INDIAN RIVER COLONY CLUB POLICY Date: October 23, 2012 SUBJECT: Membership 1. Purpose 1.1 To present the policy decisions of the IRCC Board of Directors concerning admission to membership, membership categories, and the rules and regulations applicable to each category. 1.2 In its more than twenty years of existence IRCC has had many membership categories and varied policies concerning each category as regards to admission to membership, use of amenities, fees and voting privileges. This policy document summarizes the current set of policies concerning those matters. 2. General: Current Membership Categories 4.1 Resident Members. Those members who own a home or lot within the subdivision of IRCC and have been issued a membership certificate. The holder(s) of each certificate shall be entitled to one vote in all Club matters. If spouses are not named in the certificate, both shall be considered Resident Members with respect to the use of IRCC amenities. Any person (or married couple) who holds title to real property within IRCC must apply for membership if he intends to live on that property. 1

4.1.1 Single Member. A single resident member is one who has acquired title to the property in which he or she resides within IRCC and has been approved by the Board for membership. This membership authorizes full use of amenities as well as voting rights in all matters presented to the vote of the membership. 4.1.2 Family Member. A family member is one who resides on the property, is on the title of the property for ownership normally as the spouse, and is approved for membership by the Board of Directors. Upon the death or incapacity of the member who holds title, membership does not transfer to the new title holder unless that person is the spouse. Another person who resides on the property with the member and is not the spouse, but is on the title of the property, will be considered a Family Member, but, as soon as that residency begins, that person will require a separate membership approved by the Board of Directors and appropriate fees will apply. Sibling dependents and/or legally defined dependents of the title owner(s) are considered as family members for the purposes of this classification. This membership authorizes full use of the amenities. Voting is not permitted for a family member unless that member also holds a membership certificate separate from the property owner(s). 4.1.3 Additional Family Member. An additional family member is an individual residing on the property of a resident member and is not a sibling or legal dependent. This category of individual will be required to receive approval of the Board of Directors to use the amenities and recreation facilities and will be assessed the required fees identified for an additional family member. No voting rights are authorized and he or she cannot be listed on the property deed. The sponsor s membership does not transfer to this individual upon the demise or incapacity of the sponsor. 4.1.3.1 With the approval of the Board of Directors additional family members may also use the golf course on a daily fee basis or they may avail themselves of one of the existing golf membership options. Single and double memberships are available. 4.1.3.2 Golf fees for additional family members will be charged to the IRCC member on a monthly basis. 4.1.3.3 Exception to Additional Fee. With Board approval, family and additional family members, as defined in 4.1.2 and 4.1.3, who reside in the member s residence in order to provide temporary (less than 180 days) care giver service may be granted an exception to the additional family member monthly fee during the period they provide such service. 4.2 Non-Resident Members. Those members who have been issued membership certificates, but do not currently own residential property and/or lot within IRCC. The holder(s) of each membership certificate shall be entitled to one vote in matters of IRCC business, with the exception of amendments to the Deed of Restrictions. If spouses are not named in the certificate, both shall be considered non-resident 2

