WHEREAS, the Merrill Field Airport Master Plan identifies the need to acquire certain lands adjacent to Merrill Field for the purpose of ensuring compatible land use in compliance with the Airport Master Plan; and WHEREAS, the Federal Aviation Administration (FAA) grant agreements encourage and require the Municipality of Anchorage ensure compatible land use around Merrill Field Airport; and WHEREAS, the FAA has approved the administrative process used to determine the market value of the subject property; and WHEREAS, property owner Hubert J. Sandoval has expressed an interest in selling the property to the Municipality of Anchorage (MOA) on a willing seller/willing buyer basis; and WHEREAS, on May, the MOA passed AR - giving Merrill Field approval to accept grant funds for the acquisition of this property; and WHEREAS, the acquisition amount may be adjusted depending on the fund account used to actual expenditures at time of closing; now therefore, THE ANCHORAGE ASSEMBLY ORDAINS: Section. The acquisition of the following described real property (hereinafter, the Property ) by the Municipality of Anchorage is approved: Lot, Block 0, Third Addition to the Townsite of Anchorage, according to the official plat filed February,, under Plat Number C-, filed in the records of the Anchorage Recording District, Third Judicial District, State of Alaska. The Property is approximately,000 square feet. Section. The property is to become a part of Merrill Field Airport Property under MOA and airport management authority.

The Merrill Field Airport Master Plan identifies the need to acquire certain lands along the west side of Merrill Field. The primary purpose of this land acquisition program is to eliminate deviations from airport design standards within Runway and Taxiway Object Free Areas and Runway Protection Zones and to ensure airport compatible land use. The Federal Aviation Administration (FAA) has consistently supported these land purchases to provide the airport with the authority to remove existing obstructions and to maintain a Runway Protection Zone for Runway -. The acquisition of Lot will enhance the safety of the airport by removing Non- Compatible land use residential development within the Runway Protection Zone for Runway -. After these obstructions are removed, the property will be revegetated for erosion control and will remain undeveloped. Over the past years, Merrill Field has had a Land Acquisition Program in place to prioritize land acquisitions as identified on the FAA approved Airport Layout Plan. The Land Acquisition Program has been very successful: There have been grant funded property acquisitions and grant funded building demolitions which have resulted in a safer environment for the aviation community and the general public. Currently, there are three remaining parcels recommended for acquisition along the west side of Merrill Field, which includes the subject parcel. All of these land acquisitions have been completed under a willing seller - willing buyer arrangement. The current property owner, Hubert J. Sandoval, has expressed an interest in selling his property to the Municipality of Anchorage. Subject to Assembly approval, the property owner and the Municipality of Anchorage will execute a Purchase and Sale Agreement whereby Seller agrees to sell his property to the Municipality of

The obligation of the Municipality to close on this agreement is expressly contingent on Assembly approval to give Merrill Field authority to acquire this property. A recent appraisal and review appraisal have established the fair market value of the property to be $,000. The not to exceed appropriation of $00,000 includes closing costs, appraisals, engineering, environmental study/assessment, and administrative costs. Merrill Field Airport anticipates receiving a grant in the amount of $00,000 from the FAA for the acquisition of the subject parcel; however, in recognition of the age of the seller, prior to actual receipt of FAA administered Airport Improvement Land acquisition funding the property may be purchased using Merrill Field funding on a FAA reimbursement basis.
