Appeal of Planning Commission Denial - On March 19, 2015, the Planning Commission took action to deny special use permits and a tentative parcel map to subdivide a 2.52-acre vacant site into three separate parcels for development of: - a 3,000 sf fast food restaurant (Carl s Jr.) with drive-thru facility; - a 7,400 square foot (sf) church (New Trinity Community Church) with seating for 250 members; - a 6,100 sf building including off-site sale of beer and wine (ABC-Type 20) within the for a 2,500 sf 7-Eleven, 24-hour convenience store. 2

Alternative, Due to Changes in The Project: Council may wish to overturn the Planning Commission s decision of March 19, 2015 and adopt resolutions: - Approving PZ 14-500-05 (Special Use Permit), subject to certain findings and conditions; - Approving PZ 14-500-06 (Special Use Permit), subject to certain findings and conditions; and - Approving PZ 14-300-02 (Tentative Parcel Map), subject to certain findings and conditions. 18
Staff Recommendation That the City Council adopt a resolution: - Upholding the decision of the Planning Commission and denying PZ 14-500-05 (Special Use Permit); - Upholding the decision of the Planning Commission and denying PZ 14-500-06 (Special Use Permit); - Upholding the decision of the Planning Commission and denying PZ14-300-02 (Tentative Parcel Map). 19
