Planning Agenda Item R-8 Recommendation to Authorize the Execution of an IGA between the FPDDC and the County of DuPage for the Conveyance of an Easement for the Relocation of the Existing Path and Construction of Improvements within the Springbrook Prairie Forest Preserve Department Planning Meeting Date June 14, 2016 Staff Recommendation Authorize the execution of the IGA Previous Commission Action N/A Background In recent years, there have been incidents between vehicles and pedestrians at the Book Road crosswalk south of 75 th Street. This is partially due to the crosswalk and stop bar being located too far south which limits sight lines within a historically busy intersection. The DuPage County Division of Transportation received federal funds through the Highway Safety Improvement Program to perform some safety improvements at this intersection. Part of these improvements will include moving the crosswalk and trail connections 18 north and closer to the intersection. As the crosswalk will be relocated, the existing trail will need to be relocated within the ROW also. Grading associated with this relocation requires that the trail be re-profiled south and slightly into the preserve. The work will require a 0.15-acre temporary easement within the preserve to complete the grading work. Restoration of the temporary easement will comply with District standards. As Springbrook Prairie is a State Nature Preserve, District staff has confirmed with the Illinois Nature Preserves Commission that the proposed work is acceptable. As work will occur on our property, IDOT has required that the District sign the cover sheet of the plans as a non-participating project sponsor. The trail improvements will be constructed out of limestone gravel matching the District s standards. Rationale The District, with County approval, constructed the trail almost 15 years ago and has maintained the trail since that time. It is in the best interest of both agencies to allow the improvements to be constructed in order to provide better visibility at this crosswalk and reduce potential vehicle and pedestrian conflicts. Cost N/A Exemplifies intergovernmental cooperation for the public s benefit. The project is slated for a September letting with work beginning shortly thereafter. Funding Source N/A Public Impact The project will provide increased safety for users of the Springbrook Prairie trail system as well as the motoring public. RESOLUTION NO. 16-212 A RESOLUTION AUTHORIZING THE EXECUTION OF AN INTERGOVERNMENTAL AGREEMENT BETWEEN THE FOREST PRESERVE DISTRICT OF DUPAGE COUNTY AND THE COUNTY OF DU PAGE PROVIDING FOR THE CONVEYANCE OF AN EASEMENT FOR THE RELOCATION OF THE EXISTING PATH AND CONSTRUCTION OF IMPROVEMENTS WITHIN THE SPRINGBROOK PRAIRIE FOREST PRESERVE WHEREAS, the COUNTY and the DISTRICT are public agencies within the meaning of the Illinois "Intergovernmental Cooperation Act", as specified in Illinois Statute, 5 ILCS 220/1 et seq., and as authorized by Article 7, Section 10 of the Constitution of the State of Illinois; and WHEREAS, the purposes of the "Intergovernmental Cooperation Act" and Article 7 of the Constitution of the State of Illinois include fostering cooperation among governmental bodies; and WHEREAS, the COUNTY has prepared plans for a safety project at CH 33/75th Street at Book Road, known as Section No. 13-00168-08-SP (hereinafter referred to as the PROJECT ; and WHEREAS, in order to construct the PROJECT, the COUNTY has determined that it is necessary and in the public interest and welfare to acquire temporary easements over portions of the Springbrook Prairie Forest Preserve from the DISTRICT in order to relocate the existing path and construct the PROJECT and the DISTRICT has determined that it is reasonable, necessary and in the public interest and welfare to grant to the COUNTY and/or its agents, successors and assigns the EASEMENTS as provided for herein ; and WHEREAS, the COUNTY and the DISTRICT are municipalities as defined in Section 1(c) of the Local Government Property Transfer Act, 50 ILCS 605/1(c)(West 2006), hereinafter referred to as the Transfer Act ; and WHEREAS, Section 2 of the Transfer Act authorizes transfers of real estate, or interests therein, between municipalities for any public purpose upon such terms as are agreed to by the corporate authorities of the respective municipalities; and 1625001BAL -1- Resolution No. 16-212 R08
WHEREAS, in accordance with Section 2 of the Transfer Act, the County Board, pursuant to a duly passed ordinance, has determined that it is necessary to acquire two temporary easements over portions of the Springbrook Prairie Forest Preserve for the PROJECT; and WHEREAS, the COUNTY and the DISTRICT, in order to ensure the safety of the motoring public, desire to cooperate in the construction of the PROJECT because of the immediate benefit of the PROJECT to the residents of the COUNTY and to the users of DISTRICT facilities; and WHEREAS, the COUNTY and the DISTRICT desire to establish the parties mutual PROJECT cost and future maintenance responsibilities with respect to the PROJECT; and WHEREAS, the COUNTY and the DISTRICT are authorized to enter into this Agreement pursuant to the authority conferred by Article VII, Sec. 10, and the Illinois Constitution and the Intergovernmental Cooperation Act 5 ICLS 220/1 et. seq. WHEREAS, the Board of Commissioners of the Forest Preserve District of DuPage County finds that the Intergovernmental Agreement attached hereto is in the best interest of the DISTRICT and the public. NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Forest Preserve District of DuPage County as follows: 1. The preambles as set forth above are incorporated herein and made a part hereof. 2. The President is hereby authorized and directed to sign on behalf of the District, and the Secretary is hereby authorized to attest thereto, the Intergovernmental Agreement attached hereto and incorporated herein titled An Intergovernmental Agreement Between the County of DuPage and the Forest Preserve District of DuPage County Providing for the Conveyance of an Easement for the Relocation of the Existing Path and Construction of Improvements Within the Springbrook Prairie Forest Preserve, CH 33/75 th Street at Book Road, Section 13-00168-08-SP. 3.
