huan habitation. 1.3 Municipal Clerk eans the person appointed by bylaw to be the Clerk for the Corporation of Township of Raara. 1. Property owner eans the person who holds legal title to the property. 1.5 Township eans the Corporation of the Township of Raara. Page 1 of 12

1.6 Water works eans a water distribution syste operated by the unicipality to provide residents with potable water, in the water service areas defined by the aps in Schedule A attached hereto. 1.7 Water eter package eans the water eter, dual check valve (backflow preventor), isolation valve, expansion tank, appurtenances and reote read pad. 1.8 Service charge eans the rate, as approved by Council, to be charged to each property owner connected to a water works for the supply of doestic water. EXISTING 2. WATER METER SUPPLY AND INSTALLATION CONNECTIONS 2.1 All connections to the water works as of the date of enactent of this by-law shall be equipped with a water eter package supplied and installed by the Township, through their agent Waco Municipal Products. 2.2 All eters shall be installed in an easily accessible area in a position selected by the installer that will ensure all water consuption will be registered by the eter, the eter face can be read, and the reote reading device can be placed on the outside of the building and wired to the eter. 2.3 All property owners are to proptly schedule an appointent for the installation of the water eter package when properly contacted for sae by the Township or their installer. 2. The property owner shall perit entry to the property and preises for the initial installation of the water eter package and any subsequent entry to the property and preises for the reading or repair of the eter. 3. PENALTIES EXISTING CONNECTIONS 3.1 Any property owner not peritting access for installation of a water eter package will be subject to an interruption of water service and/or increased flat rate service charges. 3.2 A property owner who refuses the initial installation will be responsible for all additional costs for a later installation.. NEW CONSTRUCTION.1 Any new construction in the water service areas described herein shall have a water eter package installed by a licensed pluber retained by the property owner at the tie of the new construction..2 The Township will supply the property owner with the water eter package at the tie of issuance of the Building Perit, and upon payent of all associated costs. .3 The installation of the eter package shall be in conforance with the Township Standards in accordance with the detail enclosed in Schedule B. 5. OPERATION AND MAINTENANCE 5.1 The eter package, once installed to the standards of the Township, shall not be changed or altered by any person except by persons authorized by the Township. 5.2 No person shall taper with or willfully daage a water eter. 5.3 If the eter is echanically defective, the cost of repairs shall be paid by the Township. 5. If the eter is daaged by the carelessness or neglect of any person other than an eployee or agent of the Township, the property owner shall pay to the Township the cost of aking the necessary repair to such eter. 5.5 Any leak that ay develop at the eter or its couplings shall be reported iediately to the Township for repairs. The Township shall not be held responsible for any daages resulting fro such leaks. 5.6 The property owner shall provide adequate heat in the preises to prevent frost daage to the eter. 6. ENACTMENT 6.1 Schedules A and B attached hereto shall be and for part of this bylaw. 6.2 All sections of this bylaw shall be deeed to be separate and independent and the invalidity of any section or provision thereof shall not affect the reaining sections of this bylaw. 6.3 This bylaw shall coe into force and take effect on the date of passing.