members with respect to the use of IRCC facilities. Non-Resident members may not serve on the Board of Directors. 4.3 Other Members. Those members who have qualified for a limited membership. The Board of Directors may establish these other classifications of membership in IRCC and provide special procedures for application, membership requirements, and amounts of payment for memberships that differ from the provisions in Article III of the Bylaws. These other memberships shall not have voting rights in any matter of the business of IRCC. 5. Policy Statement: 5.1 General: 5.1.1 Applicants will be evaluated without regard to race, creed, sex or national origin. 5.1.2 All membership categories, except those listed in Section 4, above, and in this section, which have been entered into prior to January 16, 2006, are no longer available. Members in such categories are grandfathered per Board of Directors decision on December 16, 2005. 5.1.3 At least eighty percent of those holding membership certificates shall have served honorably in any of the seven United States uniformed services (active or honorably separated), their spouses, and their widows and widowers. Up to 20 percent of those holding memberships certificates may be persons who have never served as members of the uniformed services but who have been approved for membership in IRCC in accordance with the procedures specified in paragraph 3.4 of the IRCC Bylaws dated December 6, 2011. 5.1.4 All resident members must be persons qualifying for residence in a retirement community as prescribed by the Housing for Older Persons Act of 1955, as amended in 1999, which requires that at least eighty percent of IRCC occupied houses be occupied by at least one person who is at least fifty-five years old. With the exception of special cases approved by the Board of Directors, all residents of IRCC must be at least 21 years of age. Members who do not reside in IRCC must comply with the age guidelines of their membership categories as defined by the Board of Directors. 5.1.5 Prior to becoming members, applicants must be informed concerning IRCC Bylaws, Deed of Restrictions, this policy directive, IRCC governance and organization, membership requirements, contributions and fees, financial obligations of members and the nature of life at IRCC including amenities and activities. 6. Admission to Membership. 3

6.1 Only the Board of Directors will approve or disapprove an application for membership. An applicant may appeal a decision of the Board in writing within fifteen days of notification of the Board s decision. The Board will reconsider such appeal and make a final decision within thirty days of receipt of such appeal. No further appeals are available. 6.2 The applicant must provide a complete and accurate application in accordance with the information required in the application form contained in reference 2.3. Failure to do so will be cause to disapprove membership. 6.3. The applicant(s) must meet the requirements of paragraph A, above. In addition to the criteria in paragraph A, above, the applicant must provide sufficient financial information to ensure that he will be able to meet the financial obligations of membership and he must demonstrate his compatibility with the current group of members. 6.4. The procedures for processing the application for membership are contained in reference 2.3. 7. Other Categories of Membership. The following are the categories of other memberships that are available at this time: 7.1 Associate Member: Members in this category may use all of the amenities. Membership fee is a one-time, non-refundable fee set by the Board of Directors. 7.1.1 Memberships in this category will be limited to fifty. 7.1.2 Those applying for membership must be sponsored by a current member. 7.1.3 Members in this category will be required to pay monthly club dues, nonresident capital reserve fees and non-resident General and Administrative fees. No minimum annual club expenditures will be required. 7.1.4 Golf and Tennis fees will be charged monthly or on a pay-as-you-play basis at the resident member rate. 7.1.5 Vehicles, including golf carts, driven on IRCC grounds and roads must be registered with IRCC and properly insured. The golf course is restricted to cart use only; no walking permitted. Golf carts may not be trucked or trailered into IRCC. IRCC will provide for a fee, one cart for each two people playing golf with the same starting time. Privately owned golf carts may be stored at IRCC for a monthly fee provided there are sufficient electrical hook-ups. 7.1.6 Members do not have voting rights in IRCC elections or meetings and may not serve on the Board of Directors. Members are expected to comply with the Bylaws, rules and regulations that affect other membership categories. 7.1.7 Membership may be terminated by the Board of Directors for cause after the member is once warned in writing of conduct inappropriate to the standards of the Club and the member s conduct does not improve. Members so terminated 4

