PLANNING DEPARTMENT Application for a Nonconforming Use Modification Dear Applicant: A nonconforming use (NCU) is a use that was lawfully established prior to the current requirements of the Pinellas County Land Development Code, but would be prohibited, restricted or further regulated under the updated Code. It is the intent of the Code to permit the continuance of nonconformities, but generally not to allow their enlargement, extension or expansion unless granted a modification approval. A nonconforming status runs with the land and is not affected by a change in ownership, however it will expire in the event of abandonment (for 180 days or more) or deterioration in excess of 50 percent of appraised valuation for tax purposes. Any use not legally established may not apply for nonconforming status and must be discontinued. An NCU may be verified via a Type 1 review by County staff. If you would like to verify an NCU, please fill out the separate NCU verification application. A verified NCU may be modified via a Type 2 review by the Board of Adjustment & Appeals. The modification (1) cannot result in a change of character or quality of the surrounding area, (2) must be compatible with the surrounding land use and zoning designations, (3) must comply with current dimensional requirements such as building setbacks, (4) must comply with the Comprehensive Plan level of service standards, and (5) cannot be expanded beyond the boundaries of the parcel of land it occupied when it became nonconforming. To assist you in completing this application and providing sufficient information upon which to base a decision on your request, we advise the following: 1. Read the application and instructions thoroughly before attempting to fill it out. 2. All items in the application must be completed. The burden is on you to provide substantial, competent evidence. Applications which do not provide such a showing cannot be approved. 3. The current owner of the subject property must sign the application. If the owner is a corporation, a corporate officer must sign under the corporate seal. These signatures must be notarized prior to submittal. 4. You must submit a survey and a concept plan, drawn to scale, showing the location and dimension of all existing and proposed structures, the use of each, spacing between structures, setbacks from all property lines, property dimensions, abutting streets, easements, clearly delineated off-street parking spaces and drives, and north point. 5. You are encouraged to file the application well in advance of the monthly filing deadline. Applications received past the deadline will be processed on the next scheduled cycle. 6. You or your authorized representative must be present at the public hearing to present the request to the Board. Presentations must include substantial and competent evidence showing the relevant criteria is met. Failure to appear may result in a denial of the request. 7. All information required in item 16 as well as a filing fee, must be submitted at the time of application. Incomplete applications will not be accepted for processing. The Board of County Commissioners assembly room, where the Board of Adjustment & Appeals meets, provides a variety of presentation formats for your convenience. On hand is a 3'X3' presentation table with an overhead camera for TV monitor presentation of photographs, overheads, poster boards, maps, etc., (easels are no longer needed). This equipment is designed to be user and audience friendly and will enhance your audio/visual presentations. County staff will be on hand to assist you with the set-up of your presentation and with the operation of this equipment. The time, place and date of all public hearings are available at the office of Development Review Services. The applicant, or authorized representative, must be present at any public hearing. In order to authorize an NCU modification, the Board must review the request against the criteria for granting NCU modifications found in Pinellas County Land Development Code section 138-203(e)(4). This section is very important since the applicant must demonstrate to the Board that the criteria have been met to warrant approval (attach additional sheet if necessary): (a) The proposal will not materially change the character or quality of the neighborhood where it is located: (b) The proposal will be compatible with the land use and zoning designations of the surrounding properties: 2

PINELLAS COUNTY INFORMATION SHEET FOR THOSE SEEKING REVIEW BY THE BOARD OF ADJUSTMENT & APPEALS 1. Be certain that the application is completely filled out and all requirements for filing the application are met. The Board of Adjustment & Appeals will not consider incomplete applications. 2. The Board of Adjustment & Appeals has the following powers: A. Review of requests for Type 2 Uses as provided by the Land Development Code. B. Review of requests for variance to the literal terms of the Land Development Code, and other sections of the Pinellas County Code, as authorized. C. Hear appeals of Type 1 administrative reviews. D. Review of requests for modification of verified nonconforming uses. 3. Note the property description section. The type of structure(s) presently on the land must be shown (e.g., Single family residence, one story real estate office, etc.) If there are no structures at all on the land, then the answer is none. 4. Proposed use and the effect of granting the application must be described. 5. Survey and concept plan, drawn to scale, showing the following: A. Location and dimensions of all existing and proposed structures. B. Dimensions of the lot C. Use of each structure D. Spacing between structures E. Setbacks from property lines F. Abutting streets and easements G. Clearly delineated off-street parking spaces and drives H. North point I. Curb cuts J. Proposed screening or buffering (together with type, height and dimensions) K. If the plan is larger than 11" X 17" twelve (12) copies shall be required. In the event the applicant does not submit a survey and concept plan meeting the above requirements, the Board shall not consider the application. 6. The complete applications together with the appropriate fee must be submitted to the Land Use & Zoning Division by the monthly deadline. Applications received after that time must be held over to the following month. Deadline times are available online at www.pinellascounty.org/plan. 7. Review of decisions made by the Board of Adjustment & Appeals is through the Florida Court System. 8.
