Dear readers, Welcome to the pages of our Newsletter! Within this newsletter we bring you again the insight into current issues in the field of land and soil policy of European Union and Slovakia. We bring you also summary of the most important information and events which took place or are being prepared in this field and in our Centre of Excellence. Is European Union prepared for Directive on Soil? As stated in the Report on the implementation of the Soil Thematic Strategy and ongoing activities (COM (2012) 46); (available at: http://ec.europa.eu/environment/soil/three_en.htm), soil as the part of environment faces several threats, such as climate changes, soil degradation, desertification, growth of the built-up areas, contamination etc. Back in 2006, European Union has already prepared a proposal for a directive on soil protection (COM (2006) 232) but there was no political will of member states to adopt it (available at: http://eurlex.europa.eu/legal-content/sk/txt/pdf/?uri=celex:52006pc0232&from=en). Janez Potočnik, current European Commissioner for the Environment, reiterates the importance of the framework directive on soil protection. He also concludes that it is necessary for the directive proposal to be revised within the meaning of commitments adopted in the 7 th Environmental Action Programme in order to ensure the efficient soil protection in EU. Opposition member states, especially Germany (opposition leader), France, Great Britain, Austria and Netherlands, still disagree with the regulation of soil protection through the framework directive. These states argue with the fact that the adoption of the directive will cause the violation of principle of subsidiarity, high costs for implementation, administrative burdens and overlapping the European directive with national legislations of member states. Therefore it is still questionable if there will ever be a political will to approve the framework directive on soil. Partnership Agreement of the Slovak Republic for the period 2014 2020 Partnership Agreement refers to whole support from European structural and investment funds in a particular member state. This document defines the strategy, priorities and conditions for Slovakia to efficient use of these funds in order to achieve the priorities of the Europe 2020 Strategy (available at http://www.partnerskadohoda.gov.sk/). Direct payments for farmers will be guided by new EU regulations Regulation (EU) No 1306/2013 of the European Parliament and of the Council of 17 December 2013 on the financing, management and monitoring of the common agricultural policy had replaced and repealed concurrently valid Regulations (EC) No 637/2008 and No 73/2009. In connection to this regulation were adopted the measures on financing, management and monitoring of the common agricultural policy and also the new rules for granting the direct payments (more information available at: http://www.apa.sk/index.php?navid=440).

Relating to regulations of the EU, in Slovakia was adopted the Regulation of the Government of the Slovak Republic No 19/2014 Coll. amending the Regulation of the Government of the Slovak Republic No 488/2010 Coll. on the terms and conditions for the provision of support in agriculture in the form of direct payments, as amended. Rural Development Programme of the Slovak Republic 2014 2020 Ministry of Agriculture and Rural Development of the Slovak Republic (MARD) published a notice about the proposal of strategic document Rural Development Programme of the Slovak Republic for programming period 2014 2020; available at: http://www.mpsr.sk/index.php?navid=262&id=8446. Programme is based on the following EU legal acts: Regulation (EU) No 1303/2013 of the European Parliament and of the Council laying down common provisions on the European structural and investment funds (ESI), Regulation (EU) No 1305/2013 of the European Parliament and of the Council on support for rural development by the European Agricultural Fund for Rural Development (EAFRD). The estimated budget for the Rural Development Programme 2014 2020 is EUR 2.079 billion; available at: http://www.mpsr.sk/index.php?navid=262&id=8472. Current project support of Rural Development Programme of the Slovak Republic 2007 2013 Within the project support of RDP 2007 2013, following measures have a current call (www.apa.sk): 1.1. Measure: Modernisation of agricultural holdings 1.2. Measure: Adding value to agricultural and forestry products Law on the protection and use of agricultural land tightens the rules on withdrawal of land On 27 February 2014 entered into force the Act No 34/2014 Coll. amending Act No 220/2004 Coll. on the protection and use of agricultural land and on amending Act No 245/2003 Coll. on integrated prevention and control of environmental pollution amending and supplementing certain acts. Amendatory act tightens rules on transformation of using agricultural land to the non-agricultural purposes with particular emphasis on protection of vineyards. Controversial act on acquisition of ownership of agricultural land Adoption of Act No 140/2014 Coll. on the acquisition of ownership of agricultural land and on amendments and supplements to certain acts, which entered into force on 1 June 2014 led to the wider public discourse. This Act transferred the legally binding EU acts such as Council Directive 88/361/EEC of 24 June 1988 for the implementation of Article 67 of the Treaty. Application practice will show whether new legislation will meet the objective by which the legislature justifies the adoption of this act: to reinforce legal instruments on agricultural land protection aimed not only to protect it against degradation and deterioration of its biological and physical state, but also to establish the legislation framework by definition of the criteria (especially professional criteria) which the acquirers of this land have to meet. Therefore it may be presumed that the legislature foresees that if the acquirer of agricultural land will be the person from agricultural business this will also ensure a legislation