may appeal such decisions. The subsequent decision by the Board will be final. 7.1.8 Double memberships are limited to persons residing in the same household. 7.1.9 A maximum of three guests are allowed for each membership for each round of golf or tennis outing. Guest fees will be those of a non-resident. Guests must be accompanied by the member on the golf course, the tennis courts, driving range, practice green, club, physical fitness facility and swimming pool. 7.1.10 Members in this category must not have permanent residents in their home below the age of 21. 7.2 Trial Golf Membership: Resident members who are not or never have been annual golf members may participate in unlimited golf play on a ninety day one-time trial basis. 7.2.1 Trial golf memberships may be single or double. Double memberships are limited to persons residing in the same household. 7.2.2 Members in this category man invite a maximum of three guests per membership to play. Guest will pay the scheduled green and cart fees as listed for Guest of a Annual Golf Member. The member must accompany the guests on the golf course. Guests must be properly attired (See paragraph 7.3.13 below) 7.2.3 Members may use their own golf cart provided it is properly registered and insured for use in IRCC and on the golf course. 7.2.4 Membership extends three consecutive calendar months beginning with the first month following application. 7.2.5 Memberships are limited to persons residing in the same household. 7.2.6 Members in this category may invite a maximum of three guests per membership to play. Guests will pay the scheduled green Fees will be paid on a monthly basis, and will be included in the member s monthly bill. Fees for the ninety day trial period will be at a rate of seventy five percent of the monthly fees for an annual golf member. 7.3 Seasonal Golf Member: The purpose of the Seasonal Golf Membership is to supplement IRCC s golf revenue and hold down costs to resident and non-resident fee paying members by attracting local residents particularly in the Viera area. This might be particularly attractive to Snowbirds. Neither Resident nor Non-Resident Members are eligible for this membership. Members in this category are exclusively limited to the use of the golf course, the pro shop and the 19th Hole lounge on a cash basis only. A one-time non-refundable administrative fee of $200 plus sales tax is required. 5

7.3.1 Membership is for a minimum of ninety (90) days. Memberships will begin and end on the first day of the month. Thirty days notification is required for cancellation of membership. If membership is not cancelled by the member or by IRCC, play and billing may extend indefinitely. 7.3.2 Double memberships are limited to persons residing in the same household. 7.3.3 A maximum of three guests are allowed for each membership for each round of golf. Guest fees will be those of a Guest of a Non-Resident. Guests must be accompanied by the member on the golf course, the driving range, the practice greens and the 19 th Hole. 7.3.4 Memberships in this category will be limited to fifty (50). 7.3.5 Membership acceptance will be in accordance with IRCC policy. 7.3.6 Vehicles, including golf carts, driven on IRCC grounds must be registered with IRCC and properly insured. The golf course is restricted to cart use only, no walking permitted. Golf carts may not be trailered or trucked into IRCC. IRCC will provide one cart for each two persons playing golf with the same starting time. 7.3.7 Members in this category will be required to pay monthly green and trail fees. A monthly contribution to the IRCC Capital Reserve will also be required. Fees will be in accordance with the current IRCC golf fee schedule. Use of members own carts will not result in a reduction of the trail fee. 7.3.8 Golf members do not have voting rights in IRCC elections and meetings and they may not serve on the Board of Directors. All members are expected to comply with the Bylaws, rules and other directives that affect other members. 7.3.9 Membership may be terminated by IRCC, with a thirty day notice, only under exceptional circumstances in accordance with procedures outlined in IRCC policy. 7.3.10 Members in this category are invited to join the social golf outings held at IRCC. 7.3.11 Golf fees required are as published on IRCC s current fee schedules. 7.3.12 Fees will be charged for all months in which the membership remains open. 7.3.13 All golfing members must be properly attired, i. e., collared shirt is required on the practice greens, driving range and the course; no cut offs or blue jeans are allowed. 7.4 Weekend Golf Member: This membership is similar in purpose, fees and restrictions to the Seasonal Golf Membership but members in this category may play only on Saturdays and Sundays. A one-time non-refundable administrative fee plus sales tax is required. The monthly fees are less than for Seasonal Golf Members. All of the provisions for Seasonal Golf Members cited above apply except for 3.j., above. 6

Weekend golf members are invited to join the social golf outing if they are held on Saturday and/or Sunday. Memberships in this category will be limited to fifty (50). 7.5 Town Square Member: Members in this category reside in the Wuesthoff Town Square Assisted Living Facility (ALF) and are eligible to use all facilities on a pay as you use basis. Requirements for application are: 7.5.1 Be a resident at The Town Square. 7.5.2 Apply for and receive approval of the Board of Directors for membership. 7.5.3 Be required to pay a one-time non-refundable initiation fee. 7.5.4 Be required to become a member of the IRCC At Ease Club and pay monthly dues only. 7.5.5 Not own property at IRCC nor have voting privileges. 7