framework of protection of this land, because within this Act there is no explicit provision on agricultural land protection. The Act defines clearly the range of potential acquirers of agricultural land by providing a preferential right for persons active in agricultural business. On the other hand, liberalisation of the Foreign Exchange Act (Act No 202/1995 Coll., Article 19a) and of Article 4, Section 1 of the Act on the acquisition of ownership of agricultural land allows new business entities to acquire agricultural land in Slovakia. Up to now, such entities could acquire this land only in case of inheritance (e.g. donation or sale of land to the close persons without Slovakian citizenship or persons residing outside of Slovakia). On the basis of the Act, MARD established Register of publication of offers for transfer the ownership of agricultural land available at: https://pozemky.mpsr.sk/. Will be the new act on land register progressive in comparison to modern cadastres in the EU? Geodesy, Cartography and Cadastre Authority of the Slovak Republic submitted a draft act on land register which passed through inter-ministry comment procedure. New act have to provide more clearly defined regulation of rights and obligations in the field of land register, establish unified legislation on geodetic and cartographic activities in the field of cadastre whose results are transferred into a land register and to set up legislative conditions for improving the operation of the land register. New regulation reflects a requirement for improvement and speeding up the registration of real estates, better access to the data in land register, increase of accuracy and thus certainty while localising the position and shape of real estate s on the surface. New act should enter into force on 15 July 2015. For more information see: www.lt.justice.gov.sk/material/materialhome.aspx?insteid=-1&mateid=7088&langeid=1 In comparison to modern land registers in EU member states, regulation on land register in Slovak Republic was not updated and failed to reflect the needs of contemporary society. For instance, the aim of this legislation in Netherland is to register transactions, provide information on ownership, geographical information and real estate information, such as information on purchase prices of houses, sold houses and flats, real estate information on public registers which are included also in cadastral maps. In addition to the most important data on each parcel and its owner, land register in Netherlands provides also the cadastral map showing, among others, the location of the house on the parcel. Research and Development in European Union Horizon 2020 Programme Horizon 2020 (http://ec.europa.eu/programmes/horizon2020/en) will be the main tool for implementing research, development and innovations in period 2014 2020. Participation on this programme is intended to all entities of national economy with special emphasis on small and medium enterprises (SMEs). The main pillars of Horizon 2020 programme are:

Excellent science Industrial leadership Tackling societal challenges (e.g. food safety, climate action and resource efficiency, etc.) Within the EU 2020 Strategy (under its Innovation Union initiative), European Commission's Directorate-General for Agriculture (DG Agri) established the European Innovation Partnership on Agricultural Sustainability and Productivity in order to accelerate the process of research, development and innovations in the EU through public and private partnerships of all stakeholders regardless the borders and sectors; available at: http://ec.europa.eu/agriculture/eip/index_en.htm. Jean Monnet Centre of Excellence current activities On 28 and 29 April 2014 took place a workshop Improvement of the EU legal acts understanding whose aim was to improve the clarity and interpretations of the EU legal acts for researchers and educational staff. This workshop was attended by PhD students, young researchers and teachers. Among other things, discussion of the Centre s members was focused on land valuation in Slovakia. They agreed, that the Bonited Soil-Ecological Units (BSEU) are already outdated and do not take into account the environmental requirements. Members also decided to initiate a meeting with competent authorities with aim to propose potential solutions or prepare the research project. Centre of Excellence also supported the issue of monograph: Bielek, P. Soil Manual Protection and Use, 2014 ISBN 978-80-552-1155-8 This monograph represents the first part of the comprehensive Soil Manual issued in Slovakia. It identifies and evaluates the basic parameters of Slovakia s soil cover, enables practical orientations for their regulations and compares the soils in Slovakia to soils in surrounding states (especially EU and OECD members). Monograph is for everyone who deals with issues of soil, e.g. students, teachers, decision makers, competent research institutions etc. (taken from the abstract of the monograph). Submission of project VEGA Members of the Centre of Excellence submitted a project VEGA Protection of agricultural land s area preservation in Slovak Republic. Main aim of the project is to analyse and assess the decrease of agricultural land s area in Slovak republic after 1990 depending on legislation and economic arrangements and to identify the reasons and impacts of this process. On the basis of analysis of already implemented agricultural land s area protection measures arising from the EU policy, there will be proposed some measures leading to preservation of agricultural land s area in Slovakia. Centre of Excellence initiated a regular membership of SUA in Global Soil Partnership (FAO, UN) http://www.fao.org/globalsoilpartnership/partners/en/

Member of the Centre prof. JUDr. Anna Bandlerová, PhD. attended a work stay in Wageningen and Apeldoorn, Netherlands. In the Institute of Agrarian Law in Wageningen she discussed the possibilities of cooperation of the Centre in the field of research and education activities related to the issues of agricultural land use and protection. In Apeldoorn, she had visited the land register to get to know its function in Netherlands. Member of the Centre JUDr. Lucia Palšová, PhD. attended the conference Land as a Resource which took place in Brussels under auspices of Janez Potočnik (European Commissioner for the Environment) on 19 June 2014. Objective of the conference was highlighting the importance of good land management to address European and global challenges, particularly in view of an increasing world population. It also tackled the shortcomings of the current European land use model. It was pointed out that decreasing of area and quality of agricultural land is global problem. European Union is ready for implementation of activities to preserve or increase the quality of its agricultural land. Until 2015, European Commission has to prepare an announcement Land as a Resource aimed to raise awareness of value of the land as a resource for key ecosystem services. Member of the Centre Prof. Pavol Schwarcz, PhD. attended a study stay in DG Environment. Aim of his stay was to discuss the current issues and trends of the land policy in the EU and Slovakia. What are the next plans of the Centre of Excellence? Centre of Excellence prepares a seminary Comparison of legislation on agricultural land in selected states of the European Union which will take place in October 2014. Aim of the seminary will be to gain knowledge on agricultural land ownership in selected states of the EU.
